raped three (3) times. The Investigating Prosecutor conducting the preliminary
investigation filed a complex crime of Forcible Abduction with Rape against the three
(3) respondents. If you are the victim will you agree to the charge? Why? If you are
the counsel of the accused will you agree to the crime charged of your clients? Why?

F, a Municipal Treasurer of H Municipality altered the figure P3,000 in a Land Bank of

the Philippine Check to make it appear that the amount is P30,000.00 and then
encashed it with funds in his custody and thereafter misappropriated the amount of
P27,000.00.What crime is committed by F?
Explain your answer.

3) Juan was taken from his house by Pedro with the purpose of killing him. He was
taken to another barangay where he was killed. If you are the Investigator
conducting the Preliminary Investigation of this case, what crime/s will you file
against Pedro? Explain your answer.

X, after having a quarrel with his wife, got a bolo, ran amok and in the course killed
five (5) persons. Is X liable for five (5) counts of Murder and why?

Maria was convicted by the MTC of seven (7) counts of Grave Oral Defamation and
imposed upon her an imprisonment term of one (1) year for each count and an
accompanying fine of P800.00 for each count. His property is not sufficient to pay
the fine. Is he liable for a subsidiary penalty? If so, how much? Explain your answer.

What are the distinctions between Habitual Delinquency and Recidivism?

Jose was sentenced to suffer the following penalties for the following crimes:

l4 years for another Homicide
l7 years , 4 months and 1 day for another Homicide
12 years for Falsification.
How will he serve these several penalties and for how long? Explain your answer.

of City O. Said crime of Unjust Vexation will prescribe in two (2) months. To beat the
two (2) months prescriptive period when will U file the complaint before the City
Prosecutor’s Office?

Are the effects of a Pardon given by the President to an accused similar to the effects
of a Pardon given by the offended party? If not, can you state the distinctions?

K was given by the President a conditional pardon. He however committed violations

on the conditions imposed on him. What are the consequences, if any,
of these acts of K?
