BUTUAN City--The Kilu-
sang Mayo Uno said Cara-
ga’s mining and agricul-
tural sectors are the most
problematic in terms of
labor issues and concerns.
KMU revealed this
even as some 1,000 work-
ers and activists from the
five provinces of Caraga
took to the streets here on
Tuesday to air their griev-
ances against the Duterte
administration over what
they said was the govern-
ment’s failure to fulfill its
promises to workers.
The demonstrators, un-
der at least 18 unions in
Caraga led, trooped to the
Guingona Park where they
marked the 115th Labor
Day with a protest rally.
Tito Tanduyan, secre-
tary-general of KMU in
Caraga, said the demand
was for a genuine solution
to the problem on contrac-
tualization, just wages,
and to assert their right to
establish workers’ unions.
“We are here to ask for
what is fair, and for the
workers who have been
exploited and stepped on
all these years,” he said.
Tanduyan noted that
most of the workers who
joined in the Butuan pro-
test came from the mining
sector and plantations. He
said organized teachers
and youth and other groups
also came.
Caraga’s mining sector
is the most problemat-
ic, pointing out that over
8,000 mining workers were
not regularly employed or
were merely contracted
loaborers.
He said the agricultural
sector, especially workers
in oil palm and banana
plantations, is next in their
list. He said there were
nearly a thousand cases of
workers’ rights violations
against plantation owners

and law enforcement oper-
ations against personalities
who were tagged as direct-

that was staged Tuesday

were happy to reveal that it
is peaceful in the province.
“We have no record that
there (was) a rally that was
staged in our area of re-
sponsibility,” said Ranario.

code violation to four local
business establishments.

munities has been consigned to the dis-
cretion of traditional politicians (trapos).
One has but to look around to see
how the sovereign citizens of the baran-
gay are marginalized and manipulated—
practically at will—by people who are
supposedly their public servants. One
sees how even the best educated and
most respected citizens are manipulated,
their institutions taken for granted or
treated condescendingly.
One sees also how every citizen’s

THE second word, dear graduates, that I
offer to you on this day of your gradua-
tion. Calling. In these times, during this
interregnum, with the morbid symptoms
staring straight at us, what are we called
to do? What is the mission of the young
Mindanawon lawyer today?
I propose that we are called to do
four tasks: First, to speak truth to power
no matter the costs.. Second, to imag-
ine the possible and invent options that
would allow our society to solve age-old
challenges. Third, to be workers of jus-
tice and human rights and especially for
the poor. Fourth, to be enablers of peace
in our island and country.
We must speak truth to power. But
we must do so gently and with mercy.
Enough of the hatred. Enough of the
division. As young lawyers, be instru-
ments of the truth, be problem and
dispute solvers. Reach out to those who
have different views. Have conver-
sations with those whose politics are
different from yours.

ignore the negative reports about the

depreciated. How many times have
barangay elections been peremptorily
suspended, postponed, or cancelled?.
Without so much as a hearing or consul-

And so our society is now at the
point where virtually every one of its
communities are at the mercy of the
trapos, the dynastic rulers, and assorted
lords. Drug lords. Gambling lords. War
lords. Name them.
Our political landscape has been
bastardized! And it is partly because
citizens who ought to know better have
abandoned their role as the beacon of
righteousness and good governance in
the community.
One does not see the local profes-
sionals—lawyers, educators, financial
managers, development planners—
anywhere in the course of their com-
munity’s governing process. They do
not participate in local meetings. They
ignore the community’s parliament, the
Barangay Assembly and its proceedings,
although they are members. They don’t
bother to participate or bring their ideas

. . . To discern the truth, we need to
discern everything that encourages
communion and promotes goodness
from whatever instead tends to isolate,
divide, and oppose . . . An impeccable
argument can indeed rest on undeniable
facts, but if it is used to hurt another and
to discredit that person in the eyes of
others, however correct it may appear,
it is not truthful. We can recognize the
truth of statements from their fruits:
whether they provoke quarrels, foment
division, encourage resignation; or, on
the other hand, they promote informed
and mature reflection leading to con-
structive dialogue and fruitful results .
. . The best antidotes to falsehoods are
not strategies, but people: people who
are not greedy but ready to listen, people
who make the effort to engage in sincere
dialogue so that the truth can emerge;
people who are attracted by goodness
and take responsibility for how they use
language.”’
In this spirit, I would call on the
Duterte administration to abandon its
plan to award the reconstruction of
Marawi to a Chinese-led consortium
of companies. That is a disaster in the
making. Everyone I know in Marawi is

