Summary:
On February 10, 2015, Sergeant Ann Hinton received a call from Da'Vetta Flowers regarding her daughter,
Millicent McClinton (DOB: 02/04/1990). Ms. Flowers stated that her daughter was touched inappropriately
by an officer and the same officer began sending text messages to her cell phone number which he obtained
during the investigation of a police incident. Ms. Flowers was advised that investigators would need to
speak to Ms. McClinton; however, Ms. Flowers forwarded the text messages that were sent to Ms.
McClinton to Sergeant Hinton. Sergeant Hinton identified the phone number that was provided by Ms.
Flowers as Officer Jason Butler's.
On February 11, 2015, Ms. McClinton contacted Sergeant Hinton and stated that on Friday, February 6,
2013, at approximately 2:00 a.m., she was in an unknown area of southwest Little Rock with a male. Ms.
McClinton stated the male fled from the police in her vehicle and that once the vehicle stopped she was
searched twice by a black male officers and touched inappropriately in the crotch area. Ms. McClinton
stated after the incident, she began receiving text messages from the officer. Ms. McClinton failed to appear
for her scheduled Internal Affairs Interview on February 12, 2015.

On February 20, 2015, Assistant Chief Hayward Finks authorized a Criminal and Internal Investigation
concerning Ms. McClinton' s allegations.
During the Internal Investigation, the MVR of the incident confirmed Officer Butler as the officer involved
in the complaint. A police incident report detailing the circumstances of the stop was not found to have
been completed.
On March 4, 2015, Sergeant JC White was assigned to conduct a criminal investigation into the allegations
made against Officer Butler. Sergeant White advised that on the same date he made contact with Ms.
McClinton via phone. Sergeant White stated that Ms. McClinton told him that she had been out with friends
and had let an unknown friend drive her car. Ms. McClinton further stated that they had left a club and
drove to an unknown location where they were encountered by officers. According to McClinton, officers
were at the location investigating an earlier domestic incident, involving the driver of her vehicle. Ms.
McClinton told Sergeant White that one of the officers searched her initially then came back and searched
her again. Ms. McClinton stated the officer ran his hands over her vaginal area and she felt this was
inappropriate. Ms. McClinton further stated that a few days later the officer began sending text messages
to her phone at which time she asked him about touching her inappropriately. Ms. McClinton initially
advised that she wanted the incident investigated to keep this from happening to anyone else. Ms.
McClinton agreed to provide a statement in reference to the criminal investigation on March 9, 2015, but
did not show up for her scheduled appointment. Sergeant White also asked Ms. McClinton to keep the text
messages that the officer had sent her and to forward them to him. Ms. McClinton did not supply Sergeant
White with any text messages involving this incident. Numerous attempts were made by Sergeant White
to reschedule Ms. McClinton's interview with negative results. Sergeant White also sent a certified letter
to the address that was provided to him by Ms. McClinton, which was returned undelivered.
On April 16, 2015, Sergeant White made contact with Ms. McClinton's mother, Davetta Flowers. Mrs.
Flowers advised that she would have Ms. McClinton call Sergeant White to reschedule her interview.
Sergeant White also sent another certified letter to Ms. McClinton with an address that was provided by
Mrs. Flowers. Sergeant White stated that both Mrs. Flowers and Ms. McClinton were provided with his
contact information; however, the second letter was also returned and Ms. McClinton did not contact him.
Sergeant White reviewed Officer Butler's MVR video, which showed him escorting Ms. McClinton from
her vehicle to the back of his patrol vehicle where they were out of camera view. The video revealed that
as Officer Butler was escorting Ms. McClinton to his patrol vehicle that she was unsteady on her feet. The
audio revealed that Officer Butler asks Ms. McClinton to place her hands on the car where he searches her
and placed her in the backseat of his patrol vehicle. Officer Butler leaves Ms. McClinton in the back seat
of his patrol vehicle until he returns a short time later and tells her that her vehicle smells like drugs. Ms.
McClinton admits to Officer Butler that she smoked weed earlier, at which time Officer Butler asks her if
she had anything on her. Officer Butler then asks Ms. McClinton to step out of the patrol vehicle at which
time he searches her again. It is at this point that the audio revealed Ms. McClinton ask Officer Butler if
he is supposed to be touching her right there. Officer Butler responds that he is to search her everywhere
and then placed her back in his patrol vehicle.
The Major Crimes Division conducted their investigation and determined that no criminal act was
committed and recommended this investigation be terminated.
On May 20, 2015 Assistant Chief Hayward Finks authorized no further on the criminal investigation unless
Ms. McClinton cooperated.

On July 2, 2015, Officer Jason Butler was interviewed by Internal Affairs Investigators. Officer Butler
stated he met and became attracted to Ms. McClinton when he responded to a call on February 7, 2015 .
Officer Butler stated Ms. McClinton was a passenger in a vehicle, driven by Mr. Mixon, and that she was
searched and placed in the backseat of his patrol unit. Officer Butler stated the vehicle and Ms. McClinton
had an odor of marijuana and that he searched her again after she admitted she had been smoking marijuana
earlier that night. Officer Butler stated after Ms. McClinton was release from temporary custody, he asked
her if she dated "cops" and if it would be alright to call her.
KEATHLEY: When you said that you started talking to Ms. McClinton on the call and you asked
her if she had a boyfriend, and if it would be okay to call her and if she like cops
or dated cops, what was your reasoning for doing that?
KEATHLEY: And we are talking about the same individual that's smelled like weed and admitted
that she was smoking weed?
Officer Butler supplied telephone records documenting the telephone calls between him and Ms. McClinton
and admitted to calling and texting Ms. McClinton, February 7th and 8th, 2015; however, he stated all
communication between them stopped after she told him not to text her further on February 8, 2015. Officer
Butler admitted that the text messages supplied by Ms. Flowers were text message conversations between
him and Ms. McClinton. Officer Butler stated that he did not inappropriately touch Ms. McClinton during
the two searches and he advised that he should have used better judgment and kept his personal and
professional life separate.

MEMORANDUM
On February 10, 2015, I received a call from Da'Vetta Flowers regarding her daughter Millicent
McClinton, DOB 02/04/1990. Ms. Flowers stated that her daughter was touched inappropriately
by an officer and the officer was texting her. Ms. Flowers wanted to know the process of filing a
complaint against the officer. I advised Ms. Flowers that Millicent would have to file the
complaint if she believed the officer did anything wrong. Ms. Flowers forwarded the text
messages to me that were sent to Millicent McClinton.
On February 11, 2015, I was contacted by Millicent McClinton who advised that around 0200
hours on Friday, February 6, 2015, she was unsure of her location but was somewhere near
Baseline Road at a residence when police officers arrived. She said the male subject she was
with ran from the scene and was arrested by the police. She said a black officer asked for her
information and searched her twice. She said that while being searched she was touched
inappropriately in the crotch area. She said after the search she began receiving text messages
from the officer. She said she has not had any previous contact with the officer.
The phone number attached to the text returned to Officer Jason Butler who is
assigned to the 2300-0700 Southwest Field Services Division. The text also list Officer Butler's
address as being . The Southwest Division 2300-0700 Scope lists Officer

On Thursday, February 12, 2015, at 1000 hours, Millicent McClinton was scheduled for an
interview with Internal Affairs but did not show up. I informed Lieutenant Cook of the complaint
and she contacted Chief Hayward Finks and Captain Alice Fulk. Captain Fulk advised she would
have an investigator attempt to contact Ms. McClinton to determine if a Criminal Investigation is
warranted. I recommend an Internal Affairs Investigation.

