Fax (413) 259-2402 Amherst, MA 01002-2351 Email: inspections@amhersima.gov CEASE AND DES Certified Mail and Email: 7015 1660 0001 0673 0591 Property: 326 West Pomeroy Lane, Amherst, MA 01002 Owner: Michele Chandler Date of inspection: February 8, 2018 You are in violation of Town of Amherst Zoning Bylaw (ZBL), Section 5.014 which requires the accessory use of property to be registered with the Board of Health, You must remove all livestock, including but not limited to, chickens, rabbits and goats, from the property no later than February15, 2018. Further, due to the history of nuisance complaints and concerns for animal well-being, no application for a livestock permit will he accepted for your property. ‘On November 15, 2016 the Amherst Board of Health discussed a nuisance complaint regarding ‘odors and animal intrusions. Health Department Director Julie Federman and Animal Welfare Officer Carol Hepburn reported on problems that have occurred repeatedly at your property during the last several years, and expressed concerns that the animals are not being maintained in a manner consistent with the animals? well-being and the need to respect abutters’ privacy. ‘On December 13, 2016, an inspection was conducted of your property by the health department, and you discussed your plan to relocate your rabbits to 357 West Pomeroy Lane. The owner of that property, Brie Spokas, was present and agreed to the plan, On May 2, 2017, an inspection was conducted of your property by agents of the health department and the animal control officer. On this date, Ms. Federman wrote to you regarding the relocation of rabbits and goats to 357 Pomeroy Lane and provided you with an application for a livestock permit, On May 17, 2017, Ms. Federman wrote to Mr. Spokas regar goats t0 357 Pomeroy Lane and provided him with an application for a livestock permit In January 2018, the health department received a nuisance complaint regarding odors coming from your property. On February 8, 2018, the health inspector conducted and inspection of your property at 326 West Pomeroy Lane and observed multiple rabbits in hutches and a strong odor of animal waste, ‘To date, no application fora livestock permit has been received by Amherst Inspection Services. If you feel aggrieved by said decision or, any officer or Board of the Town, may within 30 days, appeal to the Zoning Board of Appeals. ‘You have @ right to request a hearing before the Board of Health. ‘This request must be made by ‘you, in writing, and filed within 7 days after the day this order was served. Ifyou request a hearing, all affected parties will be informed of the date, time, and place of the hearing, and of their right to inspect and copy all records concerning the matter to be heard. ‘The petitioner has the right to be represented at the hearing.