use their great influence to exact obedi-
ence from smaller nations.
Without going into history, we make
judgments based on what we see at face
value, and conclude that communist
countries are bad. Because we are so
used to a democratic life, we readily
accept the idea that communism is bad.
A communist country has its reason
for being one, and only its people can
understand and may agree or disagree.
Beyond its border, we can only watch
and rely too much on available informa-
tion.
China has been a communist country
until today. It is said that Mao Tse-Tung
killed hundreds of thousands of his own
people. Perhaps, more! But for a huge
nation like China with a population of
more than a billion, she needs a unifying
force or figure to unite it amid the threat
of being divided.

Unsung heroines
circa 1900-1901
Conclusion
JULIA Valmorida, known as Lolay,
was one of the belles of Balingasag.
She married Vicente Roa y Racines of
Cagayan de Misamis Past Speaks
who was then a
First Lieutenant of
the Spanish Army.
During the period of
the Aguinaldo rev-
olutionary govern-
ment, Roa who had
had military experi-
ence, was given the A. Paulita Roa
rank of Captain and
headed the First Company of the Mind-
anao Battalion. After a rigid training of
his men in Camp Maitum, they marched
to the coastal area for patrol work and
his wife was not far behind. Lolay was
by then pregnant with their first child but
it did not deter her from riding a horse
and following her husband everywhere
he went.
On May 14, 1900, when Capt. Roa
and his men were in Agusan Hill and
were preparing for the coming of later,
the American forces, he was informed
that Lolay was on a hut a few kilometers
away and was experiencing labor pains.
It is said that her husband later took of
his bloodied coat and gave it to one of
his men with the instruction for Lolay
to wrap their new born child with his
coat and to name the baby after him.On
that day, Capt. Roa and most of his men
died in that historic battle in Agusan
Hill. Lolay named the baby Vicenta. Her
apparent sadness moved someone to
compose a song to comfort her over the
loss of husband:
“Lolay ayaw kasakit, kay si Vicente
atua na sa langit.” (Lolay dont be sad for
Vicente is now in heaven.)
When Vivencia Velez de Gaerlan was
asked about her married life, she would
wistfully reply that most of her time was
spent on horseback following her hus-
band, Maj. Justo Gaerlan, a high official
next to Col. Apolinar Velez of the West-
ern Mindanao Division. The headquar-
ters was located in a large forested area
dotted with hills starting from Barangay
Bayanga up to Talakag. It had hills with
descriptive names like Dili Maantus
and Supaksupak and was near the upper
Cagayan river. This was where Vivencia
Gaerlan, together with other wives and
children camped with the men.
June 4,1900 will go down in local
history as the day when American sol-
diers suffered heavy losses and had to
retreat when they unsuccessfully tried to
enter the small fort in Macahambus hill
that was the gateway to the headquarters
of the Western Mindanao Command.
The fort was guarded by a detachment
headed by Lt. Cruz Taal. This was the
first victory that the Filipinos had over
the Americans and is known as the battle
of Macahambus Hill. Col. Velez gave the
dead American soldiers a proper military
burial and treated the wounded in the
field hospital. He then left Talakag and
set up a base in Opol while Maj. Gaerlan
assumed command of the camp.
Then the Americans came back with
vengeance. An expedition was sent to
capture Macahambus at all cost. Being
aware of the fact that the Americans had
the latest military hardware that translat-
ed to superior firepower, Maj. Gaerlan
ordered all the wives and children in the
camp to leave immediately. Vivencia
Gaerlan’s grandchildren recounted to me
the unusual way that their lola was evac-
uated -- she and all of the dependents
were brought to the mouth of Macaham-

