1. You have committed misappropriation of the Endowment fee,


Affiliation fee and Renewal of Affiliation fees of Rs. 7,50,000/-
and Rs. 1,10,000/- in the form of cash from viz.,
LathaMathavan Arts & Science College, Madurai and Nazia
College of Arts& Science College, Kariapatti respectively.

2. You have committed forgery without collecting Endowment fee


and Affiliation fee, you had created a file and obtained the order
of Affiliation and the same order was issued to the college
without any orders from the Authorities and you have received
hard cash from the said colleges.

3. You have committed misappropriation of the Endowment fee,


Affiliation fee and Renewal of Affiliation fees of Rs. 7,50,000/-
and Rs. 1,10,000/- without paying the said fees towards the
University Account.

4. When the Letter from the Management of collegesdated


20.02.2016 and 08.03.2016 was received by the University
seeking receipt for the payment of Rs, 7,50,000/- and Rs,
1,10,000/- respectively for the Endowment fee and Affiliation
fee towards the College.The university came to Know about the
fraud played by you on the part by getting the amount in person
without receipt in order to cheat and embezzle the amount
belong to the University.

5. You have committed gross dereliction in your duty and grave


misconduct in your responsibilities by misappropriating
Endowment fee, Affiliation fee and Renewal of Affiliation fees of
Rs. 7,50,000/- and Rs. 1,10,000/- without remitting the same
to the University Bank Account.

You are directed to submit your explanation as to why


appropriate disciplinary action shall not be taken on you for the
above charges of misconduct, dereliction of duty and breach of
discipline within a period of 7 days from the date of receipt of
this memo.

If no explanation is received within the said period it would be


deemed that you have no explanation to offer and appropriate
further action would be taken in this regard.

forgery. Those offences come under moral turpitude. So
Management of Madurai Kamaraj University had suspended you
on effect from 20.08.2015 vide this office memo cited
No.Estt.IV/4/2015 dt: 11.12.2015 based on the letter received
from The Inspector of police, Nagamalai Pudukottai Police
Station. It is grave criminal charge,

Renganathan, but till date Establishment Disciplinary
committee not convened.

4) As per order dt: 23.09.2015 , salary has been stopped


temporarily from September’s 15 on based of the criminal case.
As per F.R.53(1) (a)(i), the subsistence allowance at an amount
equal to half of the pay last drawn by the government servant
and in addition dearness allowance. The subsistence allowance
submitting letter that, he is not engaged in any other
employment, business, profession or vocation.
5) Based on FIR filed under section 406,420,468,506(i) of IPC
against you so the Management of colleges come to the
conclusion .The university came to Know about the fraud played
by you on the part by getting lakhs of money to get the job in
the University in order to cheat and embezzle the amount
belong to the University.

You are directed to submit your explanation as to why


appropriate disciplinary action shall not be taken on you for the
above charges of cheating, criminal breach of trust and forgery

PERIYASAMY V

18.10.2013 :G.O.(MS).No 164 Highways and Minor Ports


(HP2) Department issued by the
1st respondent state government. According to
administration sanction for the acquisition of
lands to form ring road at Karur.

The ring road is proposed as


bypass starting from Km 224/2 of NH
67(thaineerpandal) crossing Eroad road near,
Kuttakadai, salem, NH road Near semadai
and pass through Ellaimedu, Othakadai,
ThiruMukadulur, Somur and joints with NH
bypass at 203/530 of NH 67
near Veerarkkiam.

Its total length would be 27.50 Km also it


is proposed to form an approached road for
4.06 Km on the west side of vanagal town to
join the proposed ring road.

22.12.2014 : Subsequent to above government order


3rd respondent District Collector, Karur
District. Formed an alignment committee to
finalized the route of the ring road and said
alignment committee meet on 22.12.2014 to
review and finalized the alignment and
acquisition of lands for the ring road.

2015 :To bridges viz one Amaravathi river from


Melapalayam to koyampalli under NABARD
scheme for sum of 11 cores and another
bridge Mohanoor to Vangalkuppuchipalayam
was constructed across river Cavery in the
cost of 25 crores has been constructed.

However due
to non-formation of the ring road and
approached roads to bridges. Both the
bridges are not in usage its lead to heavy
traffic conjunction inside the city.

The
authorities (Assistant divisional engineer )
Highway department specialized Tahsildar ,
land acquisition, surveyor and concerned
villager administrative officers had conduct
survey in all the 14 villages for proposed of
constructing ring road.

22.05.2017 : Proceeding of the 3rd respondent (Divisional


Engineer ) saying that already route
alignment has been finalized and
communicate to district revenue officer on
18.03.2015 for action.

The land acquisition proceeding has


commenced by appointing two
specialized Tahsildar.

