The   petitioner   nos.   3   to   10   have   been   appointed   in


September,  2010  by  petitioner  nos.  1  &   2,  a  minority   institution
managing minority school.
Approval to their employment has been rejected on the
ground that it is without previous permission of respondent no.2
Education Officer.
We have heard respective Counsel.  
The   petitioners   have   pointed   out   that   in   the   light   of
judgment of Division Bench of this Court in the case of  Canossa
Society,   Mumbai   v.   Commissioner,   Social   Welfare,   Pune
reported in 2014 (4) ABR 521, an institute like the petitioner nos.
1   &   2   is   not   bound   to   obtain   previous   permission   from   the
respondent no.2.
We find that the status of petitioner as minority institution
has   been   recognized   on   23.9.2016   with   effect   from
commencement   of   educational   year   2016­17.     The   application

therefor was moved by petitioners on 19.8.2016 and it has been
allowed on 23.9.2016.   The appointment orders are after moving
said application and in academic year 2016­17.
In   this   situation,   we   find   the   denial   of   approval
unjustified.
We, therefore, quash and set aside the impugned order.
If all other norms are satisfied in the present matter, the
respondent no.2 to extend necessary approval to petitioners in the
matter.       This   exercise   shall   be   completed   within   next   three
months.
Writ Petition stands partly allowed and disposed of.