THE $64-question that needed
to be answered regarding the
criticisms that are
being hurled against
two Tulfo brothers
-- Ben and Erwin
-- in connection with
the reported use of
some P60 million
from the Department
of Tourism (DOT) Batas
as advertising fees Mauricio
for their programs
at PTV 4, is quite simple: was
there any law that was violated
by anyone here?
Critics are complaining that
the P60 million payments appear
to be reeking with anomaly, sim-
ply because the DOT is headed
right now by their sister, Tour-
ism Secretary Wanda Tulfo Teo.
Many are saying that a big favor
accrued to the Tulfo family by
the use of DOT funds for Ben’s
and Erwin’s programs.
The Tulfo brothers violated no law
Now, if we are to talk about
the law here -- and it is the law
we should be talking about
on matters such as this -- it
would be clear that no rule
or regulation was trans-
gressed by the use of some
P60 million in DOT funds
for the programs of Ben
and Erwin Tulfo. Why am I
saying this? For the simple
reason that the two did not di-
rectly transact with their sister,
Wanda, or with the agency that
she is heading today, the DOT.
Under the Anti-Graft and
Corrupt Practices Act (or Repub-
lic Act 3019, as amended), what
is considered therein as graft is
the giving of favor by an officer
or employee of the govern-
ment in favor of his immediate
relatives, through the discharge
of his or her official duties and
responsibilities.
What the law contemplates
here is the direct contractual en-
gagement between a government
official, like Secretary Teo, with
the members of his or her own
family, like Ben and Erwin. So
the question should really be, did
Teo directly contract with Ben
and Erwin in connection with
the P60 million advertising fees
for their programs? The clear
answer is, no.
DOT actually contracted
with another party. And Ben and
Erwin contracted with someone
else. According to the pieces of
evidence that Wanda released
to the media on Monday, DOT
entered into an agreement with
PTV 4, not with her brothers or
their company.
This seals the fact that no law
was ever violated in this transac-
tion.
On the other hand, Ben and
Erwin contracted with PTV 4, not
DOT.

Therefore, there is no contrac-
tual relationship at all between
DOT and Teo, and Ben and
Erwin.
Of course, Tulfo critics will
say that their contract should not
have been entered into in the first
place because, even assuming it
did not violate any law, it would
not be looked kindly upon by,
and will not sit well with, our
countrymen. Well, if the truth be
told, there are many contracts in
government that did not sit well
with, nor were looked kindly
upon by, many citizens, but yield-
ed truly beneficial results just
the same.
My view is that the contract
between DOT and PTV 4 was
intended by the DOT to help
PTV 4 increase its financial
capabilities, so that it can have
the necessary funds to continue
its operation as a government
station. PTV 4 after all is not

enjoying advertising support
in the way private TV stations
are raking it in. Perhaps, the
contract stipulated that PTV 4
should devote the funds coming
from DOT to its shows and pro-
grams that have been ranking
high in ratings, to attract more
viewers.
Indeed, PTV 4 knows that,
today, the programs of Ben
and Erwin Tulfo are enjoy-
ing popular viewer support,
compared to its other shows
and programs. That being the
case, it is but wise and natural
that DOTs funds should be
channeled to Ben and Erwin’s
programs. The end result of all
these is that, DOT and PTV
4 would enjoy, as they in fact
enjoyed, greater advantage for
their own purposes.

prepared by this or that gov-
ernment agency, or even by

cern the citizens of the com-
munity but are done by parties
external to it; lists whose
contents are known only to
those who claim to possess
them. Drug list, Crime list.
Gambling list. Name them!
Even the president claims
to have a list. But does the
concerned community pre-
pare or maintain their own
lists? As far as I know, no
barangays prepare or main-
tain such lists, and none are
furnished copies of such lists.
Are the barangay people
presumed to be unaware of
the goings-on in their own
backyard? If so, it would
betray how little faith the gov-
ernment and its functionaries
have in the people they serve.

This explains why many
people feel they are being
taken granted by agencies
and operatives that conduct
raids in their midst, even at
ungodly hours.
The government should
stop claiming that all these
are done on behalf of the
people if the people are treated
largely as mere spectators.
At the least, they should be
consulted. Or they should
be informed about who are
listed in their own neighbor-
hoods—and asked to validate
the information.
The people are the princi-
pals of the community. They
should have a say in what are
being planned or being done
in their neighborhoods. And

