Our family law says a couple who have lived
together in a marriage-like relationship
for at least two years are “spouses” – even
if they’re not formally married. Generally
this means that common-law couples are
treated the same as married folks if they
break up, for example when it comes to
child and spousal support or division of
family property.
But what is meant by a “marriage-like rela-
tionship”? It’s essential to prove this some-
what vague concept – that yours was a
“marriage-like relationship” – for you to be
treated as a common-law spouse.
A recent case considered whether Michael
and Sandra (names changed) had a
“marriage-like relationship.”
Sandra was a former criminal lawyer.
Michael had been her close and loving
companion of over 20 years. They had
started their sexual relationship in 1993
when Michael was still married. They had
carried on their relationship after Michael
separated from his wife (later getting
divorced) – right up to the time Sandra
died in 2015.
Over the years, they travelled together, told
everyone they were husband and wife and
were regarded as a loving couple by their
friends. When Sandra fell ill, Michael cared
for her to the end.
Since they had never gotten married,
Michael asked the court to declare he was
Sandra’s common-law spouse. The other
side, which would benefit if Sandra had
no “spouse,” argued theirs had just been a
long-standing affair.
The court decided Michael and Sandra
had indeed been in a marriage-like
relationship.

Many factors come into play when
deciding whether a particular relationship
is “marriage-like,” said the court.
Some of those factors include the nature
and length of the couple’s relationship –
how long they’ve been together, whether
they’ve shared their lives, their particular
living arrangements, how they’ve viewed
their relationship, how they’ve handled
their finances, whether they’ve cared for
each other when ill, etc.
Relationships, like people, come in all
shapes and sizes, said the court. No single
factor alone is decisive; you can’t just
tick off the boxes on some shopping list.
The circumstances of each case must be
looked at individually.
Here, Sandra and Michael loved and were
faithful to each other for a long time,
and it was clear they were more than just
“friends with benefits.”
The fact Michael and Sandra never lived
under the same roof and kept their fi-
nances separate might at first blush sug-
gest something less than a marriage-like
relationship. But the overall picture was
overwhelmingly in favour of declaring
their relationship was marriage-like, said
the court.
Sandra, better off financially than Michael,
had made Michael the beneficiary of
her valuable RRSP years earlier already.
She’d also given him online access to her
money. And while Michael didn’t move
in and live with Sandra after he separated
from his wife, that was because Sandra
had developed a hoarding illness.

Mercer, Celgar will cover the costs of the consultant to perform soil sam-
pling, obtaining government authorization and delivery costs of Celgrow
soil amendment based on access with a large truck/pup combination. Acre-
age should be able to accommodate at least 6 truck/pup loads. The two
major components of Celgrow are individual wood fibres lost from the
pulping process and surplus bacteria from the wastewater biological treat-
ment facility. Wood fibres enhance soil moisture retention and bacteria are
a good source of soil nutrients. The landowner is responsible for spreading
and incorporating Celgrow into their soil.
