You did not answer my requests point by point as required by law. | had requested that you provided proof of claim. A copy of the security instrument is not a sufficient proof of claim as per U.C.C. - ARTICLE 3 -§3-501 (b) 2 (1). Under this code, | am entitled to have the instrument presented to me as you are required to upkeep the legal document entrusted to you. Under USC Title 18 Chapter 25, and 241, you are engaging in counterfeiting and such behavior isa felony. Under FOCPA 15 1692 (I) Harassment, Under USC Title 18 Chapter 25, and 241, you are engaging in counterfeiting and such behavior is a felony. Under FDCPA 15 1692 (I) Harassment, THE FDCPA imposes civilliablity on any person or entity that violates its provisions and establishes general standards of debt collector conduct, defines abuse, and provides for specific consumer riahts. The operative provisions of the FDCPA declare certain rights. The FDCPA is a strict liability statute that provides for actual and statutory damages upon the showing of one violation. It has been universally held that whether a debt collector's ‘conduct violates the FOCPA should be judged from that standpoint. Providing a photocopy of a security instrument is not only unconscionable but is illegal. | had asked for the visual inspection of the original promissory note, not a copy. You did not provide any proof to sufficiently satisfying your claim under U.C.C. - ARTICLE 3 -§9- 302 that you are a note holder in due course. You did not stipulate whether or not you were the holder in due course. You did not stipulate whether this loan was no more because it was securitized as required by law and a buyback on the secondary market and presented to the court and world, that your action to create the illusion of attachment. The Mortgage Deed in itself does not attach to, nor does it create an enforceable right for the BANK (and their Attomey) to enforce an action (foreclosure) against your property.