On this date I received an email from Captain Fulk about the citizen complaint in regards to
Officer Jason Butler. At approximatley 1200 hours I made contact with the complaintant
Millicent McClinton and inquired about the memo that I had received. Ms. McClinton advised
that she had been out with friends and had let an unknown friend drive her car where she was the
passenger from the club to an unknown location where they were encountered by officers.
According to McClinton, Officers were at the location for a domestic issue and as a result an
unknown male subject had involved them into the incident. Upon contact with Officers she
advised that one of the Officers searched her and put her in the back of a patrol car. A short time
later the officer came back from to her and told her that he needed to search her again because
they had smelled marijuana in her vehicle. The officer again searched her again. She stated that
the Officer touched her vaginal area through her clothing both times and that she felt it was
wrong. She stated a few days later the officer began texting her and she asked him about
touching her vaginal area.
Mcclinton advised that she wanted the incident investigated because not necessarily for her
benefit but to keep this from happening to any one else. McClinton agreed to a interview on
March 9, 2015 at 1000 hours. She was also advised to keep her text messages from the officer.
McClinton could provide no specific information about the incident location other then it
happened in SWLR.

further details about the incident in hopes of locating a report. She advised that she could not. I
also requested that she send me the text exchange between her and the officer. I gave her my
number and she advised that she would.

she advised that one of the Officers (Butler) searched her and put her in the back of a patrol car.
During the search the Officer ran his hands over her body, including her vaginal area. She
indicated that this was through her clothing. A short time later the officer came back to her and
told her that he needed to search her again because -they had smelled marijuana in her vehicle.
The officer again searched her. She stated that the Officer touched her vaginal area through her
clothing again and she felt it was wrong. She stated a few days later the officer began texting her
and she asked him about touching her vaginal area. Mcclinton advised that she wanted the
incident investigated not necessarily for her benefit but to keep this sort of thing from happening
to anyone else. McClinton agreed to an interview on March 9, 2015 at 1000 hours. She was also
advised to keep text messages she received from the officer. McClinton could provide no
specific information about the incident location other then it happened in SWLR.
On March 6, 2015 I spoke with Ms. McClinton who advised that she could provide no further
details about the incident in helping me locate that location in which it occurred. I advised her to
text me the emails she had saved to my work cell so I could go ahead and print them off. She
advised okay.
On March 8, 2015 I text Ms. McClinton to inquire about the text messages. I received no
response.
On March 9, 2015 McClinton did not show up for her interview. I made two attempts to call Ms.
McClinton and left voice messages for her after receiving no answer. I prepared a letter for Ms.
McClinton to contact me so we could reschedule the interview. The letter was put in the mail on
March 10. At the time of this report I have received no response from Ms. McClinton.

72209. I have yet to receive any correspondence from Ms. McClinton in regards to her complaint

MEMORANDUM
On this date I received the certified letter back that was mailed to Millicent McClinton
undelivered. I then made contact with Sgt. Hinton this morning and advised if she had a better
address for McClinton. She advised that she would find out and call me back.
At 1240 hours Sgt.Hinton called me back and advised that she had spoken to Davetta Flowers
who is the mother of McClinton. She also provided a phone number for Mrs. Flowers and
address for McClinton. I asked if Mrs. Flowers would speak to me and Sgt. Hinton advised that
she would speak with me.
At 1250 hours I made contact with Mrs. Flowers and introduced myself and the reason for the
call. I also informed her that her daughter had missed the interview and would not return my
calls. I informed her that I had also sent a letter to the address the Millicent had provided. She
advised that she did not know anyone at that location and did not know why Millicent would give
me that address. Mrs. Flowers further advised me that Millicent was scared of the police but that
she would talk with her tonight and call me back with an appointment for an interview.

On March 4, 2015 I was assigned the complaint against Officer Jason Butler in which he was to
have allegedly inappropriately touched the complainant Millicent McClinton. I made contact
with McClinton on the same day and via phone conversation she advised that she had been out
with friends and had let an unknown friend drive her car where she was the passenger. They had
left the club and driven to an unknown location where they were encountered by officers.
According to McClinton, Officers were at the location for a domestic issue and as a result an
unknown male subject had involved them into the incident. Upon contact with Officers, one of
the Officers searched her initially then came back again and searched her again running his hands
over her vaginal area again. McClinton advised that she felt this was inappropriate. She stated
that a few days later the officer began texting her phone at which time she asked him about
running his hands over her vaginal area.
McClinton initially advised that she wanted the incident investigated to keep this from happening
to anyone else. She agreed to an interview on March 9, 2015, but never showed up for her
scheduled time. She was also advised to keep the text messages that the officer had sent on her
phone and to also forward them to me in which she never did. McClinton has refused to return
my phone calls on numerous occasions in an attempt to reschedule an appointment. McClinton
initially gave me her address of #4 South Wakefield Dr., LR AR 72209. A certified letter was
sent to this location but was returned 1 ½ weeks later undelivered.
On April 16, 2015 I made contact with Davetta Flowers who is the mother of McClinton. Mrs.
Flowers advised that she would talk to McClinton when she returned home and would call me
back to reschedule her interview. She also gave me the correct address for McClinton as 2109
Brown Street, LR, AR 72204. Another certified letter was also sent to this address and has yet
to be returned. As of the date of this memo I have yet to receive a call from Mrs. Flowers or

McClinton in regards to the investigation. Both McClinton and her mother Mrs. Flowers were
provided with my contact information.
Officer Butler's MVR video shows him escorting McClinton out of the front passenger seat of
her vehicle and walking her back to his patrol car where they are out of camera view. While
walking back to Officer Butler's vehicle you can see that McClinton is unsteady on her feet. You
can hear Officer Butler ask McClinton to place her hands on the car where he searches her and
places her in the backseat of the patrol car. Officer Butler leaves her alone in the back of the
patrol car until he returns a couple of minutes later and tells her that her car smells like drugs.
McClinton admits to smoking earlier at which time Officer Butler ask her if she has anything on
her. Officer Butler asks McClinton to step out of the vehicle at which time he searches her again.
It is at this point that McClinton ask Officer Butler if he is supposed to be touching her right
there . Officer Butler responds that he is to search her everywhere. Officer Butler places her back
in the vehicle and turns the heater on due to her complaining of being cold. There are no more
searches of McClinton.
In reviewing the video it does not appear that Officer Butler had done any act that could be taken
as criminal act towards Ms. McClinton. This along with the lack of cooperation from
McClinton, it is my recommendation that the investigation into this allegation be terminated at
this time.

individual.

On June 9, 2015, at 1500 hours, I spoke with Ms. Da'Vetta Flowers, the Mother of Millicent
McClinton. Ms. Flowers stated that Millicent was afraid to give a statement regarding the
incident with Officer Jason Butler. I advised Ms. Flowers that we are not located within the
police department and Millicent would be safe giving a statement. Ms. Flowers said that she
would speak with Millicent again about making a statement. Ms. Flowers also stated that she is
possibly going to file a lawsuit against the Little Rock Police Department regarding the actions
of Officer Butler. Ms. Flowers said she would contact me after speaking with Millicent. As of
June 16, 2015, I have not received a call from Ms. Flowers.

