Leave of Absence

 Leave of absence
– a right granted to employees not to report for work WITH or WITHOUT pay
[even if an employee will not be paid for his absence, he has to file a
leave of absence]

 CSC Form 6 (Leave Form)


- An employee should submit 2 original copies of Leave Form
- 1 will be returned to the employee at the end of the month
- 1 will be a copy of personnel division

 Non-teaching personnel leave WITH FULL PAY


o 5 days – forced leave
o 3 days – special privilege leave
o 15 days – vacation leave ; 1.25-day vacation leave per month
o 15 days – sick leave ; 1.25-day sick leave per month

 When to file the leave of absence


- 5 days before the effectiveness of leave
- Except for emergency sick leave

 Leave of absence for 30 days or more


- Clearance from money and property accountabilities is needed

 AWOL
- If an employee is continuously absent for 30 or more WORKING days
without approved leave

 Types of Leave
1. Sick leave
o Granted on account of sickness or disability of the teacher or
any member of the family (parents, brothers, sisters, children,
spouse, and even house help who are living with the employee)
o Should be filed upon return to work
o If more than 5 days, medical certificate is required
o If submitted later than 6th working day, automatic salary
deduction
2. Vacation leave
o Granted to employee for personal reasons
o Maximum of 15 days annually
o 10 days can be monetized
o Approval is contingent upon the necessities of the service
o Vacation leave without pay is considered a gap in the service
3. Forced leave (FL)/Mandatory Leave
o Minimum of 5 working days annually
o Required/forced for non-teaching personnel with 10 or more
vacation leave
o If the accumulated vacation leave is less than 10 days, the
employee has the option to go on forced leave or not.
o If the accumulated vacation leave is 15 days, but the employee
opted to monetize 10 days, and results to remaining 5 days
vacation leave, the employee shall still be required to go on
forced leave
o Forfeited if not taken during the year
o If forced leave has been approved, but later cancelled, it will
not be deduction from the total accumulated vacation leave.
4. Special Privilege Leave
o Maximum of 3 days annually
o Non-cumulative and non-convertible to cash
o For special milestones and/or filial and domestic emergencies
 Birthday
 Anniversary
 Mourning
 PTA meetings
o On emergency cases, should be filed the day upon return to
work
5. Maternity Leave (ML)
o Every woman who has rendered an aggregate of two or more
years in service
o 60 calendar days with full pay
6. Paternity Leave (PL)
o For married male employee
o 7 working days
o Only for first 4 deliveries of legitimate spouse
7. Parental leave (Solo Parent Act)
o For parents who has the sole custody and responsibility of the
child
o For those who has rendered at least one year of service
regardless of employment status
o 7 days annually
o Needs to submit to the Personnel Division the Solo Parent
Identification Card or Certification issued/validated by the DSWD
within the month of January every year
8. Rehabilitation Leave
o for employees with disability on account of injuries sustained
while in the performance of duty
o based on the recommendation of medical authority
o not to exceed 6 months
o not to be deducted from the sick and vacation leave credits
9. Violence against women and their children act of 2004
o 10 days leave
o Applicable to any woman employee in the government,
regardless of employment status
o If the employee’s child (below 18 or above 18 but unable to
care of oneself) is a victim of violence
o May be continuous or intermittent manner
o To enable to attend to medical and legal concerns
10. Special leave benefits for women
o Max of 2 months with full pay
o Can be availed if an employee has rendered at least 6 months
aggregate service in any government agency for the last 12
months prior to undergoing surgery for gynaecological disorder
o Can be availed for every instance of gynaecological disorder
(disorders that require surgical procedures such as dilatation and
curettage and those involving female reproductive organs such
as vagina, cervix, uterus, fallopian tubes, ovaries, breast, adnexa
and pelvic floor, as certified by a competent physician) requiring
surgery
11. Study leave
o Not exceeding 6 months
o With pay
12. Terminal leave
o Money value of the total accumulated leave credits
o Based on the highest salary rate received prior to or upon
retirement date/voluntary separation
13. Special Emergency Leave
o 5-days
o For employees directly affected by natural calamities and
disasters
