PROBABLE CAUSE AFFIDAVIT

I, Rebecca A. Schmuhl, a law enforcement officer with the Indiana University Police
Department, being duly sworn upon my oath, state that on or about the 31st day of
December, 2017, Levi Jacob Lewis committed a criminal offense. Such belief is based
upon the following:

On or about the 30‘“


December day of 2017, Detective Aussieker, with the Evansville
Police Department (EPD), notified IUPD Sgt. Kyle Moulden that EPD was investigating
a homicide involving IU student Levi Lewis. During the course of EPD‘s investigation, it
was discovered that Mr. Lewis and non-student Michael Pardee went to Evansville to
sell drugs. According to EPD investigators, Mr. Lewis arranged for the sale along with
Mr. Pardee and while in Evansville Mr. Pardee was killed. Det. Aussieker advised that
Mr. Pardee left his truck parked in the parking lot of Mr. Lewis’ fraternity, Tau Kappa
Epsilon, 1640 N. Jordan Ave. Bloomington, IN 47406, and that it may contain additional
narcotics. IUPD officers located the vehicle and searched it after obtaining a search
warrant. Inside the vehicle officers located, among other things: 14 one pound bags of
marijuana; over $3000 in cash; 26 Vyvanse pills prescribed to Mr. Lewis; 3 500mg vape
canisters; and a small notebook and papers that appeared to be ledgers.

On December day of 2017, spoke with Det. Aussieker who stated

that EPD was


granted a search warrant for Mr. Lewis' phone and they found evidence
on the phone that Mr. Lewis was involved in Iarge scale narcotics sales, some of which
were conducted at The Tau Kappa Epsilon House. requested and was granted a

search warrant for Mr. Lewis‘ room in the Tau Kappa Epsilon fraternity. During the
search IUPD Ofc. Harden and located, among other things: three glass smoking
|

devices; a set of Triton T3 scales, a glass mason jar containing 12 grams of marijuana

stems; a plastic bag containing marijuana (2 grams bagweight); four THC vape cartriges
and a vape pen; two large plastic bags with marijuana residue; four nuggets of
THC/marijuana edibles weighing 4 grams; and a small amount of suspected cocaine.
Based on my training and experience as a Law Enforcement Officer know that |

individuals buying and selling narcotics often communicate using the messaging and
chat features of mobile electronic devices. On or about the 18‘“ of January, 2018 |

began to review the text messages recovered by EPD from Mr. Lewis' phone. The
messages begin on or about the month of December of 2016. In his text messages Mr.
Lewis refers numerous times to making and/or selling THC/marijuana edibles, including
brownies, chocolates, and moonrocks.

In a text conversation with Andrew Moy, that occurred on or about the 14‘“ of
December 2017, Mr. Moy asks "Hm [how much] for 10 Chocolates". Mr. Lewis replies
"How much can you get em to pay? usually say 350 lol [laugh out loud]" Mr. Moy then

states "It‘s the same kid that bought 25" "That's deez". To which Mr. Lewis says "Ya, u
should charge him 350 for 10 then give u a cut as well" "Like $25". Mr. Moy replies
ill

"Ight". The conversation continues a little longer and ends with Mr. Moy saying "I need

the chocolates" and Mr. Lewis replying "My room".

On or about the 8‘“


March 2017, in a text conversation with Matt Winkeljohn, Mr.
of
Winkeljohn stated, "Yo homie. my buddy AJ was wondering if he could possibly throw
you a half O and you make the brownies for it? We would throw you $50 to make all of
them or more if you needed". Mr. Lewis replied, "Yeah lol thats cool. have 60 brownies

ready rn [right now] you can come now if u want". Mr. Winkeljohn responded, "Oh shit
that's hype, forsure. Be there soon". The "half O" referred to by Mr. Winkeljohn means
half an ounce, usually of marijuana.

Onor about the 14th of November 2017, in a text conversation with Karlie Somerton,
Ms. Somerton stated, "also random but what all do you sell". Mr. Lewis replied "I mean
shrooms and moonrocks rn. Other things from time to time. Acid often". Ms. Somerton
then asks Mr. Lewis if he sells "coke" or "molly" to which he replies that he sometimes
does and that he can get some if she wants it. Ms Somerton states that she wants some
"molly” for a concert she is attending on "thursday night". Mr. Lewis agrees to find some
for her. Moonrocks are the slang term for marijuana buds that have been diped in THC
oil or something similar. Molly is a slang term for MDMA or Ecstasy.

On or about the 19'“ of


March 2017, in a text conversation with Shawntain North, Mr.
Lewis asks Mr. North if he is working. Mr. North replies that he will be off in an hour and
a half. Mr. Lewis then states, "Damn. Made my moonrocks was gonna ask u to test".
On 0r about the 23m day of March 2017, in a text conversation with Nick McFadden,
Mr. McFadden asks Mr. Lewis for a picture of the moonrocks which Mr. Lewis then
sends him. Mr. McFadden and Mr. Lewis then discuss amounts and Mr. McFadden
settles for a "quarter" which Mr. Lewis states with be "250". The next day they meet at
Mr. Lewis' place. A few days later Mr. McFadden texts Mr. Lewis, "Yoo I'm not really

feeling these moonrocks they don't taste good".

Mr. Lewis'
presented above. Also on the phone were numerous photos and videos. Among the
photos recovered from Mr. Lewis' phone is a screen shot of a recipe for moonrocks.

There were also images of marijuana and marijuana edibles that Mr. Lewis had sent to
individuals when they asked for pictures of what he had for sale.

On or about 2nd
day of February 2018, had Mr. Lewis' crimina! history run through

of Marijuana as a Class B misdemeanor.

am requesting that Mr. Lewis be charged with Possession of Paraphernalia

C misdemeanor, Possession of Marijuana a Class B misdemeanor, and dealing in

Marijuana a Level 6 felony. The date of the conviction was the 2nd of February 2017.

AII known involved parties are over the age of eighteen.

These events occurred in Bloomington, Monroe County, Indiana.
