7 A RESOLUTION RECCOMENDING THE CREATION OF AN ORDINANCE
8 ELIMINATING THE REQUIREMENTS OF X-RAY EXAMINATION IN OBTAINING A
9 HEALTH CERTIFICATE FOR EMPLOYEES OF NON FOOD ESTABLISHMENTS OF
10 BUTUAN CITY.

13 WHEREAS, presented before the Honorable Sangguniang Panlungsod (SP) Body is a
14 letter from Mr. Stephen B. Cabaltera, Butuan City Investment Board Secretariat, addressed to
15 Hon. Joseph Omar Andaya, Chairman of Committee on Commerce, Trade and Industry, dated
16 June 27, 2017 with the subject: Issues and Concerns from Butuan City Investment Board.

18 WHEREAS, under concern number one (1) of the subject letter is a request to Review
19 the Local Sanitary Code of Butuan City regarding the requirement on procuring a Health
20 Certificate in relation with Presidential Decree No. 856.

21 WHEREAS, under PD 856 Section 15. No person shall be employed in any food
22 establishment without a Health Certificate issued by the local health authority. This certificate
23 shall be issued only after the required physical and medical examinations are performed and
24 immunizations are administered at prescribed intervals.

25 WHEREAS, under the Local Sanitary Code of Butuan City Section 2. Health Certificates. –
26 Every employee or personnel of a food establishment in the City shall secure the necessary
27 Health Certificate from the City Health Office. The Health Certificate shall only be issued to a
28 person applying for the same if he is able to satisfactorily pass the physical and medical
29 examination conducted upon his person and he has completed the prescribed immunizations
30 given by the City Health Office

32 WHEREAS, under the Local Sanitary Code of Butuan City and Presidential Decree No.
33 856, it is silent regarding the requirements for obtaining a Health Certificate, thus it can include
34 all necessary procedures or examinations for obtaining the same which can include X-Ray
35 Examination.

40 WHEREAS, upon review of the PD 856, it is understood that every Local Government
41 Unit can adopt their own Procedure and examination regarding the issuance of a Health
42 Certificate to the employees in line with PD 856, thus, it can include or exclude some of the
43 required examination which they may see fit for the situation/status of their particular Local
44 Government Area/Scope.

46 WHEREAS, in the discussion during the 7th Local Investment Board Meeting on June 17,
47 2017, it is understood that in Butuan City, in order for a Food and Non Food establishments to
48 obtain a Health Certificate they are required to undergo X-Ray examination.

50 WHEREAS, the Committee on Commerce Trade and Industry, upon review of the said
51 laws, the requirement of X-Ray examination before obtaining a Health Certificate for Non Food
52 Establishment employees is found to be a regulatory burden, but still necessary for employees
53 of Food Establishments.

55 WHEREAS, the SP Committee on Commerce Trade and Industry, in its hearing
56 conducted on ____________, evaluated the subject resolution and found the same reasonable
57 and in order, and recommended the creation of an Ordinance requiring the employees of Food
58 Establishments before obtaining a Health Certificate to undergo X-Ray examination excluding
59 the employees of Non Food Establishments;

61 WHEREAS, premises considered, the Honorable SP duly concurs with the
62 recommendation of the aforesaid SP Committee.

68 RESOLVED, To create an ORDINANCE eliminating the requirements of X-Ray
69 Examination before obtaining a Health Certificate for the employees of Non Food
70 Establishments.

72 RESOLVED FURTHER, to furnish copies of this Resolution for the Offices of the City
73 Mayor, the City Administrator, the City Legal Officer, the City Health Officer, the Local
74 Investment Board of Butuan City, and the Department of Health – Caraga Region.
