The Complainant submits this complaint to the Court and states that there is probable cause to believe
Defendant committed the following offense(s):
COUNT I
Charge: Aiding and Abetting Assault-3rd Degree-Substantial Bodily Harm
Minnesota Statute: 609.223.1, with reference to:  609.223.1, 609.05.1
Maximum Sentence: 5 years imprisonment and $10,000 fine
Offense Level: Felony

Charge Description: The defendant did, in Faribault County, intentionally aid, advise, hire, counsel, or
conspire with or otherwise procure another to commit the assault in the third degree.

STATEMENT OF PROBABLE CAUSE 11/20/2017 01:55:38 PM

The Complainant states that the following facts establish probable cause:
 
Your Complainant is a peace officer employed by the Winnebago Police Department. In this capacity, your
Complainant believes the following to be true and correct.

On November 9th, 2017, Officer Jacob Pettit of the Winnebago Police Department was advised by Chief
Eric Olson that an assault may have taken place. Chief Olson told him that a juvenile with the initials C.C.H.
had been assaulted and knocked unconscious by an adult male, Wyatt Tungland. 

Officer Pettit investigated the matter by approaching a number of juveniles and asking if they had heard
anything about the fight. He was told that a fight had taken place at a party, and that the incident had been
filmed. He continued to speak with juveniles about the incident and developed a list of persons of interest. 

Officer Pettit interviewed C.B.S. C.B.S. told the officer that he had witnessed Tungland punching C.C.H. in
the face while others at the party held C.C.H. down. He specifically identified B.J.B., Dalton Nagel, and
C.R.O. as the people holding down C.C.H. He told the officer that this had happened at a party at 518 3rd
Ave. SW in Winnebago. 

Officer Pettit interviewed C.C.H. C.C.H reported that he had been in a dispute with B.J.B. before the night
in question. He was invited to the party. During the party, he was attacked. He recalled being pushed down
and punched in the face. He became unconscious. The next day his face was swollen and bruised. He
returned to school for football practice. B.J.B. showed him a video of B.J.B. and C.R.O punching C.C.H. in
the face. Later C.C.H. received medical attention and discovered that he had suffered a concussion
because of the attack. He also suffered swelling and bruises on his face. 

Officer Pettit interviewed C.R.O. C.R.O. admitted that he, Tungland, Nagel, and B.J.B hit C.C.H. in the head
and face with open and closed hands. He admitted that C.C.H tried to get up, but they pushed him down
and continued to hit him. 

PLEASE TAKE NOTICE: Pursuant to Minn. Stat. 609.49., intentional failure to appear for duly scheduled
court appearances may result in additional criminal charges, and in addition to any arrest warrant that may
otherwise be issued by the Court.

From the above sworn facts, and any supporting affidavits or supplemental sworn testimony, I, the Issuing Officer, have
determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).

SUMMONS
THEREFORE YOU, THE DEFENDANT, ARE SUMMONED to appear on ________ ___, _____ at _____ AM/PM
before the above-named court at 320 Dr. H. Russ Street Fairibault County Law Enforcement Center Hearing
Room, Blue Earth, MN 56013 to answer this complaint.

IF YOU FAIL TO APPEAR in response to this SUMMONS, a WARRANT FOR YOUR ARREST shall be issued.

WARRANT
To the Sheriff of the above-named county; or other person authorized to execute this warrant: I order, in the name of the State
of Minnesota, that the Defendant be apprehended and arrested without delay and brought promptly before the court (if in
session), and if not, before a Judge or Judicial Officer of such court without unnecessary delay, and in any event not later than
36 hours after the arrest or as soon as such Judge or Judicial Officer is available to be dealt with according to law.
