A RESOLUTION URGING THE DAVAO CITY CHAMBER OF COMMERCE AND INDUSTRY

INC. TO ENCOURAGE ITS MEMBERS TO ONLY CONDUCT BUSINESS WITH PRIVATE


SECURITY AGENCIES WHO HAVE SECURED THEIR REQUIRED BUSINESS PERMIT IN
DAVAO CITY

WHEREAS, Section 5 of Article X of the 1987 Constitution provides that each local government
unit shall have the power to create its own sources of revenues and to levy taxes, fees and
charges and that such taxes, fees, and charges shall accrue exclusively to the local
governments;

WHEREAS, Section 94 of the 2017 Revenue Code of the City of Davao provides that it shall be
unlawful for any person or entity to conduct or engage in any business, trade or occupation
within the territorial jurisdiction of the City of Davao, without first having secured a permit
therefore from the City Mayor and paying the necessary fees to the City Treasurer;

WHEREAS, the Permits and Licensing Division of the City Government has pointed out that
many private security agencies are operating in Davao City, without first securing a business
permit;

WHEREAS, there is a need to encourage local businesses to only employ or contract with
private security agencies who have secured the required business permit to operate their
businesses in Davao City;

WHEREAS, the term “operating in Davao City” includes not only the actual physical presence
of a security agency within the City but also the deployment of any workers to businesses
herein from an office located outside the territorial jurisdiction of the City;

WHEREFORE, premises considered, BE IT RESOLVED AS IT IS HEREBY RESOLVED, that


this resolution be passed and adopted, urging the Davao City Chamber of Commerce and
Industry Inc. to encourage its members to only conduct business with private security agencies
who have secured their required business permit in Davao City.

RESOLVED FURTHER, that copies of this resolution be furnished to the City Mayor’s Office ,
CMO - Permits and Licensing Division, Davao City Chamber of Commerce and Industry Inc.,
PNP-RCSU XI, Regional Security Association (RESA) PADPAO XI Chapter, Department of Labor
XI, and all others concerned, for their information and guidance.