NARRATIVE
I RESPONDED TO 9601 BAPTIST HEALTH DRIVE TO TAKE AN ASSAULT REPORT AT ROOM #21. ON ARRIVAL, CONTACT
WAS ESTABLISHED WITH PEOPLES. SHE SAID HER BOYFRIEND, MIXON, HAD JUMPED ON HER BECAUSE SHE HAD
TOLD HIM TO GET OUT OF HER HOUSE AFTER HE STARTED DISRESPECTING HER. MIXON PUNCHED PEOPLES
REPEATEDLY ON HER FACE AND ALL OVER HER BODY. I OBSERVED SWELLING TO THE LEFT SIDE OF PEOPLES FACE
AND EAR. SCRATCH MARKS TO THE RIGHT SIDE OF HER NECK. SHE HAD SWELLING TO HER LEFT HAND. SHE ALSO
HAD RED SCRATCH MARKS ON HER BACK ACCOMPANIED BY SWELLING. PEOPLES SAID SHE WAS 5 MONTHS
PREGNANT. MIXON KNEW SHE WAS PREGNANT. HE HAD ACCOMPANIED HER TO DOCTORS CHECK UPS FOR THE
BABY. PEOPLES ADVISED MIXON MAY HAVE WENT TO THE RESIDENCE OF HIS MOTHER AT#4 S WAKEFIELD DRIVE.
OFFICERS WERE ABLE TO MAKE CONTACT WITH MIXON AT SAID ADDRESS AND TAKE HIM INTO CUSTODY WITHOUT
INCIDENT. HE WAS TRANSPORTED TO THE NORTHWEST SUBSTATION FOR INTERVIEWING. MIXON GAVE A
STATEMENT. HE WAS TRANSPORTED TO PCRJ AND BOOKED IN ON DOMESTIC BATTERY 3RD (ENHANCED D FELONY).
STATEMENTS WERE TAKEN FROM PEOPLES AT BAPTIST ER. ACCORDING TO HOSPITAL STAFF, PEOPLES AS WELL AS
THE BABY WERE OKAY WITH PEOPLES HAVING MINOR APPARENT INJURY. SGT. GRISBY WAS ADVISED OF THE
INCIDENT. VEHICLE 13C282 MVR IN USE.

3 His house is right here, second house from the right, he was backed
4 into the driveway, we pulled up and they're sitting -he's sitting in
5 the driver's seat and two females in the car. I go to make contact
6 with him, I said hey man roll the window down and he cracked it
7 and I said man open the door. He was like why, because I need to
8 talk to you and I need your ID and that's when he- I said man don't
9 start the car because he put his hands on the shift and man I already
10 know what's about to happen so he -he run there when we run
11 back to our car that's what I got on the radio and by the time I
12 started the recorder he had already parked and he took off running
13 and I didn't even see him. Wasn't even close enough but-
14 THREADGILL: Okay where- where was he, over there to where?
15 To right there, see that silver car in front of my car.
16 THREADGILL: Okay.
17 But I thought he was gonna go, that's why I called it like I did, but
18 he's wanted for -he's got felony charges, he beat up his pregnant
19 girlfriend Northwest and then he's got a parole hold parole
20 absconder warrant so I guess he foot bailed and went back to his
21 house and he was gonna run again, but he ran out the back door
22 and met the dog.
23 THREADGILL: So-
24 And ran back in, so (inaudible) sit there and I'm gonna charge him
25 with (inaudible) fleeing (inaudible) I mean are we gonna do a
26 pursuit file or anything like that?
27 THREADGILL: No I'm not trying to.
28 Then I won't charge him with it.

OFFICER'S REPORT
Sir,
On 02/07/2015. Officer J. Butler (3X93/14C309) and I (3X81/12C253) were dispatched to 4 South Wakefield
Drive in reference to making contact with Clarence Mixon (8/M DOB: 01/31/1986) who was wanted for Domestic
Batterv 3 rd - Felonv for an incident that occurred in the Northwest Division. Upon arrival. I observed a silver 2013 Nissan
Altima displaying Arkansas License Plate. 213WNF backed in the drivewav of 4 South Wakefield Drive. I observed the
vehicle was occupied by a black male driver, later identified as Mr. Mixon and two black female passengers later
identified as Millicent McClinton (B/F DOB: 02/04/1990) and Jennifer Marks (B/F DOB: 07/09/1991). As I approached
the vehicle. r asked Mr. Mixon to roll the window down and give me his identification. Mr. Mixon cracked the window
and then I asked him to open the door. He started to hesitate so I tried to open the door but it was locked. Mr. Mixon then
placed his hand on the gear shifter and I advised him to turn the car off. Mr. Mixon put the vehicle in drive and pulled out
of the driveway. I ran back to mv vehicle and activated my emergency equipment to catch up to the vehicle. I advised
main channel of the vehicle trving to get away from me. As I was making the curve on from South Wakefield onto East
Wakefield I did not observe any taillights in front of me. I looked down Winchester Drive and observe the vehicle was
stopped in the middle of the roadway. I stopped and conducted a felonv stop on the vehicle and found Mr. Mixon had fled
the vehicle prior to me observing the vehicle stop in the roadwav. I made contact with the female passeneers who stated
Mr. Mixon fled the vehicle on foot south back towards his residence. The backseat passenger, Ms. Marks stated when Mr.
Marks turned onto Winchester Drive: she was flung into the door due to her not wearing a seatbelt. MEMS responded to
check out Ms. Marks but she refused to be transpo1ted. Due to Mr. Mixon fleeing on foot. I requested a K9 responded to
assist in tracking him. Officer Harrington (K47) responded and began a track with her K9 pa1tner towards Mr. Mixon ' s
residence. When additional officers arrived. Officer Harrington stood bv at the backcloor while other officers knocked on
the front door. Mr. Mixon ' s mother opened the door and allowed us inside statin!!. he was inside. At that time. Mr. Mixon
tried to exit the rear door but when he observed Officer Harrington and her partner. he went to the front of the house
where he was placed into custodv. I transported Mr. Mixon to the Northwest Detective Division \Vhere he was turned over
to Officer Monroe (3X64).

3 I'm Sergeant Vicky Keathley, also present is Sergeant Rusty
4 Rothwell, this interview is with Officer - - Today's date is July the
5 2 nd , 2015 , and the time is 10:35 p.m. , we're cmTently at the Internal Affairs Office and
6 this is in reference to Internal Affairs case CC2015-00011 . Officer - are you
7 aware this interview is an internal administrative investigation and is being recorded and
8 will be treated as an official police repmi?
9 Yes ma'am.
10 KEATHLEY: Employees are required to be honest and truthful in all matters
11 related to their scope of employment and the operations of the
12 department. Untruthfulness is defined as intentionally making a
13 false, misleading or untrue statement. This requirement applies to
14 all oral statements and written statements. Written statements
15 include, but are not limited to, repo1ts of ai1y type, and any form of
16 electronic communications. Untruthfulness is a severe violation
17 which is strictly prohibited and may result in discipline up to and
18 including termination. Officer - this is in reference to a
19 call you received as a primai·y unit on February the 7th, 2015 , at
20 0528 hours . The incident address was #4 Wakefield Drive and the
21 incident was regarding an attempt to make contact with a suspect
22 who was involved in an earlier assault on Officer Morris,
23 3XRA Y64 ' s district. Can you start at the beginning and tell us
24 what happened that night?
25 On February the 7 th Officer Jason Butler and I responded to #4
26 South Wakefield in reference to making contact with Clarence
27 Mixon, a black male who was wanted for domestic battery 3rd
28 degree felony enhanced for an incident that occurred at the
29 Northwest Division. Officer Monroe was dispatched to Baptist
30 Hospital and asked that we go make contact with the suspect.
1 Upon arrival I observed a silver 2013 Nissan Altima displaying
2 Arkansas license 213WILLIAMNORTHFRANK, backed into the

