AN ORDINANCE REVISING MAKATI CITY ORDINANCE NO. 2004-A-010

(AN ORDINANCE ENACTING THE MAKATI CITY ANIMAL
REGULATION AND CONTROL CODE PRESCRIBING REGULATORY
FEES AND PENALTY FOR VIOLATION THEREOF), SUBJECT TO ALL
LAWS AND EXISTING LEGAL RULES AND REGULATIONS.

ARTICLE I

GENERAL PROVISIONS

Section 1. This Ordinance shall be known as the “Makati City Animal Regulation & Control Code”.
 ARTICLE II

Section 2. DEFINITION OF TERMS – As used in this Ordinance, the following terms shall mean
and defined as follows:

Animal – refer to any animal of whatever specie, genus, family, size and purpose which include, but
not limited, to dogs, cats, birds, etc.

Animal carcass waste - refers to animal carcass, animal tissues, organs, blood or its components and
body fluids.

Animal Owner – refers to any person keeping, harboring or having charge, care or control of an
animal including his/her representative and allows any such animal to remain about his premises for a
period of no less than ten (10) days.

Animal License – refers to the authority issued by the City Government allowing a person to possess
or keep an animal for whatever purpose, except those already covered by separate permits.

Animal Registry – refers to a log where the identity of the animal and its owner are registered.

Animal Control Facility – refers to an establishment operated and governed by the City Government
of Makati which consists of an animal diagnostic laboratory and medical facility, spay/neuter center
and dog impounding.

Animal Facility – refers to an establishment, other than that of the local Government Unit, utilized for
breeding, maintaining, keeping, treating or training of all animals, including birds, either as object of
trade or as household pets. This includes but not limited to, pet shop, kennel, veterinary clinic,
veterinary hospital, stockyard, corral, stud farm, zoo, aviary and slaughterhouses.

Animal Welfare – the avoidance of exploitation of animals by maintaining appropriate standards of

accommodation, feeding and general care, the prevention and treatment of disease and the assurance
of freedom from harassment and unnecessary discomfort and pain.

Animal Welfare Organization – refers to licensed group of individuals, whose main concern is the
welfare of animals.

Dog – refers to a common quadruped domestic animal belonging to the other Carnivora (male or
female), scientifically known as Canis familiaris.

Dog Farming – refers to the raising of dogs for meat, fur and other articles intended for human
use/consumption.

Euthanasia – mercy killing; putting an end to the life of the animal by humane means in accordance
with Republic Act 8485.

Exotic/Endangered Animal Specie – refers to animals under the endangered list of the Department of
Environment and Natural Resources (DENR).

Female dog – means any dog of the female gender that has not bees neutered.

Foster Animal Owner – animal owner keeping animals under custody for a period of no more than
two (2) months.

Infectious wastes – refers to used cotton, gauze, gloves, intravenous lines, catheters, disposable
infected sheets used in veterinary medical treatment and operation.

Kennel – a small shelter for dogs where they are bred or kept; a dog house.

Male dog – means any dog of masculine gender, either castrated or not castrated.

Neutering – refers to the surgical removal under anesthesia of the ovaries and uterus in the female and
testicles for the male animals, performed by a licensed veterinarian.
Neutered female – refers to any female animal on which ovaries or uterus have been surgically
removed by a licensed veterinarian and is accompanied by a certificate that operation has been
performed.

Neutered male – refers to any male animal on which testicles have been surgically removed by a
licensed veterinarian and is accompanied by a certificate asserting that operation has been performed.

Other animals – refers to animal other than dogs and cats which are kept or cared for by persons as
pets.

Pet Shop – any store or establishment selling live animals as pets.

Rabies – refers to a highly fatal disease caused by a Lyssa virus, transmitted mainly through the bite
of an infected animal and is characterized by muscles paralysis, hydrophobia and aerophobia and
other neurological manifestations.

Stray Animal – means any unlicensed or licensed animal leaving its owner’s place or premise and
found loose anywhere in the City limits. Also an animal tied outside its owner’s premises without its
owner or is not under its owner’s control.

Vicious Animal – means any animal with known tendency to attack unprovoked or to cause injury, or
otherwise threaten the safety of human beings or other animals, or has bitten any person.

