Supreme Court
sitting en banc
yesterday granted the
quo warranto petition
filed by Solicitor General
Jose Calida that sought to
nullify the appointment
of Chief Justice Maria
Lourdes Sereno.
This was announced
by SC spokesman Theo-
dore Te in a press briefing
after the High Court’s
special en banc session.
Sereno is the first
Chief Justice to be
removed from office
through quo warranto
proceedings.
“The petition for quo
warranto is granted, re-
spondent Maria Lourdes
P.A. Sereno is found
disqualified from and is
hereby adjudged guilty of
unlawfully holding and
exercising the office of
the Chief Justice. Accord-
ingly, respondent Maria
Lourdes P.A. Sereno
is ousted and excluded
therefrom,” reads part of
the court decision.

grant the quo warranto
petition against Sereno

from the Cagayan de Oro
City Police Office (Cocpo)
will be dispatched to vari-
ous voting precincts in the
city during the elections.

Jaime Y. Tuazon for purposes of opening up his succession under Art.
390 & 391 of the Civil Code has been filed by petition Jane Tuazon
Kabayao, through counsel, on February 5, 2018. Petitioner alleged in
her petition that her father Jaime Y. Tuazon was forcibly abducted by
unknown persons on December 20, 2005, and held for ransom for P5
Million under threat to be killed if not paid said ransom; that her family
negotiated for the kidnappers and able to gave only P350,000.00, but
despite the payment, her father was not released; that the kidnappers
demanded again for additional ransom but they failed to gave and
since then, her family has not heard of the kidnappers and her father;
that she and her family believes that their father who was abducted
and missing is already dead; that her father left certain properties and
they can not settle and partition the same. Hence, this petition.
Finding the petition to be sufficient in form and substance, the

2018 at 8:30 o’clock in the morning, at the Session Room of his Court,

No extra charge for subscribers who opt to be billed on paper: NTC
THE National Telecommunica-
tions Commission (NTC) has or-
dered telecommunications firms
not to charge additional fees on
subscribers who still opt to receive
their bills on paper.
This as NTC has released
Wednesday its guidelines which
seeks to implement electronic bill-
ing in the country.
Under Memorandum Circular
03-04-2018, telco subscribers are
given the option to either be billed
electronically or to receive the bill-
ing statements on paper, in the tra-
ditional manner.
Telcos should provide paper-
printed bills free of any charge for
those who prefer to receive them
in that manner.
“If a subscriber opts to receive
electronic bills, he/she shall provide
an email address where the state-
ment of account shall be forwarded.
Telcos, however, may offer and/or
use other mediums of communica-
tion, including web portals, provid-
ed notice to subscribers are made,”
the NTC said in a statement.

ally need to focus on inflation.”
Pernia, also National Econom-
ic and Development Authority
(NEDA) Director-General, at-
tributed the rising inflation to
the temporary effects of the
implementation of Tax Reform
for Acceleration and Inclusion
(TRAIN).
TRAIN, the first package of
the government’s tax reform pro-
gram, reduced personal incomes
taxes but increased excise taxes
on fuel and motor vehicles since
the law took effect last January 1.
“For consumers, we need to
address sources of rising infla-
tion, even if the uptick brought
by the temporary effects of
TRAIN is expected to gradually
ease this year,” he said.
The NEDA chief underscored
the need to immediately lift the
quantitative restrictions on rice
in a bid to reduce retail price of
rice, thus increase the purchas-
ing power of low-income house-
holds and bring down inflation.
“We also need to address ris-
ing prices of fresh fish, meat, and
vegetables. As demand continues
to increase with a growing popu-
lation and expanding economy,
reducing food inflation is nec-
essary to increase people’s pur-

