JUDICIAL AFFIDAVIT

I, HERNEL MAE S. SANTIAGO, of legal age, Filipino, and residing at


Ramos Ext., Brgy. Capitol Site, Cebu City, after having been sworn to in
accordance with law, hereby freely answer the following questions
propounded by Atty. Katreena M. Bisnar in her office located at 718 Cebu
Holdings Center Bldg., Cardinal Rosales Ave., Cebu City, Philippines.

Q1: Please state your complete name, age and profession.


A1: I am Hernel S. Santiago, 50 years of age. I work as a Medico-Legal
Officer with the rank of a Police Chief Inspector at the Philippine
National Police - Regional Crime Laboratory Office in Camp Sotero
Cabahug, Cebu City.

Q2: Kindly state your educational background leading to your


profession as of this date.
A2: I obtained my academic degrees in Bachelor of Science in Nursing
and Doctor of Medicine from Cebu Doctors’ University in 1988 and
1992, respectively. I finished my Post–Grad Internship at Cebu Velez
General Hospital in 1993 and also passed the Physician Licensure
Exam that same year. Thereafter, I went to the University of the
Philippines-Philippine General Hospital (UP–PGH) and completed my
Residency Training in Anatomic and Clinical Pathology in 1996. A year
after, I went to Seattle, Washington in USA to specialize in Forensic
Pathology at the King County Medical Examiner's office and
proceeded as an Exchange Scientist in Legal Medicine at the Kobe
University School of Medicine in Japan. I also attended various
courses in Forensic and Legal Medicine abroad.

Q3: What do you do as a Medico-Legal Officer?


A3: I conduct autopsies on cadavers and issue autopsy reports.

Q4: How long have you been working as a Medico-Legal Officer of the
PNP – Regional Crime Laboratory?
A4: From 1998 up to the present or for about 19 years now.

Q5: Is this your first time to testify in court?


A5: No.

Q6: Based on the foregoing qualifications, can you say that you are
competent to testify as to the cause of death of Lino Mulinyawe?
A6: Yes.

Q7: Where were you on December 9, 2017 at around 10:00 A.M.?


A7: I was in Cosmopolitan Funeral Homes at Nivel Hills, Lahug, Cebu
City.

Q8: Why were you there?


A8: I was there to conduct an autopsy as requested by PNP Crime
Laboratory Regional Chief Romer S. Daguno.

Q9: On whose remains were you conducting said autopsy?


A9: The remains were those of Lino Mulinyawe.

Q10: How can you say that the remains were those of Lino
Mulinyawe?
A10: Aside from his dental records, the corpse was personally
identified by the widow, Lina M. Mulinyawe.

Q11: How did you perform the autopsy?


A11: During the procedure, I made an internal and external
examination of the corpse in order to determine the cause of death.
Q12: What was the state of the corpse when you conducted such
autopsy?
A12: The corpse was of a fairly nourished, fairly developed male
cadaver, in rigor mortis, with postmortem lividity at the dependent
portions of the body. Conjunctive lips and nailbeds are pale.

Q13: What were your findings?


A13: The post-mortem findings, as shown in the Autopsy Report
which I attach as Annex “A” and made an integral part hereof, are as
follows:

(a) Lacerated wound, left parietal region, measuring 2 by 0.7


cm, 5 cm from the midsagittal line.

(b) Abrasion, left parietal region, measuring 1.2 by 0.6 cm, 8 cm


from the anterior midline.

(c) Abrasion left maxillary region, measuring 2 by 0.3, 4.5 cm,


from the anterior midline.

(d) Stab wound, left mammary region, measuring 3.6 by 1.4 cm,
5.5 cm from the anterior line, 12 cm deep, directed
posteriorwards, downwards, and medialwards, thru the 4th left
intercostal space, piercing the pericardial sac and left ventricle.

Q14: Based on your findings, what caused the death of Lino


Mulinyawe?
A14: Autopsy examination revealed a penetrating stab wound located
on the left chest which directly damaged the heart and resulted to
Lino Mulinyawe’s instantaneous death.

answers that the witness gave in her Judicial Affidavit.

3. Nobody coached the witness during her examination.