Vaccination – means inoculation of dog/cat with standard Rabies vaccine by a licensed government
or private veterinarian or trained individual under the direct supervision of a licensed veterinarian.
The services of the said trained individual shall be limited only to rabies vaccination injection in dogs
and cats and only during government mass vaccination campaigns.

Veterinary Medical Waste – refers to animal carcass wastes, infectious wastes and sharps (eg.
Needles, syringes, scalpels, broken vials/ampule).

ARTICLE III

ANIMAL LICENSE / REGISTRATION

Section 3. Licensing and Registration

It is hereby required that all dogs, cats and other animals which could be carriers of rabies virus to be
licensed and registered in the City and the Barangay Animal Registries. The Barangay Animal
Registry will be responsible in monitoring their constituents for compliance. Otherwise, confiscation
of the animal/s will be done by the barangay upon the recommendation and assistance of the
Veterinary Services Office.

Only a maximum of two (2) adult dogs and three (3) adult cats shall be allowed per entire household,
unless a conditional permit will be granted by the City Animal Registrar. The special permit will only
be issued to owners who comply with the following conditions:

1. Compliance to Article IV, Section 8.

2. Excess number of animals that can be kept shall be dependent on the area that can be
provided by the owner. The area should be sufficient enough based on the space
requirement appropriate per animal.

For individually cages dogs:

Dogs confined in either cages or kennels should have room to move about normally.
Cages for indoor holding should be clean and sanitary and should follow these minimum
size guidelines:
a. Large dogs (more than 50 pounds) – at least 4 feet by 6
Feet or 24 square feet
b. Medium-sized dogs (36-50 pounds) – at least 4 feet by 5
Feet or 20 square feet
c. Small dogs (10-35 pounds) – at least 3 feet by 4 feet or 12
Square feet
 For shared kennels:
Dogs who share kennels must be evaluated for compatibility and monitored closely.
Each should have ample room to stand, lie down, turn around and sit normally. This
requires a minimum area of 4 feet by 4 feet for each dog. A shared 5 feet by 10 feet
kennel should hold no more than two (2) large dogs or two (2) medium dogs or three (3)
small dogs.

For cats:
The cage will be of the same size as that of a small dog.

3. Kennels with runs, whether fully enclosed (outdoor or indoor) should follow this
minimum size guidelines.

Kennels – 4 feet by 6 feet

Runs – 4 feet by 8 feet

4. All excess number of dogs and cats should likewise be vaccinated against rabies and
licensed or registered annually.

5. No complaints regarding the keeping of such number of dogs or cats such as running
loose, noise, foul odors, defecation, damage to property injury to persons and other
associated circumstances.

6. An amount of P500.00 to be paid for the said special permit and should be renewed
annually.

Failure to comply in any one of the aforementioned conditions shall be a ground for revocation of the
license and special permit, confiscation of the excess number of animals and payment of appropriate
penalties provided under Article IV, Section 13. The above legal actions will be done upon the
discretion and direction of the Veterinary Services Office and will be implemented by the barangay
with the assistance of the Makati City Pound and, if necessary, of the Makati Police.

Requirements for Licensing and Registration:

1. Accomplished Registration from and Undertaking
2. Certificate of Anti-Rabies Vaccination, if vaccinated by a private veterinarian
3. Rabies Vaccination, if unvaccinated
4. If neutered, a certification from the veterinarian
5. Two (2) pieces 1x1 picture of your pet
6. Special permit, for those with excess number of animals

Process of Registration and Vaccination in every barangay:

1. The owner should first complete all the above mentioned requirements.
2. Then fill out two (2) copies of the registration from and an Undertaking
3. Submit accomplished registration from with all the requirements to the Barangay Animal
Registry or to the City Animal Registry.
4. If pet is unvaccinated, submit pet for rabies vaccination and a vaccination certificate will
be issued by the Veterinary Services Office.
5. Payment of Fees. Fees will be collected by the barangay or City representative.
6. Claim slip for the license or ID will be issued by the barangay or the Veterinary Services
Office indicating the date when the ID can be claimed.

Section 4. Vaccination

Animals which could be carriers of virus, such as dogs, cats, etc., are required to be vaccinated to
quality for registration. Certificate of Vaccination issued and/or validated by the City Veterinarian
shall be a requirement for animal registration.

