Probable Cause Statement ON 05/15/2017 AT APPROXIMATELY 2242 HOURS I RESPONDED TO BUCKEYE FIRE STATION 7 AT 404 § MILLER RD. DISPATCH ADVISED THAT A BUCKEYE FIRE FIGHTER HAD BEEN AS- SAULTED AND THAT THE SUSPECT WAS CORNERED IN THE PARKING LOT. UPON ARRIVAL I OB- SERVED OFFICERS SPEAKING WITH THE DEFENDANT. HE WAS SEATED ON THE HOOD OF HIS CAR SMOKING A CIGARETTE. I OVERHEARD THE DEPENDANT TELL OFFICERS THAT HE WAS STAYING IN CASA GRAND BUT HE HAD DRIVEN TO HIS WIFE'S RESIDENCE IN WADELL TO BRING HER SOME PAPERWORK. OFFICERS ADVISED ME THAT HE STATED WHEN HE ARRIVED SHE WAS LEAVING SO HE FOLLOWED HER AND SAW HER “SUCKING FACE" WITH THE MALE VICTIM. 1 CONTACTED THE MALE VICTIM INSIDE THE FIRE STATION. HE WAS WEARING A BLUE UNT- FORM TEE SHIRT WHICH CLEARLY IDENTIFIED HIM BY NAME AND AS A BUCKEYE FIRE FIGHT- ER, I OBSERVED HIS LEFT EYE WAS BLEEDING, AND SEVERELY SWOLLEN. THERE WAS BLOOD DRIPPING DOWN THE LEFT SIDE OF BIS FACE AND ON HIS EAR. THE VICTIM ADVISED THAT HE IS ON DUTY. HE STATED THAT THE FEMALE HE IS DATING WAS VISITING HIM AT THE STATION. HE SAID THAT THEY WERE JUST OUTSIDE THE BAY DOORS ON THE EAST SIDE OF THE BUILDING. HE SAID THAT THE DEFENDANT WHO WAS UNKNOWN TO HIM, CAME AROUND THE CORNER AND SAID WHATS UP MOTHERFUCKER AND THEN PUNCHED HIM IN THE FACE. HE SAID THAT HE DIDNT FIGHT BACK INITIALLY BECAUSE HE THOUGHT IT MAY HAVE BEEN A TRANSI- ENT FROM THE AREA. HE SAID THE FEMALE THEN STARTED YELLING THE DEFENDANT'S NAME. HE SAID THAT HE THOUGHT THE DEFENDANT WAS GOING APTER THE FEMALE SO THEY FOUGHT FOR A MOMENT UNTIL OTHER FIRE FIGHTERS CAME OUTSIDE. HE SAID HE MAY HAVE GOT A HIT OR TWO IN BUT WASNT SURE. HE WAS THEN TRANSPORTED TO ABRAZZO EMERGENCY ROOM IN BUCKEYE TO BE EVALUATED. I WAS LATER ADVISED THE VICTIMS LEFT ORBITAL WAS BROKEN IN 3 PLACES, HIS NOSE WAS BROKEN, REQUIRED STITCHES AND WOULD BE REFERRED TO A PLASTIC SURGEON. I THEN CONTACTED THE FEMALE VICTIM WHO ADVISED THE MAN IS HER ESTRANGED HUSBAND. SHE STATED THAT THEY ARE MARRIED BUT HAVE BEEN SEPARATE. FOR 8 MONTHS. SHE SAID THAT HE LIVES IN CASA GRAND RIGHT NOW AND DOES NOT KNOW WHY HE WAS THERE. SHE STATED THAT SHE HAD BEEN HOME IN WADDELL FOR A COUPLE OF HOURS AND THEN CAME TO THE FIRE STATION IN BUCKEYE TO VISIT THE MALE VICTIM AND BRING SOME FOOD TO THE FIRE STATION, SHE STATED THAT THE DEFENDAT CAME AROUND THE CORNER AND SAID WHATS UP MOTHERFUCKER AND THEN PUNCHED THE MALE VICITM IN THE FACE. THE DEFENDANT WAS PLACED UNDER ARREST AND TRANSPORTED TO BUCKEYE PO- LICE DEPARTMENT FOR PROCESSING. UPON ARRIVAL, I OBSERVED SOME REDNESS TO THE RIGHT SIDE OF THE DEFENDANT'S NECK. I NOTICED THAT THE KNUCKLES ON HIS RIGHT HAND WERE RED AND SWOLLEN. TEE DEFENDANT WAS READ HIS MIRANDA RIGHTS AT WHICH TIME HE STATED HE DID NOT WISH TO ANSWER ANY QUESTIONS UNTIL HE WAS ABLE TO CON- TACT A LAWYER. HE WAS THEN TRANSPORTED AND BOOKED INTO 4TH AVENUE JAIL FOR IA. NOTHING FURTHER.
