CO-MANAGEMENT AGREEMENT

SINDANGAN RIVER BASIN

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT entered into this ___ of _______, 2016 in Pagadian City,
Philippines, by and among:

The DEPARTMENT OF ENVIRONMENT AND NATURAL RESOURCES Region

IX with Regional Office at President Corazon C. Aquino Regional Government Center,
Balintawak, Pagadian City herein represented by the Regional Director, ARLEIGH J.
ADORABLE, CESO II, hereinafter referred to as “DENR-Region IX”;

-and-

The LOCAL GOVERNMENT UNITS OF SINDANGAN, SIAYAN, JOSE

DALMAN, SERGIO OSMEÑA IN THE PROVINCE OF ZAMBOANGA DEL
NORTE and DUMINGAG, MIDSALIP, SOMINOT, LABANGAN IN THE
PROVINCE OF ZAMBOANGA DEL SUR, a local government units established and
existing under the laws of the Republic of the Philippines duly represented herein by its
respective Municipal Mayors, hereinafter referred to as the “Local Government Units”.

WITHNESSETH

WHEREAS, under the Local Government Code of 1991, local government units (LGUs)
are mandated to share responsibility with the national government, in particular the DENR, in
protecting and managing natural resources within their territorial jurisdictions;

WHEREAS, Joint DENR-DILG Memorandum Circular No. 2003-01 provides the

strengthening and institutionalization of the DENR DILG-LGU partnership devolved and other
forest management functions;

WHEREAS, section 6 of Joint DENR-DILG Memorandum Circular No. 2003-01 sets

the grounds for the co-management of watersheds and other forest areas and provides that given
the urgency to protect, develop and manage certain forest and forestlands that by law have been
reposed on DENR or other agencies, concerned Local Government Units (LGUs) may enter into
co-management agreements over said areas;

WHEREAS, DENR Region-IX represented by its Regional Director and the covering
LGUs agreed to jointly undertake activities leading to the co-management and development of
the Sindangan River Basin;

WHEREAS, DENR Region-IX and the Local Government Units agreed to execute this
Co-Management Agreement for the conservation, protection and rehabilitation of the Sindangan
River Basin with an approximate area of Eighty Four Thousand Eight Hundred Sixty Two point
Eighty Five (84,862.85) hectares. An Administrative map showing the coverage area of every
municipality of the aforesaid river basin is attached hereto as Annex “A” and made an integral
part hereof;

NOW THEREFORE, for in consideration of the foregoing premises and the mutual
covenants hereinafter set forth, the parties hereby agree on the following:
A. GENERAL AGREEMENTS

The DENR Region-IX and the Local Government Units shall jointly undertake the
following:

1. Cause the conduct of actual ground validation (ground delineation, survey and
boundary demarcation) of the co-managed areas in the Sindangan River Basin to
determine the actual extent of the areas covered by this agreement and provide a copy
of the technical descriptions of the area to the Multi-Sectoral Watershed Technical
Working Group (TWG); and

2. Implement activities within a respective organizational/institutional framework

consistent with the activities defined in the Integrated Watershed Management Plan
(IWMP) within one year from the signing of this Co-Management Agreement until
twenty (25) years.

B. REPONSIBILITIES OF THE LOCAL GOVERNMENT UNITS

1. Assist for the resource mobilization and investment planning through accessing of
funds to support project implementation from the congress, national government
agencies, non-government organizations, international organizations, etc.
2. Provide allocation of financial, technical, and operational manpower supports within
its approved budget to operationalize and manage the LGU respective watershed
areas covered by this co-management agreement;
3. Jointly endorse the IWMP with the DENR Region-IX for review by the Watershed
Multisectoral Technical Evaluation Committee at the DENR Central Office thru
Resolution of support from the Sangguniang Panlalawigan of Zamboanga del Norte
and Zamboanga del Sur.
4. Enact ordinances that will support and facilitate the implementation of the IWMP.

C. RESPONSIBILITIES OF DENR Region-IX

1. Assist for the resource mobilization and investment planning through accessing of
funds to support project implementation from the congress, national government
agencies, non-government organizations, international organizations, etc.
2. Ensure priority implementation of all ENR programs/projects/activities inside the
Sindangan River Basin
3. Provide technical and manpower assistance in the implementation of this Agreement;
4. Jointly prepare the IWMP with the Local Government Units;
5. Deputize selected personnel of the Local Government Units within the river basin to
enforce Environment and Natural Resources (ENR) laws and regulations in the co-
managed areas;

D. AMENDMENTS

All amendments, revisions and/or modifications to this Agreement must be approved in

writing by both Parties.

E. EFFECTIVITY

This Agreement shall take effect immediately upon signing hereof and shall remain in
effect for twenty-five (25) years unless earlier terminated or renewed, as the case may be, by
both parties.