Every veterinarian performing vaccination shall furnish the owner of any dog/cat vaccinated a
certificate of vaccination, which shall be presented to the Barangay Animal Registrar who, upon
payment of city license fee, shall forward all the requirements to the City Animal Registrar for the
issuance of the ID/license. No license shall be issued for any dog/cat without the production of a
certificate of vaccination and payment of license fee.
It shall be the duty of any person who owns or harbors any dog/cat in the city to have such dog/cat
inoculated by a licensed veterinarian. Vaccination shall be valid for a period of one (1) year from date
of inoculation.

Section 5. License / ID and Animal Tag

The City Animal Registrar, through the Barangay Animal Registrar, shall issue a license or ID to the
owner or harborer of the animal containing the following information:

a. Name and address of the owner/harborer

b. Date of issuance of license
c. License number
d. Name, breed, species, birth date, sex and color/markings of the animal

The animal tag shall be made of durable material which should be attached to the collar or harness of
the animal. The tag shall state the year for which it is issued and the series number of the license.
Only one tag per animal shall be issued.

Other identification system may also be established by the City Animal Registrar such as:

a. Dog identification card/vaccination

b. Ear tattooing
c. Microchip

Dogs which are duly registered shall be given 20% discount on laboratory fees and free tick and
worm treatment once a year, on the premises that its registration is updated.

Section 6. Wild / Endamgered Animals

Keeping of wild/endangered animal specie in residential areas is prohibited, with the following
exceptions:

Birds, except as otherwise provided by law;

Hamster
Guinea pigs
White rats/mice
Nonpoisonous snakes, except as otherwise provided by law;
Turtles
Nonpoisonous toads
Lizards
Salamander
Chameleons
Fish, except as otherwise provided by law

Section 7. Regulatory Fees

The following regulatory fees for license shall be collected from pet owners.

Animal license shall be renewed annually for a fee corresponding of P50.00. For the renewal, the
owner should present both the Pet’s Identification Card and Vaccination Card/Certificate. In case of
lost Pet Identification Card, the owner maybe issued a new card upon presentation of the
requirements and payment of P50.00 and maybe claimed after one week.

The vaccine and dog tag will be given for free. But in the case of failure to present previous
Vaccination Card and dog tag, the owner shall pay a penalty of P50.00 and shall be given a new card.

While the registration fees collected shall be shared by the Barangay concerned and the City
Government at the ratio of 50-50.

Article IV

OWNER’S DUTIES AND RESPONSIBILITIES

Section 8. Animal owners shall have the following duties and responsibilities. Failure to perform any
of these will be penalized by the implementing bodies through an Ordinance Violation
Receipt (OVR):

(a) Take care and provide for the needs of their animals such as proper grooming, adequate
food and clean shelter and to prevent any form of cruelty to their animals in accordance
with Republic Act 8485, otherwise known as the Animal Welfare Act of 1998.

(b) Should keep their animals within their premises. Also, owners should not tie or leash
their animals in any public property such as sidewalks or streets.

(c) To keep his/her animal, particularly dog, under control or physical restraint as to prevent
such animal from becoming a danger to persons or property or from trespassing upon the
property of the other.

(d) Prevent his/her animal, particularly dog, to run loose in public places, and must not allow
it to roam the streets or any public place without a leash. The length of the leash shall not
be more than 1.5 meters (5 feet) and the required dog tag shall be attached to the dog
collar/harness. Aggressive dogs shall be muzzled in public places.

(e) Must not allow the animal to defecate on another person’s property, on any street lane,
boulevard, and pathway or on any public place. If unavoidably, the animal defecates on
the said places, the owner is responsible for the proper collection and disposal of the
excreta/feces.

(f) Must not allow animal to bark indiscriminately or make noises frequently so as not to
disturb the peace and quiet of the neighborhood.

(g) May keep other animals provided that they are confined in owner’s premises.

(h) Should be liable for any damage to property and/or injury to person, including medical
expenses and other incidental expenses, caused by their animal while outside their
premises or within their premises with the owner’s permission.

