PROPOSED ORDINANCE MAKING SENIOR CITIZEN ORGANIZATIONS IN BISLIG CITY


MORE RESPONSIVE TO THE NEEDS OF ITS CONSTITUENCY AND OTHER RELATED
MATTERS (TN2016-06-412)

EXPLANATORY NOTE

A singular umbrella organization for a particular sector is beneficial because it could unite the voice
of that sector and therefore give their voice impact in policy-making and decision-making. This
holds true for the senior citizen sector.

The organization of the senior citizen of Bislig City has had its own challenges; more particularly, it
was beset with leadership and organizational crises which made it more difficult for its members to
avail of their benefits under the law.

There was a mandate from the Provincial and Regional Federation of Senior Citizens Associations
for the cities and municipalities to have only one federation in their respective LGUs. Thus, towards
this end, a simultaneous elections of senior citizen officials was conducted in 2016. Resultantly,
Mrs. Josequita E. Iral came out victorious as President of the Federation of Senior Citizen
Association of Bislig City (FSCABC). Previously, however, the Office of the City Mayor recognized
another senior citizen organization headed by Atty. Remedios R. Alvizo who is the President of Bislig
City Federation of Senior Citizen Association, Inc. (BCFSCAI).

This is not the first time that this organizational and leadership crises arose in the senior citizen
sector in this City. The same incident happened before but the warring factions were reconciled
and brought to a common understanding with the able intervention of the Office of the City Mayor.

In order to foreclose the possibility of a recurrence of the said organizational and leadership crisis in
the senior citizen sector in this City, there is an urgent need to promulgate a policy that would
mandate the recognition of a singular senior citizen umbrella organization.

Likewise, there is a need to provide guidelines for the creation of senior citizen organizations under
the umbrella organization in order to rationalize the overlapping memberships of senior citizen
chapters in this City.

Finally, there is also a need to create a trust fund for the senior citizens in order that all income,
donations and other funds for them can be deposited thereto for their own use and/or disposal.

Be it ordained by the Sangguniang Panlungsod of the City of Bislig, that :

SECTION 1. Title. – This ordinance shall be known as the “Responsive Senior Citizens Organizations
in Bislig City”.

SECTION 2. Adoption of Policies and Objectives. – The City of Bislig hereby adopts the declared
policy that there should be unified federation of senior citizen which could effectively represent the
sector’s needs and, for this purpose, adopts the following objectives, more specifically :
a. To establish mechanisms whereby the contributions of the senior citizens may be maximized;
b.To adopt measures whereby senior citizens are assisted and appreciated by the community as a
whole;
c. To establish a program beneficial to senior citizens, their families, and the rest of the community
they serve;
d.To establish community-based health and rehabilitation programs for senior citizens in every
political unit of society; and
f. To attain all of the foregoing objectives through a single umbrella federation.

SECTION 3. Senior Citizens Organizations. – Even as City Hall officials and offices respond to
individual needs of senior citizens, the OSCA shall be the primary office tasked to coordinate and
assist in organized efforts by senior citizens associations. Hereinafter, the following guidelines shall
govern the creation and operation of all senior citizen organizations in Bislig City, to wit:

A. Senior Citizen Chapters –

1. There may be created more than one Senior Citizen Chapter per barangay;
however, each chapter shall have a corresponding territorial jurisdiction and all
members of a chapter shall be residents of its territorial jurisdiction; For this
purpose, the OSCA in coordination with the CSWD, shall finalize the territorial
jurisdiction of each chapter which shall govern the organization of the senior citizen
chapters.

2. No senior citizen chapter shall be accredited or allowed to exist without any


required number of members.

3. Membership in each chapter shall not be less than fifty (50) senior citizens.

B. Barangay Association of Senior Citizens Affairs (BASCA) –

1. There shall be one (1) Barangay Association of Senior Citizens Affairs (BASCA) in each
of the twenty-four (24) barangays of Bislig City and shall hold office in their
respective barangay halls. All Chapters with territorial jurisdiction within a certain
barangay should present or submit their respective budget proposal to the
corresponding BASCA.