..) driveway of 4 South Wakefield. I observed the vehicle was
4 occupied by a black male driver later identified as Mr. Mixon and
5 two black female passengers later identified as Ms. McClinton and
6 Ms . Marks. As I approached the vehicle Mr. Mixon rolled the
7 window down - I asked him to roll the window down and give me
8 his identification, he cracked the window and asked - and then I
9 asked him to open the door. He stated - he started to hesitate so I
10 tried to open the door, but_it was locked, he then put his hand on
11 the gear shift and I advised him to turn the car off. I thought that
12 he was about to flee, you could tell he was hesitative and didn' t
13 want to answer any questions. Mr. Mixon put the vehicle in drive
14 and pulled out of the driveway, I ran back to my vehicle and
15 activated my emergency equipment to catch up to the vehicle due
16 to the think - my thought that he was fleeing and I was about to be
17 in a vehicle pursuit. I also advised main channel of the situation.
18 As I was making the turn onto South Wakefield - or onto East
19 Wakefield from South Wakefield - the residence is at the corner, I
20 did not observe any tail lights in front of me, I started looking
21 down the cross streets that co1mect and I observed the vehicle on
22 Winchester Drive. I stopped behind the vehicle and conducted a
23 felony stop and found Mr. Mixon had exited the vehicle prior to
24 me stopping it or pulling behind it. I made contact with the female
25 passengers who stated Mr. Mixon fled the vehicle south back
26 towards his residence. The backseat passenger I believe its Ms.
27 Marks, stated when Mr. Mixon turned onto Wakefield she was
28 flung against the door due to not wearing a seatbelt. MEMS
29 responded to check her out but she refused transport. Due to Mr.
30 Mixon fleeing on foot I requested a K-9 to respond, Officer
31 Harrington responded and began to track with her K-9 partner back

1 towards Mr. Mixon' s residence. When additional officers arrived,
2 Officer Harrington stood at the back door while officers made
3 contact - knocked on the front door, Mr. Mixon' s mother opened
4 the door and allowed us to enter, stating he was inside. At that
5 time Mr. Mixon tried to exit the rear door, but observed Officer
6 Harrington and her partner, then he went to the front door where he
7 was placed into custody. I transpo1ied Mr. Mixon to the No1ihwest
8 Detective Division where he was turned over to Officer Monroe.
9 KEATHLEY: Did you write an incident report documenting the details of this
10 incident?
11 I wrote an Officer' s letter for the domestic felony file.
12 KEATHLEY: Did you write an incident rep01i documenting the -
13 No ma'am.
14 KEATHLEY: details of this incident?
15 No ma'am.
16 KEATHLEY: Why not?
17 I spoke - since I spoke to Officer - or Sergeant Threadgill who
18 came out there, he stated that since we didn't flee behind - get
19 behind and flee that we weren ' t gonna charge anybody with fleeing
20 or do a pursuit file and just to write an Officer' s letter and attach it
21 to the domestic file.
22 KEATHLEY: Did you and Officer Butler have an individual that fled from you?
23 Yes.
24 KEATHLEY: Did you and Officer Butler take any individuals into limited or
25 temporary custody or detain anyone for information or
26 investigative purposes?
27 Yes .
28 KEATHLEY: Did someone complain about being injured during this incident?
29 Yes.
30 KEATHLEY: Were these due to Mr. Mixon' s actions?

1 KEATHLEY: And did you call MEMS?
2 Yes.
3 KEATHLEY: Did you call a K-9 Unit?
4 Yes.
5 KEATHLEY: What did the females tell you about Mr. Mixon?
6 That he fled back towards his residence.
7 KEATHLEY: Did the females make statements about how long they were with
8 Mr. Mixon?
9 They stated they had- were with him earlier that night, I don' t
10 recall how long, it's been five months.
11 KEATHLEY: Did they tell you how they met up with him?
12 I believe they did but I don't recall what they said.
13 KEATHLEY: He was accused of physically assaulting his girlfriend around three
14 that morning-
15 Uh huh.
16 KEATHLEY: and in his statement he said he was at his mother's residence
17 during that time, were you able to verify the details of the
18 statement?
19 No ma'am.
20 KEATHLEY: Do you feel as if the female's statements could have had been
21 helpful?
22 Regarding what?
23 KEATHLEY: About-
24 The domestic?
25 KEATHLEY: where he was?
26 Yes ma'am, I suppose.
27 KEATHLEY: It would have given him alibi or maybe determine that he wasn't
28 with them during the time that he was supposedly hitting his
29 girlfriend. Would you agree?
30 Yes ma'am.

1 KEATHLEY: Do you feel like that's something you should have documented in a
2 police report, everything that happened that night?
3 I - regards to my contact with him, that's what I documented in the
4 Officer' s letter, I don't have any details to anything involving the
5 domestic end paii of it.
6 KEATHLEY: I'm not talking about the domestic, I'm talking about the incident
7 that occurred when you made contact with Mr. Mixon, Ms.
8 McClinton and Ms. Mai·ks, were they fled in a vehicle and then
9 you made contact with them, took them into custody and called a
10 K-9, I'm talking about all of those details?
11 Yes ma'am.
12 KEATHLEY: Do you believe that would be something you would wai1t to
13 document?
14 I did document it in an Officer's letter.
15 KEATHLEY: Did you document it in a police incident report?
16 No ma'am.
17 KEATHLEY: What happened to the vehicle that night?
18 It was returned back over to the owner who was one of the
19 females.
20 KEATHLEY: Who owned it?
21 I don't recall which vehicle- which female .
22 KEATHLEY: Why did you call MEMS for one of the females?
23 She said whenever Mr. Mixon turned that- that she got slung across
24 the vehicle.
25 KEATHLEY: Did you refer to her as being intoxicated?
26 Yes I believe so.
27 KEATHLEY: Is she the one that drove off?
28 No ma'am.
29 KEATHLEY: Did you have any contact with the one that did drive off?
30 Limited contact, Officer Butler had the contact with her.
31 KEATHLEY: Did Officer Butler tell you that he smelled weed in the car?

7 pursuit file and he was pretty much charging him with and take
8 him to Northwest and drop him off for the domestic.
9 ROTHWELL: You would agree that you could have charged this gentleman with
10 fleeing without doing a pursuit file?
11 Yes.
12 ROTHWELL: I think you said Ms. Marks required MEMS attention?
13 Uh huh.
14 ROTHWELL: Did she go with them?
15 No she refused to be transp01ied.
16 ROTHWELL: Was there anything wrong with her that you could see?

18 ROTHWELL: But you know she's not the one that drove away that night, it was
19 Ms. McClinton?
20 That's what I recall. (Inaudible) I wouldn't let an intoxicated

24 be important to this investigation?

29 residence and that's based on something that a Northwest guard -
30 there was an incident number created for you guys gomg over
31 there, is that right?

4 ROTHWELL: So that- you were primary, right?
5 Yes sir.
6 ROTHWELL: So that would have been in your dropdown box?

10 I don't remember, if I did then I just filled it- completed an
11 Officer's letter for the totality of making contact with them since it
12 was related to the original domestic, I may have coded it with a
13 supplement. But like I said before all- before we left the scene
14 Sergeant Threadgill responded and I advised him of everything and
15 that's what I was told to do which should be on the MVR.
16 KEATHLEY: Anything else?
17 ROTHWELL: That's all I've got.

