Article 51 A (g) of Indian Constitution defined fundamental duties of all of us and
we appeal our beloved Prime Minister to use his contacts to perform, reform the
Govt. of Rajasthan as we have moved attached representation with relevant proof
and judicial orders to safeguard the wetland of Rajasthan, Ramsar site of
Sambhar Salt Lake adjoining Jaipur, Ajmer and Nagaur District. Please find
attached here with petition for immediate directions for consideration to pass
appropriate orders. Committees on Petitions, Rajasthan Legislative Assembly are:

1. As per article 51 A (g) of Indian Constitution, you are also duty bound, being citizen of India, to
safeguard lake and to protect animals and birds from unnecessary pain and sufferings, besides it
these migratory birds flamingoes have five freedoms, which were also upheld by the Hon’ble
Supreme Court of India, whereas local Administration also failed to perform their fundamental as
well as official duties because following judicial orders were not implemented as per their spirit:

2. Far from being a wetland, Sambhar in Rajasthan is no more a lake. Anthropogenic pressures
have killed a wetland of international importance in the state. Ramsar site number 464 under the
Ramsar Convention on Wetlands, the Sambhar Salt Lake, once a large saline lake fed by four
rivers set in a shallow wetland, is dangerously close to extinction. The lake has dried up and the
flamingoes that used to visit the lake in thousands have reduced to just a few. Salt extraction,
earlier done by surface brine, is now done by 1,544 bore wells dug all over the lake.
Ironically, after being designated as a Ramsar site, a wetland of international importance, on
March 23, 1990 Sambhar has not been anybody’s baby. Until now, the Govt. of India has not
provided a map showing the boundary of the Sambhar Lake Ramsar Site and this is indicated in
the paper update on the status of sites on the list of wetlands of international importance which was
presented at the 53rd meeting of the Standing Committee of the Ramsar Convention in May 2017.
The only thing that the Indian government sent was Ramsar Information Sheet that led to the site
being designated as a Ramsar site.
But the Ramsar Secretariat is still awaiting further information from the Indian administrative
authority on the cases of unauthorized salt extraction and excess pumping of groundwater for salt
manufacture.
Progressive degradation of the water fowl habitat has happened over past few decades despite
financial assistance received by the Rajasthan government for conservation of the lake. But all that
the government did was prepare reports and sit on it. Despite being a Ramsar site, Sambhar has
not been declared a wetland under the Wildlife Protection Act, 1978 and, till today, there is no
single authority responsible for the Ramsar wetland. The wetland of Ramsar status is under threat
of water scarcity, desertification, disappearing biodiversity, increasing salt production,
deteriorating quality of salt and overall eco-system. There is an urgent need for developing effective
management strategy based on scientific studies for conservation of the wetland of international
importance, reported CSIRNational Environmental Engineering Research Institute (NEERI) that
was commissioned to do a report by Rajasthan department of environment in April 2015.
The lake despite being declared a Ramsar site in 1990 does not have a management plan even
today. NEERI studied an area of 77,349 hectre that covers three districts, Ajmer, Nagaur and
Jaipur, and observed that percentage occupancy of water bodies had decreased from 15.1% to
barely 5.7% over the years and saltpan land had drastically increased from 3.1% to 5.3% from
1997 till 2014.
But with several anicuts obstructing ground water recharge of the three rivers that feed Sambhar
Lake compounded with climate change, the scope of groundwater development is already
exhausted. The lake, according to the Central Ground Water Board (CGWB), comes under the
category of overexploited / critical. Indiscriminate groundwater extraction is the single largest
threat to Sambhar which has resulted in progressive waterfowl habitat degradation. The present
water withdrawal at the lake is estimated at 112.42 MCM (million cubic metre) as against the
annual groundwater availability of barely 20.05 MCM reported NEERI.
Besides, a road made between Nawa and Khakarki through the lake has divided the lake into two
equal parts which may seriously affect the winter congregation of flamingoes. Ramps have been
constructed for easy access to the lake area. Hence as natural fallout, villagers have started using
the lake area as a short cut to commute between Gudha and Sambhar.

