CNA GROUND RULES BETWEEN THE URS ADMINISTRATION AND THE

FACULTY ORGANIZATION OF THE UNIVERSITY OF RIZAL SYSTEM

1. Composition of the Negotiating Panels is based on the Office Order issued by the
University President, and Resolution submitted by FOURS for their respective
negotiation panels.
2. Authority to Negotiate. The principal of both parties shall give their respective
negotiating panels the written authority to negotiate and bind such principals to the
matters agreed upon.
a. For the Union:
i. FOURS Board Resolution authorizing the listed officials / creating the
Executive Board as the Negotiating Panel of the Union with the
following attachments:
a. SEC Registration
b. Copy of the Certificate//Proof of Union Registration
with the Certificate of Bureau of Labor Relations
(DOLE Reg. No. 1836)
c. Copy of the Certificate/Proof of Union Accreditation
with the Civil Service Commission – Personnel
Relations Office (CSC Accreditation No. 961)
ii. Board Resolutions from existing Non-Teaching Personnel
Associations/Unions recognizing the FOURS as the Sole and
Exclusive Bargaining Representative of the Employees authorizing the
same to represent in the CNA with the Administration. Further, state
that FOURS has the majority support of the rank-and-file non—
teaching employees in the organizational unit.
b. For the Administration:
i. Copy Designation / Memorandum Order issued by the Head of the
Agency creating the CAN Negotiating Team/Panel and designating the
members thereof.

3. Quorum. The presence of at least majority of the members from each panel shall be
sufficient to hold negotiation meetings. Should the management or union failed to
meet the quorum, the issues supposedly presented, discussed and acted upon will be
deemed “APPROVED” as agreed by those presents.
4. Relief from Regular Duties and Responsibilities. The members of FOURS
Negotiating Panel, including the members of its Secretariat, shall be on official
business throughout the duration of the negotiations and they shall be relieved of all
their regular duties and responsibilities except in the exigency of services.
5. Time Limits and Schedule of Meetings. The parties of the CNA shall finish the
negotiation not later than the end of May 2018. The parties may agree to hold
meetings on a daily basis until the conclusion of the negotiation.
6. Postponement and Delays. No postponement of scheduled meetings shall be
allowed except on mutual agreement by both negotiating panels. In no case shall
consecutive meetings be postponed at the instance or request of only one panel. No
delays shall be allowed on the ground that a party needs time to research or
consult/secure an opinion from an outside source/agency.
7. Venue. The negotiation meetings shall be held at URS Main Campus, Tanay, Rizal.
8. Expenses. Each party shall bear its own cost for the preparation of its written
proposal and for other pre-negotiation expenses. Reasonable expenses for food
during the negotiation proper shall be shouldered by the University subject to the
usual accounting and auditing rules.
9. Access to Financial and Other Records of the University. Upon request in writing,
the management shall provide FOURS with pertinent true financial statements and
other related documents of the University whether audited/verified or not.
10. Proceedings. A Secretariat shall be formed to record the proceedings of the
negotiations. The members of the Secretariat shall be responsible for the preparation
of the minutes of the meetings. Minutes of the meetings shall be approved and duly
signed by both parties in all pages immediately following the negotiation meeting.
11. Sequence of Issues for Negotiation. The parties shall discuss based on the sequence
of proposed amendments in the submitted matrix of proposal from the Union.
Nothing shall stop the parties from changing the sequences of issues or from
suspending the discussion of a particular issue to give way to another. The item
considered for discussion shall be based if not limited on the items presented in the
approved Gantt Chart of Activities.
12. Provision for Information Dissemination. Each panel shall ensure that their
constituents are informed of the progress of the negotiation through the Negotiation
Board.
13. On Deadlock. In case of deadlock in any of the items discussed, both parties shall
pursue with the negotiation meeting considering the next item in the list for
presentation and discussion. Services or advices of “Observer” / “Consultant” shall be
availed of in case of deadlock in negotiation.
14. Observers. Other officials and personnel who wish to observe the proceedings of the
actual negotiation shall be allowed to do so provided that there will be no disruption
of work. They CANNOT participate in the deliberations.
15. On Approval of Ground Rules. These ground rules should be approved by both
parties before any negotiation starts.