Family ties that bind
SO… Maybe it’s some kind of denial, or
maybe it’s some kind of resignation. Ev-

tion to the personali-
ties who populate our
political landscape.
It’s just that this time
I’m noticing that even
at the barangay level,
the redundancy and

me somewhat aghast. And confused.
And frustrated.
For years the discussion about the
anti-dynasty law has been making the
rounds, but certainly not making prog-
ress. After all, those most affected are
those who make and pass the laws. If
and when the bill passes and is enacted,
it will without a doubt be an impotent
and watered-down law which will have
cost us millions of pesos in Congress
and Senate man-hours. So I’ve been
trying to understand (to the best of my
non-political mental processes) why

personnel, is being utilized by Philhealth
in the conduct of its Cagayan de Oro-

families are so heavily invested in poli-
tics.
Going by the Pinoy manner of look-
ing at the worst of things, it makes a lot
of sense that a dominant family leader
who has successfully entered the politi-
cal arena would recruit various members
of his or her clan, whether thru election
to various positions or appointment, to
join the “public service” fold. Oh, yes.
They keep repeating the mantra—“We
want to continue the family legacy of
serving our public and constituency in
order to improve our community and the
lives of our less fortunate brothers and
sisters.”
Let’s not talk about whether they’re
doing a good job or not. That’s another
column. But let’s talk about how large
these political families are. A father
succeeds in entrenching himself in the
government. Pretty soon, he is sure to
be followed by his wife, offspring, his
in-laws and siblings, families of his in-
laws and siblings, grandkids, personal
assistant, housekeeper, driver. They’re
either going to be elected or appointed
to positions. I mean, I can understand

During the consecration of its brand
new workspace, RVP Alonto welcomed
guests, fellow public officers, friends
from the media and, the city’s chief
executive, Mayor Oscar S. Moreno, the
guest of honor. In his speech, Mayor
Moreno emphasized Philhealth’s core
competency as a financial institution.
Accordingly, as such, Philhealth’s busi-
ness is to ensure and insure the hospital-
ization needs of its members. Needless
to say, its funds must constantly be kept
robust via competent, efficient, and
responsible handling of its funds.
Mayor Moreno’s message comes at
a time when Philhealth at the national
level is reported to incur losses of P8.9
billion in the immediately preceding
year, 2017, under the watch of interim
president and CEO Celestina Ma. Jude
P. dela Serna. Incidentally, the latter is
being made to account for her excessive
travel spending amounting to P627,000
which funded her trips (to and from
Manila-Bohol only) despite prior notice
from a junior official that such expenses
were not in line with regular accounting
and auditing rules and are, therefore,
palpably irregular. Hence, the Commis-
sion on Audit (COA) questioned interim

already but physically, I can no longer
be at pace with what I was five or 10
years ago. So, I now have more time at
home than being outdoors.
Yes, I can watch Youtube with anoth-
er gadget. But the monitor is small com-
pared to my 50-inch smart TV. Besides,
it’s more relaxing watching TV in bed.
It may not be complete but it’s more
than enough you could ask for in You-
tube. Search and you shall be provided,
so to speak.
Filipinos love tele-serye programs
that make you laugh and cry. It’s so
typical of Filipinos that when hooked to
it, one can put everything behind just to
be able to update oneself of the next epi-
sode. And when I come across programs
on how to make this and that, programs
that teach how to make a living or how
to generate income, I thought why not
spend time on these programs instead

Be careful whom
you vote for
EVERY vote is cast in the precinct of a
barangay. Perhaps because it is cast in
the lowly barangay, people may think
that it is just a small, insig- Street Talk
nificant matter; that
therefore one need not
be serious about it.
This is perverted
thinking, of course.
An attitude that un-
dermines democratic
governance. It results
in low voter counts, Manny

of whoever wins the
election and setting the stage for corrup-
tion.
Citizens with low regard for the
ballot play into the hands of traditional
politicians who take advantage of their
attitude. Such voters easily fall victim
to predatory trapos who either buy their
votes or pay them not to vote so the rival
candidate will lose.
In fact, even one vote can make a dif-
ference. Letting others know whom you
favor can influence people who look up
to you to vote for your candidate. They
in turn may persuade others to do the
same, and so forth, creating a domino
effect that can multiply your one vote
many times.