3. I, Naresh Kadyan S/o of Shri Om Prakash Kadyan, representing the United Nation affiliated
“International Organisation for Animal Protection: OIPA in India, Master Trainer, Animal
Welfare Board of India, Volunteer of the Wildlife Crime Control Bureau and Commissioner,
Bharat Scouts and Guides, Haryana, Advisor cum Consultant, Hindustan Salt Limited, submit that
in Ramsar Convention the land of Sambhar Lake territory was declared Wetland according to
which no encroachment or any kind of activity by any person is allowed on the Wetland except with
the prior permission to be obtained from the authorities notified for the purpose. Sambhar Lake
area is rich with the salt water and contains brine water for extraction of salt. The Govt. of India
formed a company viz. Hindustan Salt Ltd., for the purpose and later on its subsidiary company viz
Sambhar Salt Ltd. was formed for manufacturing of salt.
In report dated 20-04-2010 of Shri Vinod Kapur, IAS officer mentioning therein the manner and
method by which the Private persons are stealing the brine water from the water from the Wetland
territory of Sambhar Lake and suggested the ways and methods by which stealing of the brine
water and digging of bore wells, laying of pipe lines and drawing electrical connections up to the
Wetland Area may be prevented.
It was seen that except the above company i.e Sambhar Salts Ltd., Private Persons are
unauthorized extracting the salt by stealing the brine water from the territory of land allotted to
Sambhar Salt Ltd. Aggrieved from this I filed a Civil Writ Petition before the Hon'ble Supreme
Court of India, New Delhi
The Hon'ble Supreme Court of India vide its Order dated 09-05-2014 directed the State Govt. to
inform as to whether it has accepted the report of Shri Kapur and directed the State Govt. to take a
clear stand as to whether the State of Rajasthan has accepted the report of Shri Vinod Kapur, IAS.
If for any reasons, the State Rajasthan has not accepted the report, the Chief Secretary, Rajasthan
is required to file an affidavit for the State of Rajasthan including the reasons therein for its non
acceptance. The State Govt. has neither complied with the directions of the Hon'ble Supreme Court
nor it acted upon the recommendation of Shri Kapur so as to prevent the aggression on the
Wetland area of Sambhar Lake and stealing of brine water from the Sambhar Lake area by
adopting various methods like digging of unauthorized bore wells and stretching of illegal electrical
connections in the Lake Area.
The Hon'ble NGT in an application filed before it also directed the State Govt. to prevent the
aggression on the Lake Area as it is adversely affecting the visiting of Flamingo birds or other kinds
of birds in the winter seasons, but the State Govt. has not taken any effective steps to comply with
the directions of the Hon'ble NGT.
The plight of the Sambhar Lake was well understood by the Hon’ble Bench of National Green
Tribunal (CZ) Bhopal. After analyzing the two reports as mentioned supra i.e. Report by Vinod
Kapoor Committee & NEERI has directed for implementation of the two reports without delay.
In OA NO. 92/2016(CZ) while enquiring about the steps taken in pursuance to Orders dated 04th
November 2016:
Orders of the, 17th July 2017:
“It has been vehemently submitted before us that a major problem with regard to the receding of
the water level in the Sambhar Lake is on account of ongoing salt manufacturing works which are
drawing excessive water from the lake by digging several bore wells. It has also been submitted that
unauthorized electricity connections are being taken by laying of long cables unlawfully for
operating the illegal bore wells for drawing water, we would except that immediate action in this
behalf be taken under the directions of the Govt. to the electricity Board (DISCOMS)”
Orders of the NGT dated 5th September, 2017:
“We have been informed that while directions have been issued to the company namely AVVNL by
Rajasthan Lake Development Authority so far disconnections have not been effected, this may
bring to the notice of the Chief Secretary to Govt. of Rajasthan who should take immediate steps to
ensure compliance of the directions issued for disconnection of the illegal electrical connections”
“State of Rajasthan who should take immediate necessary steps to ensure compliance of the
directions issued for disconnection of all illegal electrical connection so that all such cables etc.
which are laid unauthorized are disconnected”
Orders of the NGT dated 20th September, 2017:
“As directed in our last order dated 05.09.2017 managing Director AVVNL is present. He has
submitted that they have already started disconnection of unauthorized electricity which was being
used for drawing brine form Sambhar Lake for illegal manufacturing of Salt. ”
Orders of the NGT dated 9th January, 2018:
“Learned council appearing for the state electricity board has submitted that they have already
disconnected electricity connections which are illegal and also removed the transformer. He further
submits that there is no electricity connection given within the sambhar Salt. He however submits
that all the unauthorized salt miners have installed solar panels for the purpose of drawing brine
from Sambhar Lake.
Aggrieved from all the above facts and circumstances that the State Govt. did not take any effective
steps to prevent aggression in Wetland and stealing of brine water from the Lake Area by digging
un authorized bore wells, laying of pipe lines up to the distance of 4-5 Km. beneath the land and
stretching of un authorized electrical connections by the aggressors and other un authorized
persons I am presenting this Application, on the prescribed Format, for kind consideration of the
Hon'ble Chairman, Committee on petitions, Rajasthan Legislative Assembly for consideration to
pass suitable orders as deem fit / directions thereon.
As per V.T. Krishanama Chari Award dated 29th April, 1961:-
1) A Company should be set up for working the Sambhar area for carrying out the integrated
programme of development envisaged in which the Government of India (either by themselves or
through the Hindustan Salt Co.) and the Government of Rajasthan will be share holders. The Govt.
of India will allot free shares in favour of the Govt. of Rajasthan to the extent of 40% of the Paid up
Capital of the company. This will be in full compensation to the Rajasthan Govt. for royalty. The
Rajasthan Govt. will have two representatives on the Board of the Company.
2) For the period between the expiry of the present arrangement (January 1960) and the formation
of the company referred to in Para-1 above payment will be made to the Rajasthan Government on
the terms in force upto January, 1960.
3) As a matter of temporary arrangement, the Govt. of Rajasthan will be paid a sum of Rs.80/-