2. A representative of the BASCA should be a member of the Barangay Development


Council for purposes of assuring representation and the budgetary allocation for the
senior citizens in the said barangay.

3. Each BASCA shall submit to its respective Punong Barangay its annual plans and
requests for budgetary assistance from the barangay.

C. Senior Citizen Federations –

1. The Federation of Senior Citizen Association of Bislig City (FSCABC) shall be


recognized as the official umbrella organization of all the BASCAs in the city.

2. After the term of office of the FSCABC officials, there shall be created a Unified
Senior Citizen Federation of Bislig City (USCFBC) UNIFYING all chapters in Bislig City
through the assistance of the OSCA and the CSWD and which shall thereafter be the
recognized federation of senior citizens in Bislig City.

3. Thereafter, the new federation shall endeavor to register the same with the
Securities and Exchange Commission (SEC) or with the Department of Labor and
Employment (DOLE);

4. Only Chapter Presidents in Bislig City shall be qualified to run and vote for the
different positions in the said USCFBC.

5. The term of office of these elected officials shall be for three (3) years pursuant to
the by-laws of the federation.

6. The USCFBC shall collate its own as well as all BASCA annual plans and requests for
budgetary assistance from the City Government and submit the same to OSCA for
consideration and accommodation in time for the annual budgeting process of the
City Government in August each year.

The Sangguniang Panlungsod, through the Committee on Cooperative and Livelihood, in


coordination with the OSCA and the CSWD, shall ensure that all senior citizen organizations are
properly and regularly reviewed and accredited on an annual basis.

SECTION 4. OSCA Trust Fund –

a. The OSCA Trust Fund is created and maintained at the Treasurer’s Office to provide additional
financial and/or material aid to senior citizens for health care and rehabilitation system for the
disabled senior citizens and extend assistance to the needs of the underprivileged, sick, and
incapacitated elderly and give full support to the improvement of the well-being of the elderly.
Unexpended mortuary aid and AICS for the year shall likewise be deposited to this account.

b. To this OSCA Trust Fund shall be paid/deposited all payments for replacement of ID’s and
Purchase Booklets, donations from individuals or institutions, earnings from income-generating
activities and projects undertaken by the OSCA, and savings from externally-funded activities.

c. This OSCA Trust Fund shall be managed by Trustees that by resolution shall approve
disbursements for full and exclusive assistance to senior citizens in need and shall require annual
audit of the same. The Trustees shall include:
1) City Mayor – Chairman
2) OSCA Head – Vice-Chairman
3) Sangguniang Panlungsod Chairman of the Committee on Social Welfare – Member
4) City Treasurer – Member
5) USCFBC President – Member

SECTION 5. Budgetary Provision. – (a) Annual Budget. As provided in Ordinance No. _______, fifty
percent (50%) of the one percent (1%) of the IRA shall be allocated as follows, to wit:
(1) MOOE = ____%

(b) Federation Election Budget. – For the election of federation officers every three years starting
2019, there shall be allocated the amount of Twenty-five Thousand Pesos (P25,000.00), Philippine
currency, for purposes of the conduct of election of the officers of Unified Senior Citizen Federation
of Bislig City (USCFBC) to be conducted and supervised by the OSCA in coordination with the CSWD.

SECTION 6.Transitory Provision. – The two (2) existing senior citizen federations, namely, the Bislig
City Federation of Senior Citizen Association, Inc. (BCFSCAI) and the Federation of Senior Citizen
Association of Bislig City (FSCABC), shall continue to exist with corresponding benefits UNTIL the
creation of the Unified Senior Citizen Federation of Bislig City (USCFBC).

SECTION 7.Separability Clause. – Any provision of this ordinance found to be in violation of the
Constitution or declared invalid by a competent court shall not impair the other provisions or parts
thereof and shall continue to be in force and in effect.

SECTION 8. Repealing Clause. – Ordinances, rules and regulations or parts thereof which are
inconsistent or in conflict with provisions of this ordinance are hereby repealed. Likewise, all
previous senior citizen ordinances particularly, except for the persons with disabilities (PWD)
provisions in Ordinance No. ______, are hereby repealed.

SECTION 9. Effectivity. – This ordinance shall become effective immediately upon approval.
