Under the Arkansas Freedom of Information Act § 25-19-101 et seq., I am requesting an opportunity to inspect or obtain
copies of public records regarding:

Vehicle damage reports, including but not limited to emails or memorandums regarding accidents or other
damages; repair invoices and costs, for all city owned or leased vehicles in use by the Little Rock Police
Department.

Time frame for this request is December 2017 through the date of this request.

Under 105(e), an agency has three business days to respond where (1) a public record is in active use or storage AND (2)
the record is therefore not available at the time a citizen asks to examine it. Thus, even if a record is in active use or
storage, it must still be provided more or less immediately upon request if it is not unavailable to the custodian. If
access to the records I am requesting will take longer, please contact me with information about when I might expect
copies or the ability to inspect the requested records.

I am requesting that the information requested be supplied to me in electronic form and sent via email to
russracop@att.net.

Please note that § A.C.A. 25-19-105 (e) (4) states that If it is necessary to separate exempt from nonexempt information
in order to permit a citizen to inspect, copy, or obtain copies of public records, the custodian shall bear the cost of the
separation.

Also reference Arkansas Attorney General’s Opinion No. 2010-140 regarding a state agency must bear the cost associated
with redactions no matter the size or amount of documents involved. And this matter is also addressed in Watkins, J., et
al., "The Arkansas Freedom of Information Act" (6th ed.), at p. 303, "Moreover, the custodian must bear any cost arising
from segregation of exempt and nonexempt information.”

If you deny any or all of this request, please cite each specific exemption you feel justifies the refusal to release the
information and notify me of the appeal procedures available to me under the law.

I believe that you have confused the information about take home cars and fuel with the request for "Vehicle damage
reports, including but not limited to emails or memorandums regarding accidents or other damages; repair invoices and

I keep detailed records of requests and those receipts you have me sign are done so without reviewing the material
provided on the cd/dvd.

While you may think you have provided it you have in fact not.

I would have thought that somewhere in LRPD HQ there would be a copy of the LRPD Generals Orders, but I found out
last Friday that is not the case.

Seriously, are you so thick headed that you cannot understand that the information I asked for ( accident info) was not
placed on the disc I picked up. Look at the screenshot provided. The information on the disc (take home car) was
material previously provided in response to a separate FOI request/response.

Dear Lieutenant Ford and Mr. Racop,

I have been following this chain and it seems like the City thinks the information was provided and Mr. Racop
thinks otherwise. There was an email sent today that threatened suit if the information was not provided today. I
spoke with Mr. Racop earlier and told him that I am under an incredibly tight deadline to complete an amicus brief
to the U.S. Supreme Court no later than tomorrow morning. May I suggest that on Friday we find some time and all
three of us (and anyone else who need to come) sit down and try to figure out what happened? I offer my office as a
place to hold this meeting.

Please understand that I am responded to emails upon which I have been copied. I know that LRPD tries to
comply within the time frames for FOIA, but I am not sure that both parties are describing the same information. So,
I offer this up more as a mediation than anything else. The key is that if the information is subject to release the City
certainly wants to release it. What I cannot tell is where the communication breakdown appears to be. So, instead of
lawsuits, I would like to get the information out.

Please let me know if a Friday meeting would be acceptable? I have a 10:30 meeting on Friday, and I am supposed
to be a witness in court at 9:00 (on a property tax matter – I would rank it up there with a root canal, but my dentist
managed to do root canals on me with no pain and no problems afterward; hopefully you get the point). I do not
believe that testimony will take more than an hour. So perhaps early in the afternoon on Friday would work.

Why is a meeting necessary when LRPD simply placed the wrong material on the disc provided to me? If they cannot
understand the written word and pictures, I have little belief that spoken words will make much difference in helping
them have a clear picture of their mistake and the simple steps it takes to avoid unnecessary litigation and further
embarrassment.

They just need to email the requested material sought in my 01/29/2018 FOI request.

I have been following this chain and it seems like the City thinks the information was provided and Mr. Racop thinks
otherwise. There was an email sent today that threatened suit if the information was not provided today. I spoke with
Mr. Racop earlier and told him that I am under an incredibly tight deadline to complete an amicus brief to the U.S.
Supreme Court no later than tomorrow morning. May I suggest that on Friday we find some time and all three of us (and
anyone else who need to come) sit down and try to figure out what happened? I offer my office as a place to hold this
meeting.
Please understand that I am responded to emails upon which I have been copied. I know that LRPD tries to comply
within the time frames for FOIA, but I am not sure that both parties are describing the same information. So, I offer this