lakhs for the period from 1960-61 to 1964-65 @ of Rs.16 lakhs per year.
THE FACTUAL REPORT AS PER THE INVESTIGATION CAARRIED OUT BY THE
COMMISSION OF SHRI VINOD KAPOOR, SECRETARY, AND JUSTICE N.N. MATHUR
The State Govt. ordered to Shri Kapoor to give his report in connection with the illegal possession,
dragging and drugging of bore wells and laying of the pipe lines and theft of Lime water by the
Private Salt Producers on the land of Sambhar Salt Ltd.
It was also ordered to give suggestion as to how the above illegal activities can be stopped and to
mention the role of officers in these activities.
Shri Kapoor submitted his Report dated 20-4-2010 which contained 18 proposals in connection
with the following matters:-
1) Illegal possession by the Private Salt Producers on the land under Sambhar Salt Ltd.
2) The drugging and dragging of illegal tube wells and bore wells and laying down the pipe lines
under the territorial land of Sambhar Salt Ltd. by the Private Salt Producers for stealing the lime
water.
3) The Electrical Connections given to the Private Salt Producers for stealing the lime water
on/from the land falling within territorial land of Sambhar Salt Ltd.
It is mentioned in the Report that a Civil Writ Petition No.4958 / 04 has been filed by Sambhar Salt
Ltd., regarding the land belonging to it admeasuring 6620 Bigha Land (Khasara No.302, 622,996,
1800 and 1803 situated in Nava, Distt. Nagaur (Rajasthan) before the Hon'ble High Court of
Rajasthan, Bench at Jaipur which is pending. In the said Writ Petition Sambhar Salt Ltd. has
impleaded the State Govt., Collector Nagaur, Sub-Divisional Officer and Tehsildar Nava. The
Hon'ble High Court has ordered to maintain the status-quo in the matter. Various suits are also
pending before the different courts in connection with the disputed land.
Point No.2 of the Investigation Report:-The illegal drugged and dragged tube well by the Private
Salt Producers and laying of pipe line by them for stealing the salt water in the territorial area of
Sambhar Salt Ltd.:-
In the territory of Sambhar Salt Ltd., the salt water is stolen by dugging bore well and laying of
pipe line illegally by the Private Salt Producers. The laid pipe lines are 4-5 Km. long under the land.
According to the Distt. Administration, the officers of Sambhar Salts Ltd., it had been writing
letters time to time to stop the theft and also written letters to its officers to help in it. They also
wrote to the Police Administration for taking necessary action. It also was being informed that
necessary co-operation had been given, but looking to the entire situation no result bearing action
could be taken.
Generally, the illegal boring / action of taking illegal possession are in the area of Tehsil Nava of
Distt. Nagaur. For providing Police help 8 letters were received, whereby the Police help was
demanded to stop theft of water salt by Private Salt Producers / to remove the transgression and to
dispossess the transgressors.
Here, it will be relevant to mention that the Police Administration has made a mention of different
disputes in its note, but in most of the cases no information is available in regard to the action taken
by it, which is a miserable state of affair. Even, at the level of State Govt. the help was demanded
from the different Departments like Revenue Department, Industries Department, Home
Department and remained in contact with the District Administration and Police Administration
continuously but the desired co-operation could not be received and the problem could not be
solved and today it has become a grave problem.
The Home Department did not make any correspondence with the Police Department in connection
with taking of necessary action on the letters of Sambhar Salt Ltd., under reference.
According to a note submitted by Sambhar Salt Ltd., Private Salt Producers are producing salt by
stealing salt water by means of illegal bore well and lying of pipes during nights and holydays in its
lake territory. In this procedure, on the basis of Committee constituted by the company number of
illegal bore well beneath the earth is about 250 approx., and except this there may be other bore
wells also which are dugged in depth beneath the land and are not visible. It is, therefore, difficult
to decide the number of such bore wells in the area of the land. Specially, according to the report
dated 12.03.2010 of committee constituted by Sambhar Salt Ltd., there may be 240 bore wells in
different areas and there may also be some bore wells dugged in depth beneath the land which is
not visible.
Point No.3:- The Electrical Connections has given to the Private Salt Producers for stealing the lime
water on / from the land fall within territorial land of Sambhar Salt Ltd.
It is not possible to give electrical connection to any private party and no such connection can be
taken legally on the land of the company, but it is possible to extend the legal electrical connection
so as to use it illegally and is being misused extensively.
According to the company as and when the Committee of Estate Officer, Security Officers etc. go in
the land area for inspection, destroy such electrical connection and seize the electric wires, but it is
seen that such action is a temporary solution. The Private parties, again by installing the electrical
line beneath the land, operate the bore wells and began to steal the salt water.
Although, legal electrical connections were given in the area of Sambhar Salt Ltd., for Salt Udyog,
but complains are being received for making unauthorized bore wells and drawing the illegal
electrical connection from the legal electrical connection.
In Tehsil Kishangarh of Distt. Ajmer in the area of Lake Territory at village Aau, Jhag, Sinodiya
by installing cable line from the valid connections the brine is illegally extracted. Therefore, in
order to stop this it is expected that the illegal use of electricity has to be stopped by taking steps
effectively and seriously and by taking strong action under the Rules / Regulations for long time by
Ajmer Vidyut Vitaran Corporation Limited.
From point of view of availability of ground water the block of Sambhar Salt area, Distt. Jaipur
falls under the category of "Ati Dohit" area. Presently, at the State level no ground water Act /
Regulation is applicable. Therefore, the Department has no interference in the construction of
ground water well (Nalkoop).
Entire Nagaur Distt. Falls under the category of "Ati Dohit".
In Ati Dohit areas the continuous excessively extraction of water is miserable and it is expected that
effective restrictions be imposed on it.
In the entire Lake area, the bore wells dugged by the private parties are lying open and there is
possibility of happening of any incidence. The Local Administration, after survey, may fill up such
open bore wells.