One vote can also break a tie—and
produce a winner, who then proceeds to
assume office and wield the powers that
go with it.
It is the vote that bestows authority
to the winner, empowering and enabling
him to make decisions that impact the
wellbeing of everyone. The vote also
makes possible all sorts of undertak-
ings—financial, social, cultural, politi-
cal—in the community.
It is the vote that determines whether
there shall be a good quality of life for
everyone: efficient services, adequate
facilities/amenities, decent infrastruc-
ture, and all sorts of beneficial activities
in the community.
In other words, on the vote in the
barangay hinges whatever good or bad
events befall society after the elections,
triggering all sorts of happenings, local
or nationwide.

A vote also has the effect of enno-
bling a plain citizen, elevating him or
her to a status of privilege and power—
enabling him to undertake all manner
of initiatives and extraordinary things
or acts that he would not be capable of
doing as a plain citizen.
Even a dirt-poor barangay straggler
who gets lucky enough to win an elec-
tion will suddenly acquire a privileged
status—chairman or even kagawad—in
the eyes of businessmen, bankers, and
traders with goods and services they
might wish to offer or peddle to the
community.
One should note that a barangay
officials can avail of bank loans to
finance programs or projects with the
community’s money as collateral. The
barangay’s recurring income—its inter-
nal revenue allotment and various other
sources—can collateralize obligations or
purchases.
There may be a school building,
a playground, a recycling facility, a
dispensary, or even a perimeter fence
to construct. There may be an attractive
barangay property or feature that the
government may want to sell, privatize,
or otherwise dispose of for any reason.
All these present opportunities for sales,
contracts, and other business prospects.

al livelihood and employ-
ment program. But the more
awe-inspiring sight is of
their quick rise to material
gain—mansions, millions
of pesos worth of vehicles,
trips abroad, ostentatious
clothing and jewelry for
the wives and mistresses,
commercial properties and
investments, bank holdings.
Which always leads one to
wonder how these people got
so rich so quickly.
On the other hand, there
will also be this guy (or
guyess) who may not have a
clan hanging onto his coat-
tails, but repeatedly makes an
appearance every time there
is an election. And usually
wins. So we have this person
for the currently-mandated
three terms, after which there
is a switch in office or posi-
tion. Or a three-year hiatus
before making a comeback.
On a side note, maybe there
should be a law making elec-
tive office sticky downward.
This means that someone
cannot run for a public office
lower than the highest office
they have held ever. I mean,
really. An ex-president who
is now a congressperson? Or
an ex-president who is now a
city mayor? A barangay cap-
tain who runs as a kagawad in
the same barangay, under the
banner of the nephew who is
running as captain? What the
eff is that?
What is the lure? In any
and all cases, what is the
lure? There must be some-
thing. After all, public ser-
vice is not a joke. It is ex-
hausting, demands account-
ability (okay, here’s where
I break out into hysterical
laughter), a high level of so-
cio-geo-political knowledge,
diplomacy, mindfulness,
compassion and finesse. And
some other stuff that I can’t
remember because I haven’t
seen them in a very long
while. So what’s the lure?
Of course, the addiction to
power and the ensuing arro-
gance must be very tempting
and almost impossible to let
go. Like the smell of meat
grilling over coals. And the
money. There’s always the
money.
The thing is that everyone
assumes that there is money
being siphoned from public
funds. We all know it. We
all assume it. We discuss it
over beer and pulutan. We
post accusatory statements
on social media. We are not
ignorant (or so we would like
to believe). And yet these
people stay in office. Stay in
power. One must then also
wonder if the voters have that
much faith in them. Actually,
many do. No matter the ques-
tionable reputation some may
have. Staunch supporters will
go the limit for their political
gods. Without question or
doubt.
And then there are those
who know with all certainty
that these people stay in
power because they have
bought their way in and
cannot be unseated. And
that they are crooks, we
just can’t find the proof.
But we know it for sure. So
my questions keep coming.
What are we doing about
it? Do they actually have
that much funding to keep
them in power for eternity?
I always wonder about the
return of investment my-
self. After all, these elected
officials don’t get paid that
much, considering their job
description. SALN’s are sub-
mitted. And we all assume
that it is doctored or that
assets are hidden under some
other person’s name. and we
accept this as our reality.
That’s why I’m con-
fused. We keep screaming
for change, for improvement,
for cleaning up the system.
We’ve been screaming for so
long that I’m amazed we still
have enough vocal power to
embarrass ourselves at the
karaoke night after night.
What has all this screaming
accomplished? Nothing, so
far. And probably nothing
for the years to come. We
are a strange people. Quick
to see the errors and the
weaknesses, and yet just as
weak in making an effort to
do something about anything.
Or maybe someone should
write about how these clans
and dynasties manage to hold
such a magnetic and hypnotic
hold on the voters who keep
them in office.
Here’s my challenge.
Look at the list of candi-

