Introduction participants present made a self introduction of themselves.

Opening remarks

The opening remarks were given by Madam Christine Obondi standing in for Mr. Siambe.
The participants were informed that the workshop will address victim management in the
context of the probation. In the process of work the probation officer has to encounter victims
as key components of our rehabilitation supervision of offenders and so this places us in the
centre of the victim’s welfare. In the dispensation of the new constriction, the victim issues
are given great importance and as a department we therefore need to re-package ourselves.

Objectives of the workshop

The workshop will have both specific and general objectives

General objective Generally the workshop aims at sensitizing the senior probation officers in
the department on the victim of offences bill. Find a place for the victim in the rehabilitation
and supervision of offenders. This then called for the input of the implementers in the field,
(the field officers.)

Specific objectives

 To peruse the Bill of Rights in the Constitution its application to the victims.
 To examine the Draft Victims of offences policy and determine its applicability and
relevance in probation practice.
 To get brief highlights on the reviewed Victim Impact Statements requirements
 To determine the place of victims in supervision and rehabilitation
 To look at the role of probation officers in the realization of victims’ right, protection
and welfare
 To chart the way forward for victims issues in the department.

Bills of rights and its application to victim of offences By Ben Ong,injo

Mr onginjo stated that that both the constitution of Kenya and the UN declaration of basic
principles of justice for victims of crime and abuse of power specifies the victims right as
follows

 Right to justice and fair treatment


 Right to restitution
 Right to compensation and assistance

Article 21 of the constitution forms the basis of the law on the victims’ rights The bill of
rights on the other hand applies to all law and binds all state organs and all persons and that
every person is entitled to enjoy the rights of the freedoms in the bill of rights.

There are specific rights for the victims include the following....

The right to equality and freedom form discrimination:- In relation to the victim no gov
agency has the right to infringe on these rights.

The rights are inherent Article 19

Article 29 states the right for freedom form torture. In application to the victim ,all victims
have the right to be secured from more torture. This can be done by placing him in a safe
place. This can be so in cases of child victims.

The victims also have a right to nutrition, psycho-social care,

Article 31 gives the victim the right to privacy. This includes property. Information relating
to the family.Details of the victims communications should be confidential

All victims have the right to be addressed in a manner appropriate to ther age, intellectual dev
and language of choice culture and religiuos values