Prayers:

1) Orders to crack down all unlawful and illegal bore wells and electric connections all around
with illegal and unlawful trespass, restoring five freedoms of the migratory birds.
2) The directions may be given to the local authorities to remove illegal possession and
encroachments of the aggressors or any person who is producing the salt unlawfully on the
wetland falling under the jurisdiction area of Sambhar Salt Ltd. which falls under "Ati
Dohit" area.
3) The directions may be given to the Local Authority to stop the drugging and dragging of
illegal tube wells and bore wells and laying down the pipe lines under the territorial land of
Sambhar Salt Ltd. by the aggressors and the persons who are stealing the lime water may
be ordered to be stopped.
4) Restoration of five freedoms of migratory birds Flamingo and to provide suitable facilities
for free movements and breeding without any disturbances.
5) Prohibit the movement of the vehicles, machines and equipments related to bore wells,
without any permission.
6) The directions may be given to the local authorities to identify, detect and disconnect the
electrical lines laid beneath the land from the electrical connections validly taken by the
aggressors or then persons up to land area of Sambhar Salt Ltd. so as to prevent the
stealing of Salt water from the Lake Area.
7) The directions may be given to the Local Authority to disconnect the Electrical Connections
given to the aggressors or persons with the help of which they are stealing the lime water on
/ from the land falling within territorial land of Sambhar Salt Ltd.
8) Any other order or orders may also pleased be passed so as to meet the ends of justice and
implement the directions / orders passed by the Hon'ble Supreme Court / NGT and to
achieve the object of filing this application so that the wetland area of Sambhar Lake may
be protected.
9) White paper of the functioning of the concerned Authorities, failed to perform their
fundamental duties as defined under section 51 A (g) of Indian Constitution.
Responsibilities be fixed on the tainted officials of the Department concerned, failed to
perform their official cum fundamental duties.
10) White paper on the bad effects of the eco system along with existence of the wetland of
Rajasthan.
11) White paper, assessing the value of theft of electricity along with brine water.
12) Orders for cracking down all unlawful and illegal bore wells and electricity connections all
around wetland of Rajasthan.
13) Close circuit camera along with permission for Drone to monitor the movements in the
protected areas, deputing Central Industrial Security Force to maintain law & orders.
14) Directions for preventive orders under section 144 and 188, to be issued within the
preventive area of the wetland.
15) Strong mechanism may kindly be introduced to maintain the water level of the wetland and
to recharge ground water level.
16) Any other orders deem fit.