OFFICER'S REPORT
Sir,
On Saturday, February 7, 2015 at approximately 0528 hours, I (3X93) was operating
vehicle 14C309. I responded to 4 South Wakefield Drive in order to make contact with suspect
Clarence Mixon (B/M 01/31/1986). Upon arrival suspect Clarence Mixon (B/M 01/31/1986),
Millicent Mcclinton (B/F 02/04/1990), and Jennifer Marks (B/F 07/09/1991) was in the vehicle
parked in the driveway. After approaching the vehicle and making contact with the subjects, Mr.
Mixon drove off. The vehicle was later stopped on Winchester Drive but Mr. Mixon was no
longer in the vehicle. Ms. Marks and Ms. Mcclinton were .still in the vehicle. I made contact
with Ms. Mcclinton who was in the passenger seat. Ms. Mcclinton advised Mr. Mixon had
jumped out of the vehicle and headed southbound on foot. Ms. Marks advised her neck was
hurting and was checked by MEMS (516). Ms. Mcclinton was put in the back seat of my car
until Mr. Mixon was in custody. Ms. Mcclinton and Ms. Marks were released once M..r. Mixon
was in custody. MVR in use.

3 I'm Sergeant Vicky Keathley, also present is Sergeant Rusty
4 Rothwell, this administrative interview is with Officer Jason Butler and he has his
5 companion officer, Sergeant Troy Ellison present. Today's date is July the 2 nd , 2015, and
6 the time is 9:45 p.m. We're currently at the Internal Affairs Office and this is in
7 reference to Internal Affairs case number 2015-00011. Officer Butler you are being
8 questioned as part of an official Internal Affairs investigation authorized by the Chief of
9 Police. You will be asked questions specifically directed and narrowly related to the
10 performance of your official duties or fitness for office. You are entitled to all the rights
11 and privileges guaranteed by the laws and the Constitution of the State of Arkansas, and
12 the Constitution of the United States, including the right not to be compelled to
13 incriminate yourself. If you refuse to testify or to answer questions relating to the
14 performance of your official duties or fitness for duty, you will be subject to departmental
15 charges which could result in your dismissal from the Police Depaiiment. If you do
16 answer, neither your statements nor any information or evidence which is gained by
17 reason of such statements can be used against you in any subsequent criminal
18 proceedings. However, these statements may be used against you in relation to

22 BUTLER: Yes ma'am.
23 KEATHLEY: Employees are required to be honest ai1d truthful in all matters
24 related to their scope of employment and the operations of the
25 depaiiment. Untruthfulness is defined as intentionally making a
26 false, misleading or untrue statement. This requirement applies to
27 all oral statements and written statements. Written statements
28 include, but are not limited to, reports of any type, and any form of
29 electronic communications. Untruthfulness is a severe violation
1 which is strictly prohibited and may result in discipline up to and

3 BUTLER: Yes ma'am.
4 KEATHLEY: Officer Butler this 1s 111 reference to a call you received as a
5 secondary unit on February the 7th , 2015 , at 0528 hours. The
6 incident address was #4 South Wakefield Drive and the incident
7 was regarding an attempt in making contact with a suspect who
8 was involved in an earlier assault on Officer Morris' 3XRA Y'64 ' s
9 district. Millicent McClinton has made the allegation that you
10 touched her vaginal area twice while frisking her. Start at the
11 beginning and you can tell us how you came in contact with Ms.
12 McClinton and what occurred during the contact.
13 BUTLER: On that day we went to #4 South Wakefield Drive and tried to
14 make contact with Clarence Mixon, we end up making -we end up
15 making contact with Clarence Mixon, but there was two females
16 with him. One was Ms. McClinton and Ms . Jennifer Marks, they
17 were in the vehicle as well, while talking to Clarence Mixon, who
18 was driving in the driver's seat, the vehicle took off and fled from
19 us and he -he cut around the comer and went back up the- like half
20 a block and we ended up following it. By the time we caught up
21 with it the driver suspect was gone, he was no longer in the
22 vehicle, the two females, however, were still in the vehicle so we
23 called for a K-9 unit. A K-9 responded and we searched the
24 vehicle, we got the two females out of the vehicle and searched
25 them, I searched one, I searched McClinton, I only- I only searched
26 McClinton and I put her in the- back of my patrol car. The car
27 smelled like -it smelled like weed so we searched the car as well
28 for drugs. When the K-9 showed up they ended up eventually
29 apprehending the driver suspect, he had ran back to the- to either
30 the house, #4 South Wakefield, or a house next to it, I'm -I can't be
31 sure because I wasn 't with him. I stayed and watched the two

1 females while K-9 chased him, when they apprehended him -let
2 me- let me go back, before they appre-while they were -while K-9

.) was in search for him, I stayed with the two females, I had already
4 searched like I said Ms. McClinton, I put her in the back of my
5 patrol car, she sta1ied talking to me telling me she had -at first she
6 was -you know she had denied any use of drugs, that they hadn' t
7 been smoking or anything like that, but I guess eventually she
8 staiied talking to me more and she told me that they actually had
9 been smoking weed because they were at a- having a paiiy. So
10 that's when I end -I actually seai·ched her twice, I did seai·ch her
11 twice, the second time after she had admitted to smoking some
12 weed I searched her again, she had a - and I searched her for
13 drugs, I still didn't find any, she smelled like it but I didn't find any
14 and that's when I put her back in the patrol car. And then later on
15 that's when they - they end up apprehending the suspect driver, the
16 K-9 Unit and that's pretty much it, that's it.
17 KEATHLEY: Who were you on the call with?
18 BUTLER: It was Officer -
19 KEATHLEY: And I just want to make sure I have it right, did you actually lose
20 sight of the suspect -
21 BUTLER: The driver suspect?
22 KEATHLEY: of the vehicle? Yes.
23 BUTLER: Yes ma'am.
24 KEATHLEY: Okay. Did you ever have contact with the suspect after he fled?
25 BUTLER: I did not, no ma'ain.
26 KEATHLEY: And you had contact with just Ms. McClinton, is that correct?
27 BUTLER: I only searched Ms. McClinton but I had contact with Ms. Marks
28 as well because I was -there was a time when I was having to
29 watch them both while the other units took off after the suspect
30 driver.
31 KEATHLEY: Were they both in your vehicle?

1 BUTLER: No ma'am, the - Officer - had put Ms. Marks in his
2 vehicle first before he -
3 KEATHLEY: Were they-
4 BUTLER: and I was just watching.
5 KEATHLEY: Okay, and were they both in the backseat?
6 BUTLER: I'm not - I'm not -I can't be for sure where - put his
7 suspect, I mean usually we put them in the backseat but I can't be
8 for sure, but mine was in the backseat of my patrol car, his was in
9 his patrol car.
10 KEATHLEY: Did Officer - leave and you were watching both of the
11 females?
12 BUTLER: For a short period ohime I was.
13 KEATHLEY: But you don't know-
14 BUTLER: There was a time-
15 KEATHLEY: where the one female was?
16 BUTLER: She - she -I knew she was in the patrol car but I wasn't -I only
17 knew she was in the back of patrol car.
18 KEATHLEY: Did you or Officer - did either one of you write an
19 incident report about the fleeing subject and the two females you
20 come in contact with?
21 BUTLER: I didn't- I didn't do the report, Officer - did, I just did
22 an Officer's letter.
23 KEATHLEY: Were you the primary or secondary unit?
24 BUTLER: Secondary.
25 KEATHLEY: Do you remember what Ms. McClinton was wearing?
26 BUTLER: She was wearing some tight -they was like leggings and a jacket, a
27 tight, some kind of tight jacket with a shirt with a jacket.
28 KEATHLEY: And after this incident was over did you have further contact with
29 Ms. McClinton?
30 BUTLER: Yes ma'am.
31 KEATHLEY: Tell me about that?

