COMPLAINT – AFFIDAVIT

I, Pia Wurtzbach- Stockinger, of legal age, Filipino,

married to the respondent, and a resident of Purok 1, Block
2, Lot 3, Southville 4, Muntinlupa City, after having been
duly sworn in accordance with law, hereby depose and
state:
1. I am and the same person who is the complainant in
the instant case;
2. I know the person of Marlon, being my husband and
who is currently residing with her mother;
3. That out of lawful marriage, we begot five (5)
children. Ma. Venus fifteen years old (15), Shamcey
thirteen years old (13), Janine Mari twelve years old
(12), Ariella nine years old (9) and Maxine pitong (7)
years old; Copies of their Certificates of Live Birth
are hereto attached and marked as Annexes “B” and
“C” respectively;
4. That in the beginning of our marriage, we lived
harmoniously as husband and wife and parents to
our children until later part that the my husband had
shown and displayed irrational behaviour not

expected from a mature and a responsible husband

and father to our children;
5. That when he went to Riyadh, Saudi Arabia to
support our family financially;
6. That when he arrived in Riyadh we were in good
standing and we still have a good communication
however after 6 months our communication got
unclear, that it got to a point that we didn’t talk to
each other at all;
7. That he didn’t support us financially when he was in
Riyadh, that he never gave us anything to help his
family;
8. That it came to a point that we suffered starvation
and we ate leftovers from fast-food and we begged
for rice from our neighbors;
9. Also our children stopped going to school because of
financial constraint that our family was suffering, I
was not able to work because my husband forbid me
to work for our family;
10. That my husband often hurt me when his mood is
not that good, he punched me on different parts of
my body, there was a time that he punched me in
the face that resulted in the breaking of five of my
teeth and my nose bridge was broken;
11. That he one time uses a flat iron to burn me in the
arms, after the multiple times that he hurt me, he
also began being violent in having sexual intercourse
that he always cursed me saying that I am a whore
and I was a whore for the whole city
12. That I always felt like dirty and worthless after we
have sexual intercourse

13. That when he returned to the Philippines without

my knowledge he stayed with his mother with the
company of his mistress
14. When I was browsing “facebook” I saw their
pictures lying in bed with only white sheets to cover
them while they were hugging
15. I felt like I was being poured with a very cold
water and I was in shocked
16. That his overt acts of inflicting physical harm is
tantamount to physical violence;
"Physical Violence" refers to acts that include bodily or
physical harm;

17. That his act of continuous failure to give support

since the year 2011 tantamount to economic abuse
which is defined under R.A 9262 or Violence Against
Women and their Children as:
"Economic abuse" refers to acts that make or attempt to
make a woman financially dependent which includes, but is not limited
to the following:

1. Withdrawal of financial support or preventing the victim

from engaging in any legitimate profession, occupation,
business or activity, except in cases wherein the other
spouse/partner objects on valid, serious and moral
grounds as defined in Article 73 of the Family Code;

18. That his having a overt relationship with Mary

Jane is tantamount to Psychological Violence as
defined under the law as:
1. “Psychological violence" refers to acts or omissions
causing or likely to cause mental or emotional suffering of
the victim such as but not limited to intimidation,
harassment, stalking, damage to property, public ridicule or
humiliation, repeated verbal abuse and mental infidelity

19. That I cause the preparation of this affidavit to

support my complaint.
