LEGAL AID REPORT

From 2nd to 6th February, 2015, Three students of the X Semester, namely Purva Kaushik,
Abhijit Tripathi and Abhishek Tripathi of VIPS sat on duty in the Legal Aid Clinic set up in the
premises of VIPS Campus. Under the guidance and supervision of their Teacher-in-charge, Ms.
Navjeet Sidhu Kundal, the above named students gave legal advice to those who came and
asked for it at the clinic. Following are the matters the students dealt with during this week :-

1. On 2nd February, 2015, one Mr. A.K. Goel residing at 2-C, Ujwal Apartments, Vikaspuri,
New Delhi visited the Legal Aid Clinic seeking advice on the matter that his 91 years
widower father, having 4 sons and no daughters wished to sell off his own self-acquired
property but the other sons of the client’s father were not letting him sell off the same
property stating that they also had a right over the said property. The client wished to
know whether his old father could sell off his property and whether his brothers had any
rights over it so as to entitle them to prevent its sale.
Advice given: We informed this client that since the said property was the self-acquired
property of the client’s father, the client’s father was the true and absolute owner thereof
and therefore, fully entitled to do anything with his property including its sale. We also
informed him that his 3 brothers had no legal right to interfere in the sale of the said
property. It is only if their father dies intestate that they are entitled to 1/4th share each but
before his death, the father was fully entitled to deal with his own property in whatever
manner he wished.

2. On 3rd February, 2015, two brothers Rahul Pandey and Rohit Pandey residing at 33, CU
Block, Pitampura, New Delhi visited the Legal Aid Clinic seeking advice on the matter
that there was a temple in their immediate neighbourhood which played religious songs
on loudspeakers everyday, even late at night. The clients said that they had dialed 100
one night and called the police as even after several requests, the temple authorities were
unwilling to turn off the loudspeakers and the clients were facing difficulty in studying
for an exam the next day. Also, the other neighbours couldn’t sleep soundly because of
the loud noise which these loudspeakers created. Two havaldaars visited the temple, took
bribe of Rs. 200 from the temple authorities and instead of helping the clients, they
scolded them for troubling the police on such trivial matters. The clients sought advice as
to what is to be done by them if the same happens in future again.
Advice given: We informed the clients that according to the law of crimes, the temple
authorities were guilty of Public Nuisance and that the same offence was punishable
under the provisions of the Indian Penal Code. For next time, we adviced the clients to
make a visit to the nearby police station instead of dialing 100. We asked them to directly
complain to the S.H.O. and to further inform the S.H.O. regarding the inaction and
irresponsible behavior of the havaldaars who had visited and that they had received bribe
from the temple authorities to speak in their favour. We assured the clients that the
S.H.O. would take some action in their favour and if he doesn’t, we asked them to give a
written report regarding the matter to higher police authorities.

3. On 5th February, 2015, one Mr. J.K. Tiwari residing at C-503, Sector 19, Rohini visited
the Legal Aid Clinic and sought advice regarding a will which he wished to make. He
informed us that he had a flat in which he was presently living, bought by him with his
own hard earned money and that he had 1 son and 3 daughters. He wished to make a will
by way of which he would bequeath the above named flat to his eldest daughter who
shall, upon his death, become the absolute owner of the said property, wholly entitled to
enjoy, sell, mortgage, lease out, etc. the said property. He asked us whether the will was
to made on a stamp paper and also sought information regarding the proper procedure
and format to make a will.
Advice given: We informed the client that there was no compulsion to make the will on
stamp paper only and that the will could be made by him even on any plain paper. We
further informed him that while making the will, he should ensure that two sound and
major witnesses of the same are present. Also, we gave him a gist of the format required
to draft a will.

These were the only matters that we came across and tried to solve in the legal aid clinic.
On the days when no client visited the Legal Aid Clinic, we researched on legal topics of
our interests and collected data relevant to our topic.
The whole task strengthened our confidence and counseling skills. We got to experience
how clients in real life are dealt with. We also got to learn how the laws we have studied
in these 5 years are to be applied on the problems brought before us by the clients. It was
altogether an amazing experience and we thoroughly enjoyed the task given to us as
budding lawyers.
