AFFIDAVIT OF LOSS

I, JOCELYN MASCULINO, Filipino, of legal age, residing at Barangay


Bulay, Maasin Iloilo, after having been sworn in accordance with law hereby
depose and state:

That I was issued Philippine Passport No 39089612 by the Department of


Foreign Affairs in Iloilo on June 18, 2016;

That recently I had tried to look for the said passport for the compliance
of my application to go abroad but the same could not be found;

That I have exerted all efforts possible to locate said passport to no avail;

That the I fully understands that the said passport is automatically


deemed cancelled upon declaration of loss, and that if found, it can no longer be
used;

That I am executing this affidavit of loss in connection with my present


application for a new passport

CONTRACT TO SELL

KNOW ALL MEN BY THESE PRESENTS:

This CONTRACT TO SELL, made and executed this 14th day of March, 2018 by and
between:

RHENA LOU BONITE of legal age, married to KIM KERVIN BONITE, Filipino, and
with residence and postal address at Roxas St., Poblacion Norte Ivisan, Capiz hereinafter
referred to as the "SELLER/VENDOR";

-AND-

CHRISTINE JOY GAZO, Filipino and with residence and postal address at Luna
Street, La Paz, Iloilo City, hereinafter referred to as the "BUYER/VENDEE".

WITNESSETH;

WHEREAS, the SELLER/VENDOR is the absolute and registered owner of a parcel


of land consisting of TWO HUNDRED THIRTEEN (213)square meters, more or less, located
at Brgy, Bolilao Mandurriao, Iloilo City and covered by Transfer Certificate of Title No.
126248 issued by the Registry of Deeds of Iloilo City;

WHEREAS, the BUYER/VENDEE has offered to buy and the SELLER /VENDOR has
agreed to sell the above mentioned property under the terms and conditions herein below
set forth;

NOW THEREFORE, for and in consideration of the total sum of THREE MILLION
EIGHT HUNDRED THOUSAND) (Php: 3,800,000.00) Philippine Currency, and of the
covenants herein after set forth the SELLER/VENDOR agrees to sell and
the BUYER/VENDEE agrees to buy the aforesaid property subject to the following terms
and conditions:

1. The total consideration shall be Three Million Eight Hundred Thousand Php:
3,800,000.00) PESOS, Philippine Currency, payable as follows:

a) The amount of ONE MILLION FIVE HUNDRED THOUSAND (Php: 1,500,000.00) PESOS,
representing earnest money shall be payable by the BUYER/VENDEE to
the SELLER/VENDOR upon signing of this Contract to Sell;

b) The remaining balance in the amount of ONE MILLION EIGHT HUNDRED


THOUSAND (Php: 1,300,000.00) PESOS, shall be paid in Cash on or before December 20,
2020.

c) In case the check representing the payment for the balance provided in paragraph
hereof, is dishonored by the drawee bank, the earnest money in the amount of ONE
MILLION FIVE HUNDRED THOUSAND (Php: 1,500,000.00) PESOS, shall be forfeited in
favor of the SELLER/VENDOR.
2. Capital Gains Tax and Real Estate Tax, shall be for the account of
the SELLER/VENDOR;

3. Documentary Stamps Tax, Registration Fee, registration expenses, and all other
miscellaneous fees and expenses shall be to the account of the BUYER/VENDEE;

4. Possession to the subject property shall be delivered by the SELLER/VENDOR to


the BUYER/VENDEE upon full payment of the total consideration;
5. Upon full payment of the total price, the SELLER/VENDOR shall sign and execute
a DEED OF ABSOLUTE SALE in favor of the BUYER/VENDEE. The
SELLER/VENDOR shall likewise execute and/or deliver any and all documents, including
but not limited to the original copy of Transfer Certificate of Title, Tax Declaration and all
other documents necessary for the transfer of ownership from SELLER/VENDOR to
the BUYER/VENDEE.

CONTRACT OF SALE

KNOW ALL MEN BY THESE PRESENTS:

This DEED OF ABSOLUTE SALE is made, executed and entered into by:

RHENA LOU BONITE of legal age, married to KIM KERVIN BONITE, Filipino, and
with residence and postal address at Roxas St., Poblacion Norte Ivisan, Capiz hereinafter
referred to as the "SELLER/VENDOR";

-AND-

CHRISTINE JOY GAZO, Filipino, of legal age and with residence and postal address
at Luna Street, La Paz, Iloilo City, hereinafter referred to as the "BUYER/VENDEE".

WITNESSETH;

WHEREAS, the SELLER/VENDOR is the absolute and registered owner of a parcel


of land consisting of TWO HUNDRED THIRTEEN (213)square meters, more or less, located
at Brgy, Bolilao Mandurriao, Iloilo City and covered by Transfer Certificate of Title No.
126248 particularly described as follows:

50533, Lot 3, Psd-100703, Lot 1, Psd-150980, LRC Rec. Nos. Nos. N-27024, 51768,
89632, N-11782, N-13466, and 21071 situated in Brgy. Bolilao, Mandurriao, Iloilo City,
Prov of Iloilo, Is. of Visayas. Bounded on SE., point 4 to 1 by Road Lot 22, on...to the point
of beginning; containing an area of (213) square meters more or less..."

