Legal obligations for Aardman

Contractual
Types of contracts
A contract is an agreement or a promise that is enforced by the law, and is used in many
things an example of this is with a job, they are also phone contracts which aren’t the same.
They are hundreds of jobs in the line of Aardman, and
is important you do the one you specialize it and it can
vary between so many of them, for instance you could
be someone who handles the lighting on stage to a
clay modler they is a huge variety, of course they will
be different salaries for each of the jobs but will each
have different difficulties and challenges. Each one of
these will require a contract that you will fill in and it
will promise that you will stay in that line of work until
the contract ends.

Non-disclosure agreements
A non-disclosure agreement also known as many other similar things, and it is a agreement
between two people normally and it works the same as they
contract and will contain all the details about the contract and is to
be kept by the two of them, unless they want to drag other people
in to it, they are two different types of agreements which are;

1.Unilateral NDA – this is also known as a one way agreement

where one party wants to share information with another party but
cannot due to secretary.

2. Bilateral NDA - where both parties will be supplying information

that is intended to remain secret. This type of agreement is
common when businesses are considering some kind of joint venture or merger.

Negotiating contracts
When negotiating contracts, they’re many places where you can learn how to do it there is
loads of research of it on the web, they are many ways to get you better at handling
negotiating contract, one of people main mistakes is that people don’t take their time when
making these contracts and they just sign them, when doing this people should get
professional help so they get it perfect of a least look it up so you learn some basic insight on
what you’re doing.
Time management
In the Aardman company you will have basic working hours and to
keep on the task that you will be doing you will need to do a time
management schedule so that you stay and on target and list
everything you’ve done so when you come to a meeting or a check-
up schedule you show this to your peers or bosses, this is effective
strategy of work and it doesn’t need to be done on every task you do
or be detailed unless asked to.

Regulatory issues
Copyright law
The copyright laws that I am aware of is copying it directly from a website and saying it’s your
own, this could also include selling it as your own. Producing a software file and giving it to a
friend all this breaches the confidentiality of their
information. The copy right laws also include music,
videos, images and text etcetera.
I am also aware of how long the copyright and patents act
is for, the lifetime of the creator of the content and an
additional seventy years on top of that after that the
content gets passed down to their ‘heirs’ or beneficiaries.
I will not risk copying directly any content from a website.
If I do this would risk me getting fined a large amount or
going to prison.

OFCOM
Ofcom is in the telecoms sector in which companies can compete fairly and businesses benefit
from the choice of services
Ofcom has a duty under the Communications Act to ensure that spectrum is used effectively
and optimally, and to promote innovation and competition in the provision of networks and
services. Its objective is to secure the maximum benefit for citizen-consumers, industry and
the wider economy.

Freedom of information
Confidential information is important to the Aardman
industry. Information will only be protected as a business asset
if it is kept confidential within a small group. Unless it qualifies
for intellectual property rights protection, this being
copyright, database rights and patents etc. Secret information
could and can be stored in any form and relate to any subject
matter, whether hard copy, electronic or simply stored in
people’s minds. It’s often not appropriate to rely solely on
intellectual rights protection and the better strategy may be to maintain the secrecy of that
information. One way of keeping the secrecy of information would be to impose specific
confidentiality obligations on the recipients.
If Aardman collects sensitive consumer and employee data, I need to understand my
obligations to each law. ‘The Data Protection Act, gives individuals the right to know what
information is held about them’. My business is required to make sure personal data is, held
securely and kept no longer than is necessary. It should be protected from unauthorised use.
The Privacy and Electronic Communications Regulations, if your company was to send
marketing messages either by phone, email, fax or text, you must comply with the Privacy
and Electronic Communications Regulations. It is unlawful to send direct marketing to
someone who has not given permission, unless there was a previous relationship between
the parties.

Taste and decency

I will also be libel as it is defamation of a person, through mostly written word. Defamation
could also be in visual forms such as photographs and illustrations. Defamation is the untrue
insinuation against a person’s reputation.
Race- I will not discriminate anyone by the colour of their skin nor of their ethnicity, I will
represent race equally and not discriminate against any one because of their colour.
Gender- gender will neither be an issue nor will be used for discrimination in the role of my
business. As the thing, I will be promoting will be for all genders.
Religion- My target market group towards religion won't play any pull/push factors on my
project as I want to attract as many people as I can, their will bias against religion.
Sexuality- sexuality will not be discriminated as they're entitled to their own intentions of
their choice of person and I have the decency to respect that.

Self-regulation
Self-regulation is when a person or group governs or polices itself without outside assistance
or influence. An example of self-regulation is when you limit, of your own accord, how much
you will eat. Self-regulation in media is how the media watch their self and control what they
say about people, if they didn’t do this they could be some lawsuits made against them and
they would lose money. Self-regulation is part of everyday life and its used to make sure you
don’t go over the top on anything and cause problems for yourself.