The Sambhar Salt Lake, India's largest inland salt lake, a bowl shape lake
encircles historical Sambhar Lake Town located 96 km south west of the city of
Jaipur (Northwest India) and 64 km north east of Ajmer along National
Highway 8 in Rajasthan. It is India's largest saline lake and is the source of most
of Rajasthan's salt production. It produces 196,000 tonnes of clean salt every
year, which equates to around 9% of India's salt production. Salt is produced by
evaporation process of brine and is mostly managed by Shambar Salts
Ltd.(SSL), a joint venture of the Hindustan Salts Ltd. and the state government.
SSL owns 3% of the eastern lake. There are 38 clusters of villages surrounding
the lake. Major settlements include Sambhar, Gudha, Jabdinagar, Nawa, Jhak,
Korsina, Jhapok, Kanseda, Kuni, Tyoda, Govindi, Nandha, Sinodiya, Arwik ki
dhani, Khanadja, Khakharki, Kerwa ki dhani, Rajas, Jalwali ki dhani. Sambhar
has been designated as a Ramsar site (recognized wetland of international
importance) because the wetland is a key wintering area for tens of thousands of
flamingos and other birds that migrate from northern Asia. The specialized algae
and bacteria growing in the lake provide striking water colours and support the
lake ecology that, in turn, sustains the migrating waterfowl. There is other
wildlife in the nearby forests, where Nilgai move freely along with deer and

If the National Green Tribunal's (NGT) orders are enforced by the state
government, the monsoon of 2017 holds hope for the dying Sambhar Salt Lake.
The central zonal bench of NGT has directed the Rajasthan government to
cancel allotments of salt pans in Sambhar Salt Lake that fall within the wetland
and run contrary to the mandate of Wetland Rules, 2010. A bench headed by
Justice Dalip Singh and expert member Satyawan Singh Garbyal directed the
state wetland authority to review the allotments made so far after the

The Sambhar Salt Lake, India's largest inland salt lake, a bowl shape lake
encircles historical Sambhar Lake Town located 96 km south west of the city of
Jaipur (Northwest India) and 64 km north east of Ajmer along National
Highway 8 in Rajasthan. It is India's largest saline lake and is the source of most
of Rajasthan's salt production. It produces 196,000 tonnes of clean salt every
year, which equates to around 9% of India's salt production. Salt is produced by
evaporation process of brine and is mostly managed by Shambar Salts
Ltd.(SSL), a joint venture of the Hindustan Salts Ltd. and the state government.
SSL owns 3% of the eastern lake. There are 38 clusters of villages surrounding
the lake. Major settlements include Sambhar, Gudha, Jabdinagar, Nawa, Jhak,
Korsina, Jhapok, Kanseda, Kuni, Tyoda, Govindi, Nandha, Sinodiya, Arwik ki
dhani, Khanadja, Khakharki, Kerwa ki dhani, Rajas, Jalwali ki dhani. Sambhar