That section 15 (2) schedule has been issued


with respect to 4 villages out of 14 villages
and has been sent to district revenue officer
for approval.

That for the remaining 10 villages proportion


section 15(2) schedule by
special Tahsildar Unit 1 and 2 under process.

That after completion of land acquisition


work ring road will be formed.

28.02.2017 and 04.04.2017 representation


submitted by C.PERIYASAMY in view of non-
formation of the ring road.

07.07.2017 : The order in W.P(MD).No 6490 of 2017


disposal of the writ petition. The operation
portion of the order reads as below

“2. The learner special government pleader


on instruction submit that authority conduct
the survey of 14 villages purpose of construct
ring road from Karur.

3. since the government have already


initiated the action to form the ring road. As
indicate in G.O. 164 Highways and Minor
Ports (HP2) department date 18.02.2014. No
further order is necessary for the matter we
direct the respondent to expedite the process
of construct ring road.

The writ potion disposed of above direction no


cost.”

W.P. 12301 OF 2017 : Filed by K.K.Thangaraj praying to direct the


respondentnot to form the approach road on
the western side of the Vangal town, Karur,
instead of from the alternate approach road
as suggested by the petitioner.

4th respondent herein – C.PERIYASAMY has


filed a impending petition vide W.P.(MD).
No 10815 of 2017. Writ pending neither
notice has been ordered in writ potion nor it
was admitted it was simply adjourned and
pending.

06.10.2017 Petitioner representation to respondent


alleging Malafide in the alignment and the
allege alignment is without proper survey and
not as per the guidelines of Ministry of Road
Transport and Highway and Indian Road
Congress. A further allegation is that present
alignment is benefited to the real estate owner
who owns more than 100 acres of land in
Kuppichaipalayam village.

A further claim is that the approach road on


the western side Vanhal town connecting the
bridge across Cauvery and Amaravathi and
joints proposed ring road near Elliamadu is
nothing but second ring road is unnecessary.
Further, he suggests the separated
alignment.

W.P. 19419/2017 :The present Writ Petition Seeking for issuing


of Writ of Mandamus directing the respondent
to form the ring road at Karur as per G.O. No
164 dated 18.10.2013 by realigning the plan
based on the petition represented dated
06.10.2017.

Although the alignment is malafide, there is


no specific detail or materials to support that
the alignment is benefited to real estate
owners having more than 100 acres in the
Kuppachipalayam Village.

He has not raised any ground of Statutory


violation or non-observation of the mandates
etc.

Although the alignment of Highway is highly


technical in nature has to be done by the
technical experts and the competent
authority the Petitioner himself proposed the
alignment and seeking to implement the
same.

09.02.2018 : 4th respondent C.PERIYASAMY implied as


part in the present Writ Petition.

W.P (MD) 3106/2018 : As there was a reason to apprehend that the


respondent in taking a step to realign the
existing plan to support W.P (MD)
19419/2017. The 4threspondent
C.PERIYASAMY was file a W.P 3106/2018
seek for the issuance of a Writ of Mandamus
directing the respondents to propose ring
road for Karur from Km 224/2 of NH 64 road
( ThaneerPandhal) and joining at Km
203/530 of NH 67 road nearVeerarkkiam as
per G.O. 164 dated 18.10.2013 passed by
1st respondent as per the original proposed
route without any deviation or realignment.

15.02.2018 : The Order of W.P. 3106 of 2018 W.P closed


operating party read as below. Paragraph No
8 and 9.

“8. The
3rd respondent in the counter affidavit took a
stand that the Technical Committee approved
the alignment and as per the procedure in
place, for new highways project, normally two
or three alignment has been taken for study
of various aspects such as length, built up
stretches, crossing of existing highways and
Railways, usage of Government land, existing
monuments & Temple, education institutions,
nsture of geography etc., by comparing merits
and demerits of the alignments, the technical
committee approved the best alignment with
very minimal damage to the properties of the
residents and minimum length so as to
minimize the project cost.”

“9. It is also
pointed out by the 3rd respondent that if the
alignment is proposed by the appellant/writ
petitioner is to be considered by crossing
location at existing State Highways at four
locations and ODR will also be shifted and
will affect the existing built-up stretches,
education institution and others which
means by avoiding a single well may lead to
damages numerous buildings. ”

On 5.01.2018 written letter sent to V,ramakrishnan by the school
authority it stated that we received your letter. In
the letter you mention that some extra time of 10
days needed. When you received document from
my son and president of the school
Mr.Arunpothhiraja has been verified by you and
your wife. But in this letter you stated the
document are not clear and visible to read. We have
photo proof in this situation you are wontedly
making delay . anyway you request us for some
time so we agree with it . on 16.12.2017 if you fail
to give explanation we will take disciplinary action
has been taken without your side explanation

on 22.11.2017 I got suspend and many false allegation was
charged against me, so due to the stress my health
condition got poor and mental agony. I have not
received subsistence allowance December 2017 and

even my medical expense also depend on it. So I
request you to settle my arrear of by salary.