1 BUTLER: Actually let's go back to the scene, when I -while -at the end of -
2 s01Ty, when I was on scene I asked her for a - I asked her did she
3 -once she was found no longer a suspect I asked her if she was -if
4 she had a boyfriend and she - she said no she was single. I asked
5 her if she dates cops, she said I have no problem with cops, so I
6 asked her if it was okay for me to call her and she said yes so I
7 called her.
8 KEATHLEY : So the only contact you had with her was that night, that's the first
9 time you've ever met her, is that correct?
10 BUTLER: Yes ma'am.
11 KEATHLEY : And .then you -did you obtain her phone number or did you give
12 her your phone number?
13 BUTLER: I -because like any call I did have to obtain everybody' s phone
14 number that I came in contact with, but after the fact I still asked
15 her if it was okay for me to call her and she said yes.
16 KEATHLEY: So when did you call her? You supplied some phone records here
17 tonight and if you want to look -use those you can.
18 BUTLER: I - when it says incoming it means that she was calling -that
19 means it's coming to me, right?
20 KEATHLEY: That- that means that you're getting a call.

6 okay to cal her and if she like cops or dated cops, what was your
7 reasoning for doing that?
8 BUTLER: I - she was attractive and I'm single.
9 KEATHLEY: And we are talking about the same individual that's smelled like
10 weed and admitted that she was smoking weed?
11 BUTLER: Yes. Yes ma'am.
12 KEATHLEY: I'm just wanting to make sure. So did you just call her and I - I -
13 like I said I've got your phone records here and I can see calls
14 going in and out between you and Ms. McClinton, did you also
15 text her?

28 KEATHLEY: if you called her at 8 a.m. and you talked for six minutes and then
29 at 8:14 a.m. would that be about right where y'all were texting each

20 feel like it's missing some stuff this -this isn't reading right. "You
21 mad", "Mad at what", she texted back "Mad at what", I texted
22 "That I didn't text you back at first", she texted back "Because you
23 was searching me LOL trying to get a feel", I texted back "I have
24 to search everyone before putting them in the patrol car", this is it,
25 okay (inaudible) I texted "You do have a nice body though" this
26 me, "You do have a nice body though but I wasn't trying to get a
27 feel, what are you doing" and she texted back "At work, and you
28 was trying to get a feel on me LOL, you funny, was all between
29 my legs" I texted back "Why you didn't want to see me alone
30 yesterday" and she texted back "You searched me twice you
31 searched me twice you- and then it stops".

15 KEATHLEY: Do you believe that a Little Rock Police Officer that has gotten out
16 someone that smells like weed, do you believe that that's someone
17 that a Little Rock Officer should try to hook up with?
18 BUTLER: No ma'am.
19 KEATHLEY : Do you know anything about Ms. McClinton's criminal history?
20 BUTLER: She - at the time I didn't, at the- at the time that I -that I had
21 gotten her phone number I did not.

20 ROTHWELL: Okay. When- when we read over those or you read over those, I
21 didn' t notice where you denied touching her, was there a reason?

23 with a "Girl I didn't touch you there, I didn' t do that", you see what

5 ROTHWELL: So in two years you're about at 40,000 plus, is that what you make
6 a year?
7 BUTLER: Yes sir.
8 ROTHWELL: Is hooking up with a hood rat w011h throwing away a job?
9 BUTLER: No sir, it's not.
10 ROTHWELL: I don't have her criminal history but I remember looking at it, she's
11 been arrested for theft of prope11y, kidnapping and aggravated
12 robbery, is that somebody we need to be giving our home address
13 to? And Mr. Mixon, he's got a criminal history longer than your
14 leg for felonies and that's her boyfriend?
15 BUTLER: Yes sir. Looking back on the situation now I -I realize that a lot of
16 stuff should have- should have been a lot differently, I made some
17 mistakes looking back at it (inaudible).
18 ROTHWELL: Is it common practice for you to try to reach out to people you
19 meet on the streets of Southwest Little Rock and try to hook up
20 with them?
21 BUTLER: No sir.
22 ROTHWELL: Is that the first time you ' ve done that?
23 BUTLER: It's the first timeJ've done that, yes sir.

20 I didn't know if she was playing with me or not, but then I mean
21 when she kept going I did start to wonder, I started thinking that
22 she's -she's pretty serious about this, but I -I didn't take it serious
23 enough I guess at first because -they were not true so I -I didn't-
24 I didn't know how to react to that, but going- going back on the
25 part, I mean I - I don't -like I said I don't use -like I don't use the
26 word pussy like that, but I mean there were parts on here where I
27 said I was not trying to get a feel on you, I mean I did say that to
28 her, and that's pretty much what I was saying when I said I didn't -
29 I wasn't trying to get a feel on you, I was telling her that I was not
30 trying to feel your pussy.

1 KEATHLEY: Even after she makes these allegations you still continue to want to
2 talk to her, why?
3 BUTLER: Because she keeps -she keeps sending -well because every time
4 she sent a text she would sent LOL so that's why I -because like I
5 said before, I didn' t know if she was messing with me at first, if
6 this was like her way of flirting at first or what, because all I kept
7 seeing was okay she would say something and then she would say
8 LOL, and I'm like wait a minute, okay, and then she would say
9 something else but then she would say LOL and then she's -you
10 know she would say when, LOL, like yeah I'll come over, LOL, so
11 I - I -I did not know how to react.
12 KEATHLEY: And you said earlier you can see where you're at right now?
13 BUTLER: Yes.
14 KEATHLEY: And what is happened due to her making these allegations?
15 BUTLER: Yes ma'am.
16 KEATHLEY: Now I don' t know if you know this or not, but she has not made a
17 formal complaint, however, due to the seriousness of the
18 allegations, Assistant Chief Finks ordered a criminal investigation
19 as well as an internal investigation which was later ordered by
20 Chief Buckner. Were you aware that there was a criminal
21 investigation on this?
22 BUTLER: I was not aware there was a criminal investigation on that.
23 KEATHLEY: She did not cooperate with the criminal investigation, however,
24 this is the internal investigation and this is your chance to explain
25 why we're all sitting in here in the middle of the night.
26 BUTLER: Because I -I made mistakes and I have stuff that happened that
27 night and the following morning shouldn't have happened, I
28 shouldn't- I shouldn't ask- I should have never asked for a
29 female's phone number or anybody's phone number that was
30 involved in an incident with to begin with even if she was -
31 whether or not she was found guilty or not, a suspect or not, she

1 was involved in an incident and I shouldn't have- I shouldn't have
2 reached out. I should have kept working, my personal life kept
3 separate, I made a lot of mistakes but I did not search in that area
4 though. In the area that she described, I did not touch her in the
5 area that she described though. I did not touch her in that area.

7 ROTHWELL: Do you have a worksheet from that night? When you get her out
8 of the car or I guess - gets Ms. Marks and you get Ms.

18 earlier that night and you made the decision that she needed to be
19 patted down again, could you have started a female officer over
20 there to do that?

23 ce11ainly know Robin Marquez who was working Yow1g 82 that
24 night, you could have staited her to come over there and pat her
25 down, correct?

27 ROTHWELL: Is that a decision that you think you could probably make in the
28 future that may keep you from catching one of these complaints in
29 the future?

3 off, her and the other- I don't know which one drove, but they both

7 BUTLER: I - I was secondary so I -I just -they had apprehended the suspect
8 and the next thing I know they (inaudible).

20 they go a mile down the road and 9 out and T-bone somebody, do
21 you think that that family is gonna sue you or they're gonna sue
22 Ms. McClinton?

