SUBJECT : Formal Report regarding unauthorized Disposition of laptop


computers, Habitual Absenteeism and violation of Civil
Service
Policies

Date : March 5, 2018

Purpose : For your answer/comment

An Official Report was received by this Office relative to the pawning of laptop
computers under your custody, habitual absenteeism, insubordination and several
violations of Office Rules and Civil Service laws.

By virtue of Regional Special Order No. 069 S. of 2014 signed by Dir. Nestor Ramos
you were assigned at Property and Asset Management Section (PAMS) with the
following functions:
1. Assist to implement policies, programs and procedures on management and
disposition of real properties, equipment, semi-expendable properties and waste
materials;
2. Conduct an inventory and keep a record of all fixed assets and semi-expendable
properties of the Field Office;
3. Undertake complete documentation, registry and acquisition of all fixed assets
including donations;
4. Prepare documents for insurable properties, motor vehicles and equipment as
well as registration, if necessary;
5. Responsible for the safekeeping, updating of necessary documentation on the
ownership of real properties and fixed assets of the Field Office including
provision of security, if required;
6. Recommend to immediate supervisor on the acquisition and disposal of
equipment and properties;
7. Conduct annual physical inventory of properties including preparation and
submission of reports;
8. Responsible for the issuance of, safeguarding and updating of Property
Acknowledgement Receipt (PAR) for equipment, semi-expendable and non-
expendable properties;
9. Assist to ensure the insurance of all properties of the Field Office;
10. Conduct inventory and disposition of unserviceable or obsolete
equipment/properties through sale or transfer to other government agencies;
11. Assist to provide technical assistance to other operating division or units on area
of expertise; and
12. Perform other related tasks.

However, there were five (5) laptops under your custody which were taken out from the
DSWD Field Office premises without proper authority and pawned to different
pawnshops as evidenced by the pawn tickets you have presented to this Office with the
following details:

In connection with the above-cited report, you are hereby informed that the act of
pawning government property/ies may be charged as commission of the crime of
Malversation of Public Funds or Property as defined by Revised Penal Code Article 217
– Malversation of public funds or property and/or of Qualified Theft under Article 310 of
the Revised Penal Code. The act of taking of government property under custody
without authority is a grave misconduct and classified as a grave offense under the
Revised Rules on Administrative Cases in the Civil Service.

Further, an Official Report was also received by this Office for your failure to submit
Daily Time Records from July to November 2017 on the prescribed period. Upon
gathering of entries in the Official Logbook of the Office, it has been found out that there
a number of days without entries as shown in the matrix, to wit:

Such act can be considered as commission of Frequent Unauthorized Absences


(Habitual Absenteeism) as provided for in Section 22(q) of the Omnibus Rules
Implementing Book V of the Administrative Code of 1987 reiterated in Memorandum
Circular No. 4 Series of 1991.

Another Official Report was submitted to this Office for several violations of Office Rules
and CSC Rules and Regulations as follow:
1. Failure to submit IPC and IPCR 2017;
2. Failure to submit updated PDS for CY 2017;
3. Failure to attend flag ceremonies and flag lowering;
4. Failure to submit DTRs from June to November 2017 within the prescribe period;
5. Failure to inform or submit proper notice to the Head of Office and Immediate
Supervisor on absences committed;

6. Failure to perform and accomplish deliverables on his Position Description Form
1 and perform the responsibilities attached to the position as Administrative
Assistant I;

Considerably, a Preliminary Investigation will be undertaken to determine whether a


prima facie case exists to warrant the issuance of formal charge. Hence, as part of due
process and for Preliminary Investigation purposes, you are hereby called upon, within
ten (10) calendar days from receipt of this order, to submit your
answer/comment/counter-affidavit, affidavit of witnesses and other evidence to this
Office showing cause why an administrative and criminal case will not be pursued
against you.

Failure to submit your answer/comment under oath and other supporting documents
within the stipulated period will be considered as a waiver on your part. This Office shall
then proceed with the Preliminary Investigation process in relation to the foregoing even
without the said answer/comment.