Health and safety policy

Health and safety is important when it comes to Aardman as they are
responsible for your safety to remain intact while on the job remain in
your boundaries, so don’t go of course, and somewhere that isn’t in
your area, you are obligated to stay at your work station, they will be
signs of danger within the Aardman studio.
Here is the health and safety act below pulled from a website which will be listed in the
sources. “The Health and Safety at Work etc Act 1974 (also referred to as HSWA, the HSW
Act, the 1974 Act or HASAWA) is the primary piece of legislation covering occupational health
and safety in Great Britain. The Health and Safety Executive, with local authorities (and other
enforcing authorities) is responsible for enforcing the Act and a number of other Acts and
Statutory Instruments relevant to the working environment.”

Professional bodies
British interactive multimedia association
The BIMA is Britain’s digital community. They are innovative across the digital industry. They
represent the media and digital content sector. ‘The BIMA are the longest standing and most
prestigious digital awards within the UK’. They help and inspire people to work within the
British digital community.
The BIMA has an official website where you can look at future or previous events, it also has
a page where you can join the BIMA, it also has three other options such as “my company is
a BIMA member”, “get to know the BIMA” and “I am a student” which is a option which allows
young people to get into the British digital industry.

Professional body codes of practice

A professional association is a non-profit organisation looking to invest in a particular
profession, the interest of individuals engaged in that profession.
Code of Professional Conduct
“All leading professional bodies, such as the IIA, have a code of conduct to guide the member
and raise the level of trust and confidence of the public in the profession. All members must
express their commitment to the code when they join the IIA and to subsequent changes to
the code which may be agreed from time to time. The rules and procedures for dealing with
any allegation of infringement against the code are described in the Professional Complaints
Procedures. This code and the procedures are available to the public.”

Ethical
Ethical requirements
According to Aardman they can collect and keep some of your personal information and
release it under certain circumstances for example
this could be due to selling merchandise to third
parties they might require your information, other
than this you have rights to which can be used
against this such as, “the right to withdraw your
consent to the processing of your Personal Data at
any time. Please note, however, that we may still
be entitled to process your Personal Data if we have
another legitimate reason for doing so. For
example, we may need to retain Personal Data to
comply with a legal obligation”, “the right to
request that we erase your Personal Data in certain circumstances. Please note that there
may be circumstances where you ask us to erase your Personal Data but we are legally
entitled to retain it” and many others which are on the website found in the sources.
They are also Ethical requirements elsewhere for an example:
Not taking any pictures, videos or sound clips without permission of the owner which sometimes may
be needed in writing.

Not making any verbal statements about any individual which is abusive or harmful towards
them as this is known as slander.
Not making any written statements about any individual which is abusive or harmful towards
them as this is known as libel.
Do not take any part of somebody's work without getting permission of that person as this
would be copyright.
Be careful when you represent and describe the content and characters in work as you must
make sure that you are unbiased and accurate.
This is just a small list of them there will be many others that apply to everyone no matter
what race, sexuality, disability, nationality, class, region and age they all apply!

Policies and procedures

What is meant by policies and procedures? A set of policies are principles, rules, and
guidelines formulated or adopted by an organization to reach its long-term goals and typically
published in a booklet or other form that is widely
accessible.
When you have joined the Aardman company you will
then undergo understanding the policies and
procedures, this will happen to anyone who works there
but if you are still unsure about them or just want to
know more information go to this website
https://www.aardman.com/terms-and-conditions/.
Cultural issues and language
What is culture? “Different cultures have different patterns of behaviour/ways and norms of
living. In the US, what we generally mean by different cultures are foreign cultures and sub-
cultures within our larger US community. An example of a foreign culture, might be a person
coming from China to the United States. A Chinese person has patterns of behaviour that are
normal and healthy in his or her home community. However, certain aspects of their
behaviours may be perceived by US citizens as not healthy (not within the US "norm" of
behaviour). A good example is the distance Europeans stand from others when talking.
Europeans stand approximately 1/2 the distance from another person when talking as
opposed to Americans, which may make an American feel very uncomfortable.” this is an
example pulled from a website that will be in the sources.
In the Aardman company culture doesn't have big impact on what we think of you although
it is important to know as it is a big thing in your life and can mean some important
differences.

Representation of religious beliefs

In Aardman the company doesn't degrade anyone from choosing what to believe, as they
believe everyone has their own right to believe what they want, the company is widely diverse
in this area as it currently holds up to 400+ unique employees that all are from different
religious backgrounds.

Representation of gender
Representation of gender means being racist, this can also happen accidentally as this has
happened before in many cases. The representation of gender in the media has changed
massively over the years but in this current era they are no sexism in the Aardman industry
and everyone no matter what gender they are, are treated equal. However, they may be some
cases where women work more in other places and men work in others this is simply due to
the fact of their own personal preference.