NARRATIVE
I RESPONDED TO 9601 BAPTIST HEALTH DRIVE TO TAKE AN ASSAULT REPORT AT ROOM #21. ON ARRIVAL, CONTACT
WAS ESTABLISHED WITH PEOPLES. SHE SAID HER BOYFRIEND, MIXON, HAD JUMPED ON HER BECAUSE SHE HAD
TOLD HIM TO GET OUT OF HER HOUSE AFTER HE STARTED DISRESPECTING HER. MIXON PUNCHED PEOPLES
REPEATEDLY ON HER FACE AND ALL OVER HER BODY. I OBSERVED SWELLING TO THE LEFT SIDE OF PEOPLES FACE
AND EAR. SCRATCH MARKS TO THE RIGHT SIDE OF HER NECK. SHE HAD SWELLING TO HER LEFT HAND. SHE ALSO
HAD RED SCRATCH MARKS ON HER BACK ACCOMPANIED BY SWELLING. PEOPLES SAID SHE WAS 5 MONTHS
PREGNANT. MIXON KNEW SHE WAS PREGNANT. HE HAD ACCOMPANIED HER TO DOCTORS CHECK UPS FOR THE .
BABY. PEOPLES ADVISED MIXON MAY HAVE WENT TO THE RESIDENCE OF HIS MOTHER AT #4 S WAKEFIELD DRIVE.
OFFICERS WERE ABLE TO MAKE CONTACT WITH MIXON AT SAID ADDRESS AND TAKE HIM INTO CUSTODY WITHOUT
INCIDENT. HE WAS TRANSPORTED TO THE NORTHWEST SUBSTATION FOR INTERVIEWING. MIXON GAVE A
STATEMENT. HE WAS TRANSPORTED TO PCRJ AND BOOKED IN ON DOMESTIC BATTERY 3RD (ENHANCED D FELONY).
STATEMENTS WERE TAKEN FROM PEOPLES AT BAPTIST ER. ACCORDING TO HOSPITAL STAFF, PEOPLES AS WELL AS

OFFICER'S REPORT
Sir,
On listed date, I was working 3X64 and driving vehicle 13C282. My vehicle had
functioning MVR.
At approximately 0440 hours, I was dispatched to 9601 Baptist Health Drive to take
an Assault Report. On my arrival, contact was established with Breanna Peoples (B/F,
02/17/1993) she said her boyfriend, a Clarence Mixon (B/M, 01/31/1986), had jumped on
her and started kicking and punching her all over her body. This was due to her telling him
to get out of her house for him being disrespectful to her.
Peoples had apparent swelling to the left side of her face as well as swelling to her
left ear. She had scrape marks on the right side of her neck, scrape marks to her back,
along with swelling. She also had swelling to her left shoulder and left hand. According to
Peoples, she was 5 months pregnant. Mixon knew she was pregnant and had gone to several
doctor's appointments with her regarding the baby. During the altercation, Peoples said
Mixon said he wished she along with the baby would die. Peoples said Mixon may have
gone to the residence of his mother at #4 Wakefield Drive.
I had officers check the residence for Mixon. He was subsequently taken into
custody by Southwest Division Officers and transported to the Northwest Substation for
interviewing. Mixon was read his Miranda Rights and gave a statement saying he was at
the residence of his mother during the time of the incident.
Mixon was transported to PCRJ and booked in on Domestic Battery 3 rd Degree
(Enhanced D Felony).
According to Baptist ER staff, Peoples as well as the baby were okay with Peoples
having minor apparent injury.

Sir,
On 02/07/2015. Officer J. Butler (3X93/l4C309) and I (3X8 lll 2C253) were dispatched to 4 South Wakefield
Drive in reference to makin!! contact with Clarence Mixon (B/M DOB: 01/31/1986) who was wanted for Domestic
Batterv 3 rd- Felonv for an incident that occurred in the Northwest Division. Upon arrival. I observed a silver 2013 Nissan
Altima displaying Arkansas License Plate, 213WNF backed in the driveway of 4 South Wakefield Drive. I observed the
vehicle was occupied by a black male driver. later identified as Mr. Mixon and two black female passenl!ers later
identified as Millicent McClinton (B/F DOB: 02/04/1990) and Jennifer Marks (B/F DOB: 07/09/1991). As l approached
the vehicle. I asked Mr. Mixon to roll the window down and give me his identification. Mr. Mixon cracked the window
and then I asked him to open the door. He started to hesitate so I tried to open the door but it was locked. Mr. Mixon then
placed his hand on the gear shifter and I advised him to turn the car off. Mr. Mixon put the vehicle in drive and pulled out
of the drivewav. I ran back to mv vehicle and activated my emergency equipment to catch up to the vehicle. I advised
main channel of the vehicle trvin£t to e:et away from me. As I was makinl! the curve on from South Wakefield onto East
Wakefield I did not observe any taillights in front of me. I looked down Winchester Drive and observe the vehicle was
stoooed in the middle of the roadwav. I stooped and conducted a felonv stoo on the vehicle and found Mr. Mixon had fled
the vehicle prior to me observing the vehicle stop in the roadwav. I made contact with the female passengers who stated
Mr. Mixon fled the vehicle on foot south back towards his residence. The backseat passenger. Ms. Marks stated when Mr.
Marks turned onto Winchester Drive: she ·was flung into the door due to her not wearing a seatbelt. MEMS responded to
check out Ms. Marks but she refused to be transported. Due to Mr. Mixon tlceing on foot. I requested a K9 responded lo
assist in tracking him. Officer Harrington (K47) responded and began a track with her K9 partner towards Mr. Mixon's
residence. When additional officers arrived. Officer Harrington stood bv at the backdoor while other officers knocked on
the front door. Mr. Mixon's mother opened the door and allowed us inside stating he was inside. At that time. Mr. Mixon
tried to exit the rear door but when he observed Officer Harrington and her partner, he went to the front of the house
where he was placed into custodv. I transported Mr. Mixon to the Northwest Detective Division where he was turned over
to Officer Monroe {3X64).

Sir,
On Saturday, February 7, 2015 at approximately 0528 hours, I (3X93) was operating
vehicle 14C309. I responded to 4 South Wakefield Drive in order to make contact with suspect
Clarence Mixon (B/M 01/31/1986). Upon arrival suspect Clarence Mixon (B/M 01/31/1986),
Millicent Mcclinton (B/F 02/04/1990), and Jennifer Marks (B/F 07/09/1991) was in the vehicle
parked in the driveway. After approaching the vehicle and making contact with the subjects, Mr.
Mixon drove off. The vehicle was later stopped on Winchester Drive but Mr. Mixon was no
longer in the vehicle. Ms. Marks and Ms. Mcclinton were still in the vehicle. I made contact
with Ms. Mcclinton who was in the passenger seat. Ms. Mcclinton advised Mr. Mixon had
jumped out of the vehicle and headed southbound on foot. Ms. Marks advised her neck was
hurting and was checked by MEMS (516). Ms. Mcclinton was put in the back seat of my car
until Mr. Mixon was in custody. Ms. Mcclinton and Ms. Marks were released once M...r. Mixon
was in custody. MVR in use.

entire series of transmissions lasted until 0559:04. Thank you for narrowing it down so close. Your CD is ready. I left

