BYLAWS of

Magic @ CMU

This document contains the rules and regulations that govern the organization known as Magic
@ CMU (henceforth “the club”) based on the campus of Carnegie Mellon University
(henceforth, “the university”). The club is open to all university students and will never
discriminate on the basis of race, religion, gender, ethnicity, country of origin, or sexual
orientation, and furthermore will adhere to the University's Statement of Assurance
(http://www.cmu.edu/policies/documents/SoA.html). The club will serve the Carnegie Mellon
community by providing a network for players of the game Magic: The Gathering (trademark
Hasbro, inc.) to play, introduce new players to the game, and pool resources, including travel
expenses, experience, and card collections, such as to accomplish more than would be possible
for a single individual.

Article I. Name
Section 1. This organization shall be officially known as Magic @ CMU.

Article II. Affiliation with other groups


Section 1. Magic @ CMU is not officially affiliated with any group, although the game we
play is produced by Wizards of the Coast, a Hasbro company. We are in no way recognized by them,
though we do have informal communication.

Article III. Purpose, Aims, Functions of the Organization

Section 1. Magic @ CMU seeks to bring Magic: the Gathering to the Carnegie Mellon
Campus.

Section 2. No restrictions on the format or style of play may be imposed. A game of


Magic is a social contract between every player in the tournament, or, in casual play, in the
game. Non-sanctioned tournaments or formats must be allowed unless there is conflict with
university- or government-imposed rules regarding gambling or other rules. Specifically,
allowing or disallowing proxy cards must be a by-tournament or by-game decision; the Council
has no place legislating their legality.

Section 3. The club must always remain open to new players and players who do not
seek competitive play. Though the club is designed to be an atmosphere where tournament
players can come to practice, at its heart the game, and thus this club, is about playing Magic. It
is suggested, therefore, that a stock of cards is maintained for new players to use and/or acquire
at little to no cost and that casual play is never discarded.

Article IV. Membership Requirements

Section 1. Magic @ CMU is open to all Carnegie Mellon students. There are no
requirements to join the club.

Section 2. In order to vote, a member must attend at least two events or meetings held by
the club.
Section 3. There are three cases by which a member may fall out of good-standing
with the club. The first is misappropriation of funds. The second is being found guilty of
cheating in a game. The final case is unsportsmanlike conduct of the sort that could result in
expulsion from a sanctioned DCI tournament, as enumerated in the official Magic Tournament
Rules, including comments or actions that do not align with the club's policy against
discrimination. Each offense is punishable by expulsion from the club for the first offense.

Article V. Officers

Section 1. The club will be run by a Grand Council with no more than five members.
These five members will be elected at the beginning of every school year and must be club
members who are in good standing with the club. All club members in good standing and have
attended at least two club events and/or meetings are eligible to vote.

Section 2. The Grand Council will have the authority to make decisions concerning
club spending, activities, and other club matters. Any vote in which less than three-quarters of
the Council are in agreement must be put to a full vote by the entire club, which would then pass
by a simple majority.

Section 3. The following limits are placed on the power of the Grand Council:
• No club dues of any kind may be collected, ever. Players who simply wish to play the
game should be able to do so free of charge. This restriction does not cover charging for
entrance into club-run tournaments, which may charge admission in excess of product
cost to raise funds for the club.
• The club must always remain open to new players and players who do not seek
competitive play. Though the club is designed to be an atmosphere where tournament
players can come to practice, at its heart the game, and thus this club, is about playing
Magic. It is suggested, therefore, that a stock of cards is maintained for new players to

Section 4. The Grand Council has control over the club budget, including acquiring
and spending funds, maintaining accurate records, and complying with all university- and
government-imposed requirements. Under no circumstances may club funds be used for
personal purchases.

Section 5. The Grand Council may contain members with additional titles. It is
suggested that the Council contain, at minimum, have a Head Council Member, a Council
Secretary, and a Play Coordinator, whose responsibilities are delineated below.

Section 6. The Head Council Member is responsible for the general welfare of the
club. The Head Council Member should be chosen from the Council members by the Council
members. He or she should act as a liaison between the club and the university, schedule
meetings of the Grand Council and the full club body, delineate responsibilities, and publicly
promote the club to acquire new members. He or she must also work with each other member of
the Council, as all responsibility ultimately lies with the Head Council Member. Therefore, the
Head Council Member shall appoint the Council positions enumerated in this document to
members of the Council, as well as any other positions he or she feels are necessary.

Section 7. The Council Secretary is responsible for maintaining records of all club
meetings, transactions, and tournaments. As the Council Member most in touch with the
workings of the club, this member has the power to serve as acting Head Council Member in the
event the position is vacated.

Section 8. The Play Coordinator is responsible for scheduling when and where the club
plays Magic. While the rest of the Council in responsible for keeping the club running and acquiring new
members, this Council Member is responsible for making sure the club members can play. This includes
finding and securing play space, product, prizes, and anything else the members of the club need to play
Magic. After the Head Council Member, and in some cases even more so, this member must be willing
to work with the university and outside vendors.

Article VI. Meetings

Section 1. Club meetings should be organized regularly so that any club members can make
suggestions to the Council. At a minimum, at least one meeting must be held every twenty class days.

Section 2. At this time, a member may also request a club-wide vote to remove a Council
Member from the Council. The general body will vote on two counts: whether to remove the member,
and whether to hold an Emergency Election of a new member.

Section 3. The writers of this document acknowledge the somewhat non-standard nature of
the distribution of power in this club. Therefore, beginning with the start of club activities in 2010, and
every five years thereafter, the effectiveness of the Grand Council system should be reviewed. If it is
determined a more traditional structure, such as electing members to specific positions, is preferable, the
work should be done to alter these laws.

Article VII. Quorum

Section 1. The Grand Council will have the authority to make decisions concerning
club spending, activities, and other club matters. Any vote in which less than three-quarters of
the Council are in agreement must be put to a full vote by the entire club, which would then pass
by a simple majority.

Section 2. To be approved, sixty percent of the general body must approve of removing the
Council Member from the Council. Council Members may not participate in this vote. If a majority of
the members also favor an emergency election of a new Council Member, then that election should take
place no sooner or later than the next club meeting.
Section 3. In order to pass an amendment to these bylaws, the full club must pass the
amendment with a three-fifths majority. See Article IX below.

Article VIII. Referendum and Recall

Section 1. The purpose of full body meetings is to make announcements about club
activities and to allow for calls for amendments or accusations against club members. In order to vote on
anything, a majority of the eligible voting members must be present.

Section 2. When the Grand Council gathers to vote on issues, each member of the Council
must be present.

Article IX. Amendments

Section 1. It is within the power of the club to edit and add to these bylaws. It is the
suggestion of the founders that this is done only with extreme caution, and that whatever changes
are made maintain the club's purpose of bringing Magic to Carnegie Mellon. Changes to the
bylaws must occur only at full body meetings.

Section 2. Any member in good standing may present a proposed change to the
bylaws, along the signatures of support of at least five other club members. The proposal will
then be voted on. Unlike other votes, a change of the bylaws cannot be passed with a simple
majority; three-fifths of the club membership must approve of the change.
