5. PROBLEM STATEMENT

 The Scenario:
As the Safety and Health Officer for a construction company, you are assigned to coordinate the
investigation of a serious incident.
A day after the incident, you visited the incident scene and have the opportunity to look around and
meet with people who were present at the time.
A forklift has collided with a worker in the vicinity of the loading area. The injuries are quite serious
with latest reports indicating that the worker’s leg may need to be amputated. The details of the incident
remain sketchy but it appears that the worker walked into the path of the forklift as it travelled out of one of
the aisles between the sites. The forklift was carrying fully-loaded pallets of finishing brick with the load
being carried at around waist height.
You have established an investigation team consisting of key personnel within the organisation. You
are concerned about the comments of some team members who have suggested that one or more
individuals are to blame for the incident. You see this as an opportunity to draw the team together to
ensure that all team members have an understanding of this phase of the investigation.

 Tasks
1. Prepare briefing paper with importance outline:
 the importance of being open minded and objective;
 questioning techniques based on “why?” and “how?” rather than “what?”; and
 focusing on work systems rather than individual behaviors.

2. To achieve a high standard of health and safety within construction area, as well as compliance with
relevant legislation and approved codes of practice, it requires safety and health awareness and
culture by the employer and employees. Prepare an accident or incident report according to
OSHA 1994 or DOSH requirements based on the scenario given.

Working with FILA

Understanding four essential parts of problem solving approach called FILA is one of the critical
moments for the student’s learning process. FILA comprises of Fact, Idea, Learning issue and
Action plan. The lecturer would present the trigger to the students so that they could start to
identify the fact, idea, learning issue and the action plan from the given problem in the trigger.
The trigger could be in many forms. It could be in form of a picture, a movie, a quotation, a
model, an article and etc. It is up to the lecturer to present the most appropriate trigger related
closely to the learning outcomes of the course.
