Pursuant to Local Rule 16-10, Plaintiff Institute of Medical Education, Inc. (“Plaintiff”)

hereby requests that the Court permit Plaintiff’s counsel to participate in the Case Management

Conference telephonically.

Plaintiff’s lead counsel is located in San Diego County, California. Plaintiff’s counsel

21 therefore seeks the court’s permission to appear telephonically to preserve resources of the

22 Plaintiff, which have been severely impacted by recent events as described in the operative
23 Complaint.

Plaintiff’s counsel conferred with Defendant’s counsel, Alicia Kennon, Esq., via

email on February 21, 2012 and Defendant’s counsel had no objections to this request.