the proposal. I have nothing
against the Chinese. I col-
laborate with them on many
global and regional issues
but they are not the right fit
here. Imagine what it would
look like when hundreds of
Chinese engineers and works
arrive in Marawi. Imagine
the resentments of many Ma-
ranaos who are shunted aside
in their own beloved city, not
allowed to rebuild it and bring
it back to life. Imagine if those
who were angry would take
matters on their hands and join
terrorist groups. Imagine a
state where our soldiers would
have to defend foreign work-
ers against our own people.
In Marawi, you have a
ticking time bomb there now,
a powder keg – the wrong
decisions on reconstruction
could cause a conflagration
that would be worse than the
Marawi siege of 2017.
Don’t think that you here
in Digos and the Davao region
will not be affected when
Marawi blows us. All of us
in Mindanao will be affected,
madamay, malakip, as we
were with the martial law
declaration that is now going
to last a year and a half by the
end of the year.
Even as we must speak
truth to power, we must imag-
ine the possible, find ways to
solve decisively our deeply
rooted problems.
As far as I can remember,
Mindanao has always been
called a land of promise. Now
that we have a Mindanawon
President, can we now expect
to see that promise realized?
As someone who travels
regularly in many parts of
Mindanao and who have
been doing so for forty years,
I see many good physical
changes happening. We are
less isolated from each other.
To the credit of successive ad-
ministrations, roads, bridges,
ports, and airports have been
built and we are increasingly
connected to each other now.
With the infrastructure plans
of the Duterte government,
this will improve further and
our island will become more
integrated, including particu-
larly our economies. Imagine
the railway that is going to
be built connecting Digos,
Davao City, and Tagum –
imagine the possibilities that
will open up for you as law-
yers imagine the possibilities
for other professionals too,
imagine the housing boom
that will create.
My support for “Build
Build Build” is unequivocal. It
is necessary to defeat poverty
and to spur development. It
must be of course done corrup-
tion-free and in a financially
cost-effective way. It’s import-
ant that we choose properly
the financing for the Duterte
infrastructure program. We
do not want to be stuck with
unsustainable foreign debt
and particularly from China
who can demand an enormous
chunk of flesh, our sovereignty,
if we cannot repay.
The good thing is that we
have trustworthy and veteran
economic managers – Finance
Secretary Sonny Dominguez,
Budget Secretary Ben Dio-
kno, Neda Director General
Ernesto Pernia, and Central
Bank Governor Nestor Es-
penilla. In fairness, all the
economic managers we have
had from the Marcos to the
Duterte era, including the
last two administrations of
Arroyo and Noynoy Aquino,
have had good reputations as
technocrats; they have done
well with our fundamentals
even as they have essentially
been following what others
criticize as neoliberal policies.
While excited about the
economic possibilities of our
island and our country, there
is still no assurance that in-
clusive development will be
achieved in the near future.
That is the essential flaw of a
neoliberal economic strategy
– it might create prosperity;
it might enable development
but it does not automatically
translate to benefits for the
poor and the marginalized.
Worst, neoliberal policies
frequently have the perverse
effect of excluding the poor
more from development.
In our island, the roads that
we are building are good but
not if those roads are going
to be used by rich, powerful,
and connected individuals
and companies to open more
areas to mining, palm tree
plantations, commercial and
industrial tourism, and other
development aggression that
will destroy our environ-
ment and displace indigenous
peoples, farmer, and local
communities. That is not an
acceptable consequence of
development.
I encourage you always to
be lawyers for the poor, for the
Lumad, for farmers, workers,
women, children, and people
with disabilities. I encourage
you to be lawyers for the plan-

ties and when betrayals led to
one from another, taking a toll
on innocent lives. The Chinese
credited Mao Tse-Tung for
unifying China, Deng Xiaop-
ing for opening China’s gates
to the world and the leaders
after them for what China is
today.
Korea is a divided nation,
torn apart by an internationally
imposed demilitarized zone.
The South has the backing of
the West, but it was its own
people and industry that made
it what it is today. And North
Korea lags behind.
To say that North Korea
is evil is subjective. A leader
has a responsibility to his/her
nation and people. How these
responsibilities are executed
can be presumed as the best
options available.
Killing one’s own people
will always look bad but I
have a different view on that.
For me, it’s like having cancer
in one part of my body that
needs to be removed or else it
will spread to other parts, and
threaten my life.
So what if North Korea is
developing nuclear weapons?
North Korea has the right to
protect itself. Some would
say, “A nuclear weapon in the
hands of a crazy man (referring
to Kim Jong Un)? That’s dan-
gerous.” Really? And when
the great nations of the West
have hundreds or thousands
of nuclear weapons, is that not
dangerous?
If my neighbors have guns
which could threaten my fam-
ily, shouldn’t I get one, too?
The world just witnessed
the historic meeting of lead-
ers of a divided nation. The
international community has
a responsibility to make it
fruitful and its unification suc-
cessful the way West and East
Germany did.
Politics will always attempt
to prevent unification espe-
cially so when certain vested
interests are threatened. But let
us all look at the positive sides.
After all, the North Koreans
are people, too, who dream of
a better life, and with freedom.
I wish the Korean people a
better and peaceful life.

