Measure to strengthen and to manage the wakf property & National Wakf Development

Prologue:

I am writing this article because people like me should get the basic idea that merely passing an act does
not mean it is being implemented so we need mechanism to do so. And this I took as an example what
an ideal corporation should have and what challenges does it have to face. As a future ias officer, we
should have a basic ideas. This thing can be applied to any govt. corporation once you understand the
Moto behind it. Hope you got my point.

It was in news because of inauguration of national wakf development corporation….First some basic
about wakf amendment

Wakf Property Amendment Act,2013

What is it??

Wakf property (def.):- when a muslim person dedicate or donate his property in name of ‘allah’ or under
religious faith and sentiment for using such property to uplifment of community

Original Act: wakf act 1954

Main point of act: to make force full entry or illegal i.e. encroachment of wakf properties a non-bailabe
offence and also lease period of this property is increase from 3yrs to 30yrs + people form local wakf
tribual will be empowered to throw the people out of this who using this land illegally

National Wakf Development corporation

Inaugurated in January . with an initial investment of 500cr. Corporation was started by the
efforts of the ministry of minority . why ???

In order to ensure implementation of wakf act and proper management of the wakf property + to bring
Transparency and Accountability. but we have local or regional body to do this so why national body?
Because even local body board member misuse wakf property for personal gain and it go undetected
because nobody will be watching them and asking them for accounts…..

It is this lack of accountability and transparency that leads to all kind of misuse of wakf property and
which lead to all kind of people in wakf board.

Some points about corporation :

 All india body more like an public sector

 it will lay a legal foundation to implement acts
According to sachar committee , proper management of this property would lead to generation of
1200cr per annum . Thus the sum generated could be utilize for improving the health and education
condition of the muslim community.

What should be the priority of corporation?

1. most of the muslim youth are dropouts. So to develop mechanism to bring about modern
education to the door step of muslims. Steps should be by govt. but with the help of wakf
property. Like school, college, etc
2. Health facility like clinic or hospital besides what govt. is doing

How it will generate money for this???

 Now as a corporate it can issue lease or bond on property, for period ranging from 3yrs to 30yrs
 large amount of wakf property is they which can generate revenue

Challenges before corporation??

 To sustain the corporation itself.

 Launching into new area of management.
 Making unused wakf property into areas such as educational institution, medical and health
facility.
 Given the large amount that it can generate (rs.12000), all kind of wrong people will be there so
tackling wrong people.HOW? it is the responsibility of government and good people= to identify
bad and corrupt people on board==?to make the process as transparent as possible and placing
the right people on board with impeccable integrity.
 Youth aspiration: all youth want to take part in organization for upliftment of their community,
so providing such a platform.
 Increasing community participation.
 Increasing awareness about wakf property related laws.
 Proper and efficient grievance redrassal mechanism for any complaint. (List goes on……I got
tired so I didn’t type)

Why govt. intervention was necessary?

Because property is being misuse by the very people who claim to represent it who have vested interest
in mind. Therefore govt. intervention is postitie thing and community people should corporate with gov.
for better governance and management of wakf property & for better resources regeneration

NOTE:

Don’t forget to add social angel like youth aspiration, community harmony. From economic point of
view add economics of scales.

Regional & language barrier: like people from north speak hind and most south people don’t.