(i) Within 24 hours, report immediately any dog biting incident to the concerned officials for
investigation or for any appropriate action and the dog should be placed under
observation by a government or private Veterinarian. Suddenly death of any animal
should also be reported immediately.

Owner/harborer shall execute an Undertaking to perform the aforementioned obligations and that
he/she will be liable for any damage to property and/or injury to person caused by his/her pet within
his/her premises or at stray. The Undertaking shall be part of the requirements for registration.

Failure to perform by the owner of any of the aforementioned duties and responsibilities shall be a
ground for the revocation of license without prejudice to the penalty provided under Section 13
hereof.
 Article V

IMPOUNDMENT AND DISPOSITION OF ANIMALS

Section 9. Impoundment of Stray Animals

It shall be the duty of the Makati Veterinary Services Office/City Pound/Public Safety Department
(MAPSA) personnel and the Barangay to impound at the City Pound any animal/s running at large
within the city limits. Animal impounded shall only be released to its owner after paying fines
imposed under this ordinance. Besides payment of penalty, owners of impounded dogs should present
the following before redeeming their dogs:

1. Pet’s Identification Card and/or Animal Tag

2. Pet’s Vaccination Certificate or Card

An animal shall be deemed to be “at large” when off the owner’s premises and/or either not on a leash
and controlled by its owner or other person, or on a leash but tied stationary on public place or
property and/or pollutes property or vegetation belonging to someone other than the owner, or by any
means whatsoever injuring or damaging the property of one other than its owner or members of
his/her household except in defense of the owner, his family or property, and this shall be true
whether under control or not.

Section 10. Unvaccinated dogs/cats

Unvaccinated dogs/cats, or dogs/cats not vaccinated within one (1) year, known to have been bitten or
exposed to a rabid animal, shall be euthanized. Dogs/cats vaccinated within one (1) year and known
to have been bitten by a rabid animal shall be revaccinated immediately and confined for ninety (90)
days.

Section 11. Disposition

In case nobody claims the animal after three (3) days from the date of impoundment, the same shall
be put or offered for sale/adoption for petting purposes, donated to institutions for medical/scientific
study purposes and/or disposed of by means of euthanasia. The adopter shall pay an adoption fee of
P150.00 plus the cost/s of safekeeping and the license fee. All animals to be adopted should be
neutered and vaccinated against rabies before being released. Amount of such shall also be added to
the adoption fee.

All Veterinary Medical Wastes which includes carcasses of euthanized animal shall be collected and
disposed of properly by a Waste collection and disposal Service Provider contracted by the City
Government of Makati or through any other means of disposal authorized by law such as incineration,
donation to medical institutions and other animals facilities, etc.

Section 12. Quarantine

A dog/cat which is known to have bitten or injured any person so as to cause an abrasion of the skin,
or a dog/cat which in the opinion of any licensed veterinarian to be rabies suspects, shall be closely
confined by its owner in accordance with the direction of the City Veterinarian or Barangay.

If the owner of the dog/s referred to in subsection A cannot be determined or located, then the City
Veterinarian or Barangay shall order the confinement of the dog at the City/Barangay Pound for a
period of not less than ten (10) days. If the dog is determined to be suffering from rabies, or the
symptoms thereof, it shall be destroyed forthwith.

All other dogs known to be exposed to a rabid dog shall also be confiscated and impounded or
disposed of properly. Owners who refuse to surrender their dog will have sign a waiver stating that
he/she is well informed and warned the consequences of such action.

It is unlawful for any person knowing or suspecting a dog has rabies shall allow such dog to be taken
off his premises or beyond the city limits without the written permission of City Veterinarian. Every
owner or other person, upon ascertaining a dog/cat is rabid, shall immediately notify the
barangay/city veterinarian which shall either remove the dog to the pound or summarily dispose it.
 Article VI

PENALTY

Section 13. The penalty for violation of any of the provision of this ordinance shall be penalized as
follows:

For violation of Section 3.

First offense - P1,000.00 fine and registration of animal or submit the animal for
neutering and payment of 50% of the registration fee.
Second offense - P1,500.00 fine and registration of animal or submit the animal for
neutering and payment of 50% of the registration fee.
Third offense - P2,000.00 fine and confiscation of the animal.

For violation of Section 4.

