Demand Letter
Under Article 694 of the New Civil Code, any act, omission, establishment, business,
condition of property or anything else that “annoys or offends the senses” is a nuisance,
and under Article 695, a public nuisance affects a community or neighborhood or any
considerable number of persons although the extent of the annoyance, danger or damage
upon individuals may be unequal.
Despite repeated demands, you failed to prevent your animal from barking
indiscriminately and making noises frequently so as not to disturb the peace and quiet of
the neighborhood.
Accordingly, FINAL DEMAND is hereby made upon you to attend to the matter by
removing said animal from the premises within FIFTEEN (15) days from receipt of this
letter. Otherwise, we will be constrained to file the necessary legal action against you by
the filing of a COMPLAINT FOR ABATEMENT OF PUBLIC NUISANCE WITH
DAMAGES to protect the interest of our tenant.
We trust that you will give this matter your prompt and preferential attention to avoid
the expense and inconvenience of litigation.