below that would bring them
to safety. Instead, they let
themselves be carried down-
river by its strong currents. In
Binisaya we call it “nagpa-an-
od sa suba.” It must have been
a frightful experience for the
ladies who were dressed in
their long sayas but neverthe-
less, all of them including the
children survived the watery
ordeal. After the surrender of
the local resistance army to
the Americans the following
year, Maj. Gaerlan was exiled
to Guam where he died shortly
afterwards.
At the Plaza de los He-
roes, Mindanao’s first Philip-
pine-American War memorial
located at the Pueblo de Oro
Township along Masterson
Avenue, one can see the names
of the Eblacas family who to
this day still have a farm in
Kinawe, Bukidnon. This place
is directly across Macahambus
hill and is separated by the
Cagayan river. Among the
members of the this family
were sisters Bartola and Anas-
tasia who cared for the sick and
wounded soldiers that sought
refuge in the family farm.
Years later, one of those who
experienced their kindness
called the sisters, the Tandang
Soras of the revolution. Most
of the produce of their land
of the Eblacas family went to
supplying food for the hungry
soldiers.
These are just a few of the
many unsung heroines during
the 1900-1901 war and only
God knows the names of the
rest of them. At the heart of this
is a common thread that that
run through the stories of these
women who disregarded the
traditional myth of a coy and
subservient turn of the century
century female. Like Arcadia,
who fought the enemy along
with the men, there were wives
who left the comfort and safety
of their homes to follow their
men, cared for the sick and
wounded, loaded shotguns
and willingly shared physical
hardships,hunger and not to
mention the pain of losing
their men in battle. They never
really knew the dangers of the
war till they came face to face
with it. But their presence was
a way of saying that “We are in
this war together. It is also our
war!” Our unsung heroines de-
serve to be memorialized with
a monument for they enriched
our history with their patriotic
spirit, fidelity, courage, com-
passion and sacrifices.

Ease of Doing Business law will raise Philippine’s global ranking
HOPES are high that the expect-
ed passage of The Ease of Do-
ing Business and Efficient Gov-
ernment Service Delivery Act
of 2018 will help improve the
country’s ranking in the World
Bank and International Finance
Corporation’s (IFC) 2019 Doing
Business Report.
Trade and Industry Undersec-
retary Rowel Barba told report-
ers that the agency hopes that
President Duterte will soon sign
the legislation into law so it can
be counted among the reforms
implemented this year. The lat-
est World Bank-IFC report cov-
ers the June 2017 to May 2018
period.
During the first quarter of the
year, Congress passed the Ease
of Doing Business and Efficient
Government Service Delivery
Bill that amended Republic Act
9485 or the Anti-Red Tape Act
of 2007.
“It is still pending in
Malacañang, and I think the Of-
fice of the Executive Secretary is
asking for comments from other
government agencies,” Barba said.
Barba mentioned that the Pal-
ace is seeking comments on a
two-strike policy, that requires
government offices to deliberate
upon and issue permits in three,
seven, or 20 days depending on
the circumstance, upon complete
submission of requirements or
face penalties.

prices rise on
Labor Day
OIL firms have announced in-
crease in pump prices effective
May 1, Labor Day.
Effective 12:01 a.m., Petron
will carry a price hike of P1.90
per kilogram for liquefied petro-
leum gas, and P1.05 per liter for
AutoLPG.
Starting 6 a.m., Petron, Jetti,
TOTAL, Eastern Petroleum,
Phoenix Petroleum, PTT Phil-
ippines, SEAOIL, Unioil Pe-
troleum Philippines, Flying V,
and Shell will implement price
hike of PHP0.85 per liter for
gasoline, and P0.70 per liter for
diesel.
Likewise, Petron, SEAOIL,
Flying V, and Shell will raise the
price of kerosene by P0.70 per
liter.
The oil firms said the adjust-
ments reflect price movements
in the international petroleum