First offense - P1,000.00 fine and submit the animal for Vaccination.
Second offense - P1,500.00 fine and submit the animal for Vaccination.
Third offense - P2,000.00 fine and submit the animal for Vaccination.

For violation of Section 6 & 12.

First offense - P 500.00 fine and confiscation of animal.
Second offense - P1,000.00 fine and confiscation of animal.
Third offense - P2,000.00 fine and confiscation of animal.

For violation of Section 8.

First offense - P 500.00 fine or submit the animal for neutering.
Second offense - P1,500.00 fine or submit the animal for neutering.
Third offense - P2,000.00 fine and confiscation of animal.

For violation of Section 8, subsection H.

Refusal of the owner to shoulder the medical expenses of the person bitten by their dog shall be
meted a fine of Twenty Five Thousand Pesos (P25,000.00).

For violation of Section 9.

First offense - P1000.00 fine, registration of animal and submit the animal
for Vaccination or submit the animal for neutering and
payment of 50% of the registration fee.

For violation of Section 20.

First offense - P 500.00
Second offense - P1,000.00
Third offense - P2,000.00 and revocation of business permit

For violation of Section 25 & 26.

Any person guilty of trading dogs for meat shall be fined not less than Five Thousand Pesos
(P5,000.00) per dog and subject to imprisonment for one (1) to four (4) years.

Section 14. The Makati Public Safety Department, Veterinary Services Office and the Barangay are
directed to strictly implement this Ordinance and are deputized to confiscate animals under the
provisions of this Ordinance. The Makati Police Department is hereby directed to assist said officials
in the confiscation.

Article VII

MAKATI CITY ANIMAL REGISTRY

Section 15. Establishment of Animal Registry

It is hereby established the City and Barangay Animal Registries in Makati. The City Veterinarian
and Barangay Kagawad for Health and Nutrition Committee of each barangay are hereby designated
as City and Barangay Registrars, respectively.
Section 16. Barangay Animal Registry

The Barangay Registrar shall be charged with the duty of registering animals, particularly dogs and
cats, within their barangay. The list of registered animals shall be forwarded to the City Registrar,
together with all the requirements, before the end of each month.

The Barangay Registrar shall also submit a yearly report of all the animals registered in their
barangay to the City Animal Registry.

Section 17. City Animal Registry

The City Animal Registry shall be charged with the duty of collating data from the Barangay
Registries and shall manage the centralized animal registry for Makati City, including the supervision
and control on the issuances of animal licenses/ID and tags.

Article VIII

ANIMAL CONTROL FACILITY

Section 18. Establishment of Facility

It is hereby established a City Animal Control Facility under the control and supervision of the City
Veterinary Services Office. The facility shall consist of:

All neutered dogs and cats will be permanently marked. The marking will be based in accordance
with international standards.

Fees collected under this Section shall go to a Trust Fund for the exclusive use of the City Veterinary
Office.

Article IX

ANIMAL FACILITY MONITORING

Section 20. It is hereby required that all animal facilities, other than that of the Local Government
Unit, is required to secure an Animal Welfare Certificate of registration from the Bureau of Animal
Industry. It is hereby required that the said certificate of registration be included as one of the
requirements before the issuance of a Mayor’s Business Permit. Therefore no animal facilities shall
operate without first securing the said certificate.

In addition to the aforementioned certificate, animal facilities keeping wild animals should also
secure a Certificate of Wildlife Registration from the Protected Area and Wildlife Bureau (PAWB) of
the Department of Environment and Natural Resources (DENR).

It is the duty of the Makati Veterinary Services Office to conduct regular monitoring and inspection
on the compliance of all animal facilities within the city, in accordance with the provisions of the
Animal Welfare Act.

Pet shops and other animal facilities are also required to post information regarding Rabies and
Responsible Pet Ownership.

For record purposes, such as Makati’s animal population survey and other baseline data, all animal
facilities shall provide all the necessary information and data required from them by the Makati
Veterinary Services Office.

Article X

ISSUANCE OF ORDINANCE VIOLATION RECEIPT (OVR)

Section 21. Only the Makati City Pound and Veterinary Services Office personnel or other Barangay
Enforcers deputized by the City shall issue the OVR to violators of this Ordinance.