Well, it was not until I came
across the segment about
the three dragons -- from
eggs to full grown dragons.
Luckily, my daughter
has it in her hard drive.
Wow, six seasons and 60
episodes, more or less. It
glued me to my bed for
three days. Yes, I look for-
ward to Seasons 7 and 8
which would be available
by next year.
I’ve been watching
street food in different
countries, fishing big and
small, conspiracy theo-
ries, war histories, famous
movie personalities, how
people morphed from rags
to riches, vice versa, how
things are made, mining
and extracting gemstones,
discovering treasures and
just about anything that
interests me. It’s endless.
In the middle of these
all, my phone would ring
and off I go still doing my
chore to eke a living, to be
with friends and to attend
to matters for a cause.
That sums up my life
at this stage. Many things
are slowing me down --
my age, traffic, failure to
do and get something, etc.
There’s one thing that is
very gratifying though.
It is coming home after a
day’s work, and converting
my thoughts into words to
share these with people.
Back to Youtube, the
learning seems endless.
There are lessons that make
you wish you were 20 years
younger and could have
done what you’ve always
wanted to do in life.

wary of candidates who
invest in vote-buying or

It trashes our society’s val-
ues and denigrates our cul-
ture. And it kills the spirit
of statesmanship in poli-
tics. Instead of promoting
integrity and honesty as the

it encourages hypocrisy
and corruption.
It demeans the noble
calling of public service
and cheapens the value of
a career in politics, under-
mining it and weakening
society’s faith in govern-
ment.
Voters should be careful
and be alert to foil corrupt
politics, neutralizing the
perpetrators. Doing so is
the mark of an empowered
citizen. Empowered citi-
zens are what our society
and political system badly
need; citizens who practice
and uphold the ideals of

