RESOLUTION

This criminal complaint for the crime of Frustrated Murder as defined and penalized
under Article 248 in relation to Article 6 and 50 of the Revised Penal Code was filed at the
instance of LORENZO DELOSO, 43 years old, married, Filipino and a resident of Brgy.
Jardin, Dumangas, Iloilo.

The parties to this case were subpoenaed to appear for preliminary

investigation/clarificatory questioning before the Provincial Prosecutor’s Office on 8 February
2018 at 11:00 a.m. During the scheduled preliminary investigation, only complainant appeared.
But on 6 February 2018 respondent filed his counter affidavit through registered mail.On 22 May
2018, complainant submitted a Letter to Withdraw Complaint with regard to NPS Docket No.
VI-11-INV-17J-00821, praying that the complaint for Frustrated Murder filed against respondent
DOMINADOR FERNANDEZ be allowed to be withdrawn, reasoning that he is no longer
interested to pursue the case and respondent already paid the damages and no more credible
witnesses to testify in his favour and that the complainantncannot prove the crime beyond
reasonable doubt.

Wherefore, in view of the Letter to Withdraw Complaint(entitled LORENZO

DELOSO v DOMINADOR FERNANDEZ, docketed as NPS Docket No. VI-11-INV-17J-
00821) dated 12 October 2017, and for meritorious reasons stated therein, the complaint
filed herein is hereby DISMISSED.