and order in the area, besides it unlawful bore wells, theft of brine and
electricity, whereas para Military Forces may kindly be deputed to protect the
Sambhar Salt Lake, introducing Police Station for Sambhar Salt Lake along with
the fast track court, for immediate disposal of crime against wetland of
Rajasthan. It would also be pertinent to mention here that supply of water to the
wetland of Rajasthan, badly disturbed under cover of development by the State
Government, hence strong mechanism should be introduced to maintain the
water level of the Sambhar Salt Lake. Hence, being law abiding citizen of India,
I hereby request you, to please issue strict directions to the Electric Regulatory
Commission of Rajasthan along with the Ministry of Energy, Rajasthan, to fix
responsibilities on their top to bottom class of officers and hold them
accountable towards illegal electric connection and theft of electricity, all
around Sambhar Salt Lake area, keeping in view fundamental duties, to record
adverse remarks in their annual confidential reports.

Hindustan Salts Limited (HSL) was incorporated on 12th of April, 1958 as a

at Sambhar, Didwana and Kharaghoda earlier managed by the Salt Department,
Government of India. This is the only Central Government Public Sector
undertaking engaged in the manufacture of salt. The Company started its
business in January 1959. It also has major salt production works measuring

Salt Limited has been made a subsidiary Company and has over 90 sq. miles of
production area at Sambhar and Nawa. Both the companies have recently
diversified the business on many counts and considerable infrastructure has been
added to produce various varieties of high quality salt. Therefore depending on
the orders, We can process and send any type and quantity of salt. We do dry
mining of rock salt at another unit of Hindustan Salt Limited at Mandi
(Himachal Pradesh) which is presently used as animal lick. Since 116 million
tonnes of proven rock deposits have been established in Mandi rock mines, we
propose to set up a Solution Mining Project. In addition, we have supply centres
at Gandhidham, Bharuch in Gujarat and Ramnagar in Uttranchal. Our
specialisation is to produce high quality salt particularly for chlor-alkali
(Membrane Mercury Cell type) Industries, Textile, Soap Detergent Industries,
Leather Industries Power Projects. Besides Common Salt, Liquid Bromine is
produced at Kharaghoda Unit the current installed capacity of 450 TPA is being
expanded to 900 TPA. Bromine is mainly used for Pesticides, Pharmaceuticals,
fire extinguishers, dyes and other bromo-compounds. As peer my information,
Khadi and Village Industries Commission, have financial assistance scheme
with margin money, to develop the clusters of traditional artisans, whereas salt
manufacturing have great potential of employment around Sambar region, hence

The Sambhar Salt Lake, India's largest inland salt lake, a bowl shape lake
encircles historical Sambhar Lake Town located 96 km south west of the city of
Jaipur (Northwest India) and 64 km north east of Ajmer along National
Highway 8 in Rajasthan. It is India's largest saline lake and is the source of most
of Rajasthan's salt production. It produces 196,000 tonnes of clean salt every
year, which equates to around 9% of India's salt production. Salt is produced by
evaporation process of brine and is mostly managed by Shambar Salts
Ltd.(SSL), a joint venture of the Hindustan Salts Ltd. and the state government.
SSL owns 3% of the eastern lake. There are 38 clusters of villages surrounding
the lake. Major settlements include Sambhar, Gudha, Jabdinagar, Nawa, Jhak,
Korsina, Jhapok, Kanseda, Kuni, Tyoda, Govindi, Nandha, Sinodiya, Arwik ki
dhani, Khanadja, Khakharki, Kerwa ki dhani, Rajas, Jalwali ki dhani. Sambhar
has been designated as a Ramsar site (recognized wetland of international
importance) because the wetland is a key wintering area for tens of thousands of
flamingos and other birds that migrate from northern Asia. The specialized algae
and bacteria growing in the lake provide striking water colours and support the
lake ecology that, in turn, sustains the migrating waterfowl. There is other
