FIXED-TERM CONTRACT
This is to confirm your appointment to the fixed-term contract position of [Insert Position]
from [Insert Date] to [Insert Date]. During this period, your performance will be reviewed,
and depending on your performance, this contract may be extended.
Your total payment for the duration of this contract will be [Insert Payment Amount].
Statutory deductions, i.e. PAYE/SITE tax and Unemployment Insurance will be made
monthly and in accordance with the relevant laws.
You will be required to abide by the company rules and regulations. These include the
Disciplinary and Grievance, Safety and Security procedures. Full details of these will be
supplied by your immediate superior.
Working hours: 40 hours per week for the duration of this contract. Starting times are
determined by the Company from time to time and on demands of the job.
You will accrue leave at a rate of 1.25 days per completed month of service. Leave may be
taken, subject to approval of the department head, or paid out on termination of the
contract.
You are entitled to one (1) working day sick leave on full pay in respect of each completed
period of five (5) weeks of employment, provided an acceptable certificate signed by a
medical practitioner is produced.
This contract does not in any way entitle you to automatic appointment to a permanent
staff position with our Company.
However, as a fixed term contract employee, you are not excluded from applying for and
being considered for a permanent staff position.
It is specifically recorded that there is no expectation that this contract will be renewed or
prolonged beyond the date of completion. The termination of this contract as provided for
herein shall not be construed as being a retrenchment but shall be by virtue of the
completion of the contract.
It is specifically recorded that this contract may be terminated at any stage prior to the
expiry date of the contract for misconduct, incapacity or the operational requirements of
the Company or for any reason recognised by law, either summarily or upon two (2) weeks
written notice.
The remaining terms and conditions applicable will be governed by the Basic Conditions of
Employment Act, 3 of 1997 and such other Company Policies as may be in place from time
to time.
The parties agree that where there are any disputes regarding the application,
interpretation or termination of the contract, such disputes will be referred to private
arbitration for resolution. It is further agreed that the arbitrator’s decision is final and
binding on the parties. The cost of the private arbitration will be borne equally between the
parties. The arbitrator will be mutually agreed upon by the parties.
Kindly confirm your acceptance of these conditions by initialling the bottom right hand
corner of the first page of this letter, signing where indicated on this page and returning the
signed copy of the letter to the Human Resources Department.