MILF vows to help ensure peaceful polls on Monday

CAMP DARAPANAN,
Maguindanao — The mil-
itary arm of the Moro Is-
lamic Liberation Front
(MILF) said it will help en-
sure a peaceful and orderly
Barangay and Sangguni-
ang Kabataan elections but
will not actively participate
in the electoral process, an
MILF official said.
Von Al Haq, the spokes-
person of the MILF’s Bang-
samoro Islamic Armed
Forces (BIAF), said the
MILF prohibits its armed
members to get involved in
the country’s electoral pro-
cess as a matter of policy.
“We are not allowed
to directly or indirectly
participate in the electoral
process,” Al Haq said.
He explained that indi-
rect participation includes
acting as security escorts
of candidates, lending fire-
arms and other weapons,
and other acts that would
provide support to any can-
didate and political parties.
Al Haq also said that
the Coordinating Com-
mittee on the Cessation of
Hostilities (CCCH) of both
the MILF and government
has signed a Memorandum
of Understanding (MOU)
last week to maintain the
“peace on the ground”
during the election period.
Under the MOU, both
parties agreed that the po-
lice and military could en-
ter MILF-controlled areas
during the election period
provided that proper coor-
dination is observed.
“We know that they will
enter, pass by, or bring bal-
lots. And that was agreed
on by both parties. We do
not see it as a problem,”
Al Haq said in a statement.
“BIAF would provide
help to the AFP and PNP
only if required,” he said.
The guidelines of the
barangay election agree-
ment between the govern-
ment and MILF include
mechanisms on the mobil-
ity of people and forces.
“The main routes, wa-
ter, and land usually used
by the MILF troops during
movements and activities
shall be left open. Provid-
ed, however, that MILF
movements are properly
coordinated earlier with the
GPH CCCH and the exist-
ing ceasefire mechanisms,”
the MOU stated.
The MOU also said that
MILF “shall refrain from
consolidating its forces
for any purpose including
peace gatherings from the
time the election para-
phernalia are deployed
until the election has been
completed except at Camp
Darapanan in Sultan Kuda-
rat, Maguindanao, Camp
Bushra in Lanao del Sur,
and in urban centers, when
necessary, and in coordina-
tion with the GPH CCCH.”

to file their answers to the Complaint within sixty (60) days from date of last publication of this summons and complaint,

COMPLAINTS
Plaintiffs, through the undersigned counsel unto this Honorable Court respectfully allege that;
1. That they plaintiffs are the owner of a certain parcel of land located in Man-asog, Barangay Pilaring, Pilar, Surigao
del Norte more particularly described as follows;
Under Tax Declaratio1n Numbers 08-16-0400578 a parcel of coconut land situated at
Man-asog, Barangay Pilaring, Pilar, Surigaodel Norte bounded on the North by Pedro
Espanola, South by Rosario Antipasado, East by InocencioSumando, West by Epimaco
Espanola. Declared for tax purposes in the name of SalcedaTesado, with an assessed
value of P 21,600.00, marked as Annex 1 and made an integral part of this complaint.
2. That plaintiffs are all of legal age and resident of the United State of America except for CriseforoTesado Literato
who reside in Barangay Pilaring, Pilar, Surigaodel Norte wherein all notices of this court for the United State of America
resident shall be serve to the undersigned counsel.
3. That all defendants are all of legal age and resident of Barangay Caridad, Pilar, Surigaodel Norte where they can
be served with summons and all court notices.
4. That sometime in 2005 while the plaintiffs is out of the country except for CriseforoTesado Literato and taking
advantages thereat, defendants by means of stealth, forced and intimidation have it surveyed without the knowledge of
the adjoining owners and the plaintiffs.
5. That it came to our knowledge that our property was already fenced and defendants took possession over the 3,793
square metersof our land and then constructed fenced on the portion encroached this May 2017.
6. That defendants purposely and maliciously built a concrete fenced in the eastern portion encroaching an area of
3,793 square meters of the subject property.
7. That the fenced of the defendants deprive and limits the exercise of property ownership of property ownership of
the plaintiffs including collecting and harvesting of the fruits of the coconut tree for copra purposes on the encroached area.
8. That we were in possession of the said encroached land from the death of our mother until it came to our knowledge
that the defendants built fenced.
9. That due to the malicious action of the defendants, plaintiffs compelled to hire a lawyer to protect our right and
incurred expenses in the amount of P30,000.00 plus P5,000.00 per appearance.
10. That the malicious action of the defendants render the plaintiffs to suffer mental anguish, sleepless nights and
wounded feelings that when converted to monetary consideration would be in the amount of P500,000.00.
PRAYER
It is respectfully prayed that;
1. Ordering the defendants to turn over the possession of the encroached property to the plaintiffs with a total area
of 3,793 square meters;
2. Ordering the defendants to remove all the improvements they introduce to the land at their own expense;
3. Ordering the defendants to pay the amount of P500,000.00 as damages to the plaintiffs;
4. And such other damages as maybe proven in court during trial.
Such other relief/s which is just and equitable is likewise prayed for.