the school department , so we are not satisfied with
it. So me we decided to frame enquire committee.
23.01.2018 written letter sent by V,ramakrishnan to the school
secretary I received your letter on 20.01.2018. you
stated that its allegation against on the school
department. Sir you are secretary of the school and
you have power and liabilities to deal with dispute
raised by or on staff. So only I raised the issue. Its
does in mean that allegation against on the school
department.
24.01.2018 written letter sent to V,ramakrishnan by the
school secretary I received your letter on
24.01.2018 I treat all staff as my family member
even you, me and my son we are not dictator . if my
son commit any mistake I am ready to place him
before the enquire committee . in your privies letter
you request that your son education depend on
salary . we kindly informing you that we requested
district education officer about your salary amount
pending .
Letter to D.E.O 1.02.2018 Respected sir I am workin in the school as a
drawing teacher . false allegation was charged
against me so I got suspended on 27th November
2018 .D.E.O agree with it. But I won’t get any
photocopy of the document, I noticed it on
27.12.2017.charge memo photocopy. . I have not
received subsistence allowance December 2017 and
monthly salary on November 2017. So I kindly
request you to take a proper action on this issue.

gopalakrishna Higher Secondary school, president , Mr.Arunpothhiraja )
The address for service of summon and notices to the Defendant
(V,ramakrishnan).
Plaintiff stated that school was established on 1943 has a good reputed
name amount for past 74 years.staff meeting was arranged on 22.11.2017
by plaintiff, in which the defendant dominant behaviors in the meeting.
Further scolded the respectable head mastress Mrs. Anis Fathima and other
teacher with abused words.
Due to the immoral activities notice was issued to the defendant on
22.11.2017 to show cause against the charges. Further disciplinary
committee has suspended the defendant till the completion of disciplinary
proceeding.
Plaintiff stated that defendant sent an undated representation to D.E.O
,Madurai , wrong defamatory allegations against the school. Defendant
further stated that alleged the plaintiff demanded monetary contribution
from the teachers for that one Mrs.Packiyam has opposed the same and it
led to a dispute between the plaintiff and said packiyam. Defendant alleged
the defendant interfered into the conversation between the plaintiff and
packiyam and for the same defendant were abused ,pulled down and
assaulted by the physical education teacher Mr. Thiyagarajan and the
plaintiff. Defendant made specific allegation against the plaintiff that the
kused to call the defendant with the defendant caste name as ‘Ayyar’ Oh
Ayyar which are totally baseless and false.
Hence the plaintiff called upon the defendant by issuing legal notice and
inviting him to give written apologize to the plaintiff and issue written
representation to the D.E.O and C.E.O ,Madurai as against the defamatgory
allegations spread by the defendant, within fifteen days from the date of
receipt of the notices and pay Rs. 25,00,000/.toward the compensation for
the defendant deframatory act against the plaintiff and school aor otherwise
the plaintiff will constrain to initiate civil and criminal action agains
defendant sent a reply with untenable and falsehood statement against the
plaintiff.
Hence the defendant sent a replay with untenable and falsehood statements
against the plaintiff.the plaintiff restriction to the claim of damages to
Rs.5,00,000.00
Cause of Action
Therefore the plaintiff prays that this Hon’ble court may be pleased to pass
judgement and decree infavour of the plaintiff
a) By ordering the defendant to pay sum of Rs.5,00,000.00 as damage
for the defamation caused upon the plaintiff.
b) And pass such other or further orders as this Hon’ble court may deem
fit and proper under the circumstances of this case.
c) And direct the defendant to pay the cost of this suit.

on 22.11.2017 I got suspend due to false allegation was


charged against me without proper reason
and evidence. it was deal by previous D.E.O .
Even I sent a letter to current D.E.O of you .
I made a schedule to listed out the letter and
documents.
11.02.2018 on F.I.R was failed against me under IPC
sections by president , Mr.Arunpothhiraja in
thalakulam police station. I cause me body
and mental illness , now my economic level
very poor I am not able to file anticipate bail.
on 22/23.02.2018. I received your letter in this letter you
mention that I made a false allegation so only
previous officer Ms.J.Anandavalli move out
from the enquiry committee . its totally false ,
she send me the letter due to some personal
reason I moving out from this enquiry
committee. Without the enquiry you stating
this issue not acceptable. Now my economic
level very poor so I am not able to pay new
officer.
