16 Comes now the respondent Joe-Sixpack: Smiths with interest in this matter to appear specially

17 not generally before this administrative court and the administrative judge as the beneficiary and

18 to bring forth to the court as part of the respondents administrative remedy, “Exhibit A” in an

19 effort to aid the court in settlement and closure of this account. On june 30, 2009 Department of

20 Economic Security Division Child Support Enforcement here forth (DES) made a presentment

21 to respondent. Blacks Law 8th edition defines Presentment as The formal production of a

22 negotiable instrument for acceptance or payment.

23 U.C.C 3-501 defines Presentment as a demand made by or on

24 behalf of a person entitled to enforce an instrument (i) to pay

25 the instrument made to the drawee or a party obliged to pay the

1 instrument or, in the case of a note or accepted draft payable

2 at a bank, to the bank, or (ii) to accept a draft made to the

3 drawee. The Instrument was Accepted for Value and transferred , via certified mail #

4 60981410000012345678 to Internal Revenue Service Criminal Investigation Division (IRS) On

5 June 28, 2010 and was received June 30, 2010.

7 a) An instrument is transferred when it is delivered by a person other

8 than its issuer for the purpose of giving to the person receiving delivery

9 the right to enforce the instrument.

12 § 8. Obligation or other security of the United States

13 The term “obligation or other security of the United States” includes

14 all bonds, certificates of indebtedness, national bank currency, Federal

15 Reserve notes, Federal Reserve bank notes, coupons, United States notes,

16 Treasury notes, gold certificates, silver certificates, fractional notes,

17 certificates of deposit, bills, checks, or drafts for money, drawn by or upon

18 authorized officers of the United States, stamps and other representatives of

19 value, of whatever denomination, issued under any Act of Congress, and

20 canceled United States stamps.

23 The test adopted is that of sanction of government, whether by

24 authorization before issue or adoption afterward, which recognizes the

1 circulating medium as a part of the official currency of that government. The

2 narrow view that money is limited to legal tender is rejected.

3 U.C.C. 3-603: Tender of payment.

4 (a) If tender of payment of an obligation to pay an instrument is made

5 to a person entitled to enforce the instrument, the effect of tender is

6 governed by principles of law applicable to tender of payment under a simple

7 contract.

8 (b) If tender of payment of an obligation to pay an instrument is made

9 to a person entitled to enforce the instrument and the tender is refused,

10 there is discharge, to the extent of the amount of the tender, of the

11 obligation of an indorser or accommodation party having a right of recourse

12 with respect to the obligation to which the tender relates. (c) If tender of

13 payment of an amount due on an instrument is made to a person entitled to

14 enforce the instrument, the obligation of the obligor to pay interest after

15 the due date on the amount tendered is discharged. If presentment is required

16 with respect to an instrument and the obligor is able and ready to pay on the

17 due date at every place of payment stated in the instrument, the obligor is

18 deemed to have made tender of payment on the due date to the person entitled

19 to enforce the instrument.

In conclusion the instrument has not been discharged according HJR192 therefore I appoint
21 Tom B. Goins, Commissioner as beneficiary/Fiduciary and give you power of attorney to
