Name & Office: Clark Duffe, Independent / Libertarian, U.S. Congress, District 5, Oklahoma

1.1 What are your thoughts concerning the USA PATRIOT Act, and its implications for citizens of
Oklahoma?

“A dangerous bit of work. Filled with little nasties that most people don’t know about even today.
Implications are a growing, intrusive police state.”

1.2 What is your opinion regarding the 4th Amendment to the United States Constitution and how
it applies to technology in modern society?

“It should apply to technological advances the same way it applies to documents, etc., which were around
when the Constitution was written.”

1.3 What is your opinion on any law that would require electronic communication providers
(Example: ISPs, cell phone, TV) to monitor activities of Oklahomans, keep a log/database of this
information, and make it available to legislators or law enforcement officials upon request. Should
a warrant be required to initiate collection of such information, or should companies be required
to keep logs of all users and pass on collected information after a warrant has been issued?

“That would be a bad, bad law. Warrants should be required to collect data or information already held by
a company; warrants should not be used to require a private company to do the police’s job of gathering
data.”

1.4 In your own words, how would you define the concept of privacy and its application in context
of the Constitution of the United States of America?

“Privacy is the right to be left alone; to be secure within boundaries of own life and actions. For the
government to pry into the lives of its citizens, it must first justify those actions by obtaining the approval
and consent of a judge.”

1.5 Please feel free to add any comments regarding your position on issues dealing with privacy
that are affecting the people of Oklahoma. If running for re-election please include examples of
bills that you have supported or opposed that would have affected the privacy rights of
Oklahomans.

“What a person does in the privacy of their own home (or other consenting location) – as long a s it does
not harm others against their will – should be of no concern to Government.”

2.1 What are your thoughts on recent legislation passed by states making it a crime to videotape
law enforcement officials in public places?

“These laws should be immediately revoked.”

2.2 What are your thoughts regarding the recent Wikileaks exposure of Military Documents?

“Wikileaks should not be held liable, it is a legitimate function of the media to present data they receive.”

2.3 What are your opinions regarding current regulations regarding lobbying? What are your
plans for making sure that your time in office will be as transparent as possible?
“Lobbyists should be required to report all expenditures on government officials. Every dime or item given
to me or any one of my staff will be reported online.”

2.4. Please feel free to add any comments regarding your position on issues affecting
transparency that are facing the people of Oklahoma. If you are running for re-election please
include examples of bills that you have supported or opposed that would have affected
transparency in Government.

“We need to make sure that our open meetings and open records laws are being followed to the letter.”

3.1 What is your opinion regarding research being done in the United States using public
funding? Should the data obtained through research that is financed with public funding be
available for use by all US agencies? Should private citizens have access to data obtained with
public funding?

“With very, very few exceptions of extreme national interest – which I can’t think of right now – publicly
funded research should be readily available to U.S. agencies and private citizens.”

3.2 How do you feel bio-patents affect Oklahoma's ability to stay competitive as an agricultural
state?

“Biopatents are worrisome. They can hide the dangers of certain new biological products – such as
damaging cross-pollination effects – and squeeze out conventionally produced hybrids. Oklahoma
farmers can be coerced into using products of major agri-industrial companies, then effectively left
“addicted” to the products, unable to return to previous seed types.”

3.3 What are your thought regarding the current Anti-Counterfeiting Trade Agreement (ACTA)
currently being negotiated between the USA and other nations?

“I don’t know enough about it, but my initial response would be to be very suspicious of it. These are
usually designed to benefit large corporations over smaller companies.”

3.4 What are your thoughts regarding the passage of the Digital Millennium Copyright Act (DMCA),
especially its implications regarding Fair use?

“Again, no expert, but it seems designed to restrict Fair Use in at least some ways, which would be
detrimental to private users.”

3.5 Please add any final thoughts you might have regarding patents, copyrights, and fair use.