At approximately 0528 hours Officers Butler and - were dispatched to 4 South Wakefield Drive in
reference to a Felony Domestic Battei:y that occurred approximately two hours earlier at 8500 Keller Drive (Inc # 2015-
014428). Officers Butler and - were looking for suspect Clarence Mixon (B/M 1/31/86) who resides at that
address. Upon arrival Officers Butler and - observed a silver 2013 Nissan Altima bearing AR LPN 213WNF
backed in the driveway of 4 South Wakefield. The vehicle was occupied by three individuals. As Officer - -
approached the vehicle the driver, later identified as Clarence Mixon, opened the window. Officer - asked Mr.
Mixon for identification, at which time Mr. Mixon put the car in drive and pulled out of the driveway. Officer
- ran back to his patrol car and as he made the tum on East Wakefield he observed the suspect car on
Winchester Drive stopped in the middle of the road. Officer - caught up to the car to discover Clarence Mixon
had fled on foot. Officer - apprehended the rear passenger, Jennifer Marks (B/F 7/9/1991). Officer Butler
apprehended front seat passenger Millicent McClinton (B/F 2/4/1990). Both passengers were searched and placed in
patrol cars. Both passengers advised officers that Mr. Mixon ran south from the vehicle. Officer Harrington (K47)
responded and began a track with her K9 towards Mr. Mixon's residence at 4 South Wakefield Drive. Officer Harrington
made contact with Clarence Mixon's mother at the residence who told her that he was inside the house. Clarence Mixon
came to the front of the house where he was taken into custody without incident. Mr. Mixon was transported to the
Northwest Detective's Office and charged with Enhanced Domestic Battei:y 3rd.
On February 10, 2015 Sergeant Ann Hinton received a call from Da'Vetta Flowers regarding her daughter, Millicent
McClinton (2/4/90). Ms. Flowers stated that her daughter was touched inappropriately by an officer, and the same officer
began sending text messages to her cell phone number which he obtained during the initial police incident. Ms. Flowers
forwarded the text messages that were sent to her daughter to Sergeant Hinton. Sergeant Hinton identified the phone
number that was provided by Ms. Flowers as Officer Jason Butler's. The texts are included in the file.
On Februai:y 11, 2015, Ms. McClinton contacted Sergeant Hinton and told her that on Friday, February 6, 2015 at

Internal Affairs Interview on February 12, 2015.
On February 20, 2015 Assistant Chief Hayward Finks authorized a Criminal and Internal Investigation concerning
the allegations.
On March 4, 2015 Sergeant JC White was assigned to conduct a criminal investigation into the allegations.
Sergeant White made contact with Ms. McClinton on the same date via phone. Ms. McClinton advised Sergeant White
that one of the officers searched her initially, then came back and searched her again. Ms. McClinton stated the Officer
ran his hands over her vaginal area and she felt this was inappropriate. Ms. McClinton further stated that a few days after
the incident the officer began sending text messages to her phone. Ms. McClinton agreed to provide a recorded statement
on March 9, 2015 in reference to the criminal investigation. Ms. McClinton did not show up for her scheduled
appointment. Numerous attempts were made by Sergeant White to reschedule Ms. McClinton's interview with negative
results. Sergeant White also sent a certified letter to the address provided by Ms. McClinton, which was returned
undelivered.
On May 20, 2015 the criminal investigation was terminated due to the lack of evidence and Ms. McClinton 's
failure to cooperate.
On July 2, 2015 Officer - was interviewed by Internal Affairs Investigators Keathley and Rothwell.
Officer - stated he did not hear any of the conversation between Officer Butler and Ms. McClinton, nor did he
see Officer Butler touch her inappropriately.
On July 2, 2015 Officer Butler was interviewed by Internal Affairs Investigators Keathley and Rothwell. Officer
Butler stated he met and became attracted to Ms. McClinton when he responded to a call on February 7, 2015. Officer
Butler stated Ms. McClinton was a passenger in a vehicle driven by Mr. Mixon, and that he searched her and placed her in
the backseat of his patrol unit. Officer Butler stated both the Ms. McClinton and the vehicle had an odor of marijuana,
and that he searched her a second time after she admitted she had been smoking marijuana earlier that night. Officer
Butler stated after he released Ms. McClinton he asked her if she dated "cops", and if it would be alright to call her.
Officer Butler supplied telephone records documenting the telephone calls between him and Ms. McClinton and admitted
to calling and texting Ms. McClinton on February 7th and 8th. Officer Butler admitted that the text messages supplied by
Ms. Flowers were text message conversations between him and Ms. McClinton. Officer Butler stated he did not
inappropriately touch Ms. McClinton during the two searches, and he advised that he should have used better judgment
and kept his personal and professional life separate.
Taking all of this into consideration I feel Officer Butler's actions violated, Rules and Reeulations 1/4002.00
which states, "Officers shall not engage in any conduct which constitutes conduct unbecoming an officer or neglect
of duty", and Rules and Reeulations 1/4003.00 which states, "No officer shall eneaee in any personal act or conduct
which, if broueht to the attention of the public, could result in justified criticism of that officer or the Department."
Due to Officer Butler violating Rules and Regulations 1/4002.00 and 1/4003.00, I recommend that Officer Butler be given

Mixon (BIM, 01/31/1986). They located Mr. Mixon in a vehicle parked in the driveway of the residence and attempted to
identify him. Mr. Mixon drove away from the residence and both officers followed him to Winchester Drive where he
fled on foot. Mr. Mixon returned to his residence on South Wakefield where he was apprehended without incident and
transported to the Northwest Detective Division. Two passengers remained in the vehicle who were identified as Jennifer
Marks (B/F, 07/09/1991) and Millicent McClinton (BIF, 02/04/1990). Both subjects were detained and then released
without charges. Mr. Mixon was later charged with Domestic Battery 3rd (Enhanced) and transported to PCRJ (Incident
#2015-014428).
On February 10, 2015, Sergeant Ann Hinton received a call from Da'Vetta Flowers regarding her daughter, Ms.
McClinton's contact with an officer. who was later identified as Officer Butler. Ms. Flower's alleged that Officer Butler
touched her daughter inappropriately the night of the incident and engaged in text message conversations days after.
On February 11, 2015, Ms. McClinton contacted Sergeant Hinton regarding the allegations and agreed to come into the
Internal Affairs offices for an interview on the following day, but failed to appear as agreed.
On Februazy 20, 2015. both internal administrative and criminal investigations were authorized by Assistant Chief
Hayward Finks regarding Ms. McClinton's sexual misconduct allegations against Officer Butler. Sergeant J.C. White
conducted the criminal investigation in which Ms. McClinton failed to appear for several scheduled interviews: he
determined that there was not sufficient evidence to proceed with criminal charges: and recommended the investigation be
terminated with no further action. Sergeant Vicky Keathley conducted the internal administrative investigation. She
interviewed Officers Butler and - but was unable to interview Ms. McClinton due to a lack of cooperation.
Sergeant Keathley was able to obtain copies of the text message exchange between Officer Butler and Ms. McClinton.

recommend Officer Butler be exonerated of any wrong doing regarding this matter.
Officer Butler admitted that he inquired with Ms. McClinton whether she dated "cops" and that he contacted her by
phone. His inquiry and contact was inappropriate and not suitable conduct for the work environment. As a result, Officer
Butler violated Rules and Regulations, section 1/4002.00 which states, "Officers shall not engage in any conduct
which constitutes conduct unbecomin2 an officer or ne2lect or duty." and Rules and Re2ulations, section 1/4003.00
which states, "No officer shall engage in any personal act or conduct which, if brought to the attention of the public,
could result in justified criticism of that officer or the department." Sergeant John Elizandro counseled Officer Butler
regarding him maintaining separate personal and professional lives. I concur with Sergeant Elizandro's recommendation.
The alle ation should be shown as sustained and Officer Butler receives a written re rimand.

regular assigned duties on Thursday, December 10, 2015. You are suspended for violating the following listed section