WHEREAS, the BUYER has offered to buy and the SELLER has agreed to sell the
above mentioned property for the amount of THREE MILLION EIGHT HUNDRED
THOUSAND (Php: 3,800,000.00) Philippine Currency;

NOW THEREFORE, for and in consideration of the sum of THREE MILLION EIGHT
HUNDRED THOUSAND) (Php: 3,800,000.00) Philippine Currency, hand paid by the
vendee to the vendor, the SELLER DO HEREBY SELL, TRANSFER, and CONVEY by way
of Absolute Sale unto the said BUYER, his heirs and assigns, the certain parcel of land
together with all the improvements found thereon, freefrom all liens and encumbrances of
whatever nature including real estate taxes as of the date of this sale.

JOINT AFFIDAVIT OF WITNESSES

We, RIO ESPADA, and MARY GRACE SEVILLENO, single, of legal age, Filipinos
and working at REED ELSEVIER PHILIPPINES, after having been sworn to in
accordance with law, do herby and deposed and state:

1. That we personally know the complainant DIANA ROSE CAPANAS and accused
LEXTER GENIZERA as we are officemates at REED ELSEVIER located at Iloilo
Business Park, Mandurriao, Iloilo City;

2. That we knew that both the complainant Diana Rose Capanas and accused
Lexter Genizera have been in a relationship that lasted for one (1) year;

3. That on November 10, 2017 we had our Finance Accounting Hub Year-end
Party at The Mango Tree Restaurant, Mandurriao, Iloilo City together with the
complainant Diana Rose Capanas;

4. That at the time, we knew that the accused Lexter Genizera together with his
company was on the other side of our table;

5. That at around 11:00 in the evening, we noticed that the complainant D was
already and drunk. That on or about 1:30, o’clock in the morning of November
11, 2017, Lexter Genizera offered to the complainant to take home through a
ride by a cab;

6. That we are executing this affidavit to attest the truth of the forgoing facts and
for whatever purposes this may serve.

REAL ESTATE MORTGAGE

KNOW ALL MEN BY THESE PRESENTS:


This Real Estate Mortgage made and executed by and between:
JOSEPH MASIN of legal age, Filipino, single with residence at San Rafael,
Mandurriao, Iloilo City, and hereinafter referred to as the “MORTGAGOR”,
-and-

RAFAEL TABILOG, of legal age, Filipino, married to SWEDEN PEARL


FABRIGAS with residence at Brgy. Rizal, Catanduanes, and hereinafter referred to as
the “MORTGAGEE”.

WITNESSETH: That –

WHEREAS, the MORTGAGOR is the absolute and registered owner of a parcel


of land situated at Brgy. B covered by Transfer Certificate of Title No. 126428 of the
Registry of Deeds of Iloilo City;

WHEREAS, the MORTGAGOR is indebted to the MORTGAGEE in the


principal sum of FIVE HUNDRED THOUSANF (Php 500, 000.00), Philippine currency,
under and by virtue of a Promissory Note (“Note”) attached herewith and made an
integral part hereof as ANNEX “A”

WHEREAS, the MORTGAGOR has agreed to secure the payment of the Note
to the MORTGAGEE by means of a good and valid mortgage upon the property herein
described below;
NOW, THEREFORE, for and in consideration of the foregoing premises and
as security for payment of the aforesaid obligation, the MORTGAGOR has transferred
and conveyed, and by these presents transfer and convey by way of MORTGAGE, unto
the MORTGAGEE, his/her heirs, successors or assigns the aforesaid parcel of land
[with/without improvements] situated at Brgy. Bolilao, Mandurriao, Iloilo City and more
particularly described as follows:

50533, Lot 3, Psd-100703, Lot 1, Psd-150980, LRC Rec. Nos. Nos. N-27024, 51768,
89632, N-11782, N-13466, and 21071 situated in Brgy. Bolilao, Mandurriao, Iloilo City,
Prov of Iloilo, Is. of Visayas. Bounded on SE., point 4 to 1 by Road Lot 22, on...to the point
of beginning; containing an area of (213) square meters more or less..."
It is agreed and understood that if at any time the MORTGAGOR shall fail or refuse to
pay the obligations herein secured, or default in any installment(s) and/or
amortization(s) of such indebtedness or the principal obligation when due, or to comply
with any of the conditions and stipulations herein agreed or in the separate instruments
evidencing the obligations hereby secured or shall, during the time this mortgage is in
force, institute insolvency, suspension of payment or similar proceedings, or be
involuntary declared insolvent or writ of garnishment and/or attachment be issued
against any of the assets or income of the MORTGAGOR or if this mortgage cannot be
recorded in the Registry of Deeds, then all the obligations of the MORTGAGOR secured
by this Mortgage shall immediately become due and payable and defaulted and the
MORTGAGEE may immediately foreclose this mortgage judicially, or extra-judicially
pursuant to Act No. 3135, as amended.
MORTGAGEE is hereby appointed attorney-in-fact of the MORTGAGOR, with full power
and authority to take actual possession of the mortgaged property at once, and to
forthwith foreclose this mortgage judicially, or to sell the above-described properties
extra-judicially in accordance with Act No. 3135, as amended, and to take such other
action(s) as he may be deem necessary to recover the amount due; and in the event of
such judicial or extra-judicial foreclosure or other legal action, the MORTGAGEE shall
be entitled to compensation for expenses, attorney’s fees and costs of collection, which
is stipulated to be twenty five percent (25%) of the indebtedness then unpaid but not
less than Php50,000.00.
The condition of this mortgage is such that if the MORTGAGOR shall well and truly pay
or cause to be paid to the MORTGAGEE the obligation in the principal sum with accrued
interest, according to the terms and tenor hereof, then this mortgage shall thereby fully
discharged and without further effect; OTHERWISE, it shall remain in full force and
effect and shall be enforceable in the manner provided by law.