Section 22. OVR shall be issued to Pet owners who violate any of the provision of this Ordinance
including, but not limited to the following circumstances:

A. During Stray Dog Operation where:

1. Stray dog have already been caught but escaped.
2. Stray dog ran back home.
3. Stray dog have been caught but was snatched and held back by struggling
owners.
4. The dog is tied stationary outside the owner’s premises or in public places.
 5. The streets are narrow and the impounding vehicle is unable to enter.
6. Stray dog is caught defecating or polluting on another person’s property or
on public places.

B. Violators of Article III, Section 3, during monitoring and inspection.

C. Unsettled complaints forwarded by the barangay to our office. The said complaints are
those issues and cases that the Lupon ng barangay wasn’t able to settle or resolve.

D. Failure to perform any of the owner’s duties and responsibilities stated in Article IV,
Section 8.

Section 23. Procedure of issuance

1. The stray dog will be shooed by enforces to know to whom it belongs. If the dog
is tied in a public place, the enforcer should find the owner.

2. The OVR will be issued to concerned owner after being informed of the
violation committed and of the corresponding fines.

3. All duplicate copies of the OVR issued will be forwarded to the Veterinary
Services Office.

4. The violator will only be given three (3) working days to comply.

5. In case of failure to comply, appropriate legal charges will be filed against the
owner.

Section 24. Disposition of Fines.

The fines collected using the OVR for the violation of this Ordinance shall accrue in favor of the
following:
1. 60% to the city government
2. 15% to fund the following:
a. Training of Veterinary Office and Makati City Pound personnel.
b. Maintenance and Improvement of the Makati’s Animal Control
Facility and City Pound.
c. Veterinary Service Information, Education and Communication (IEC)
campaigns.
3. 25% to fund the incentive program in support to this Ordinance. 15% of which
will be given to the apprehending officer while the remaining 10% will be
given to his agency/office.

Article XI

DOG FIGHTING AND DOG MEAT TRADING

Section 25. It is strictly prohibited the trading of dog meat. The trade of dogs shall include but shall
not be limited to buying and/or selling of dogs, dog meat and carcasses, dog farming, collecting,
and/or slaughtering of dogs for commercial consumption.

Section 26. It shall be unlawful for any person to maltreat, kill or torture any animal or subject any
dog to dogfights.

Article XII

MISCELLANEOUS PROVISIONS

Section 27. If for any reason/s, any part of this Ordinance is declared illegal or invalid, other parts or
provisions not affected shall remain valid and in full force and effect.
Section 28. The Makati Public Safety Department, City Veterinarian and Barangays are directed to
strictly implement this Ordinance.

Section 29. This Ordinance shall take effect after its enactment by the Sangguniang Panlungsod and
approval of the Mayor and fifteen (15) days after its posting and publication in a newspaper of local
circulation.

Subject to all laws and existing legal rules and regulations.

WHEREAS, prevention of a rabies epidemic and instilling of discipline among animal owners,
particularly those with dogs and cats, call for the enactment of this Makati City Animal Regulation
&Control Code;

WHEREAS, this code seeks to address incidents of animal bites and stray animal in public places in
the interest of public safety and health. Also, as a means of discouraging breeding while encouraging
neutering; to ensure that every pet is traceable to its owner and to promote responsible pet ownership;

WHEREAS, It is the purpose of these amendments to protect and promote the welfare of all animal
by supervising and regulating the establishment and operations of all facilities utilized for breeding,
maintaining, keeping, treating, or training of all animals either as objects of trade or as household
pets.

NOW, THEREFORE, BE IT RESOLVED, AS IT IS HEREBY RESOLVED BY THE

SANGGUNIANG PANLUNGSOD OF MAKATI, METRO MANILA, BY VIRTUE OF THE
POWERS VESTED IN IT BY LAW, IN SESSION ASSEMBLED, THAT:

Section 1. Making City Ordinance No. 2004-A-010 is hereby revised, subject to all laws and existing
legal rules and regulations.

Section 2. This Ordinance shall take effect immediately upon its approval.

Section 3. Let copy of this Ordinance be furnished the Makati Veterinary Service Office and other
concerned offices for their information and guidance.
