Requirement to provide personal identifiers (biometrics) for the purposes of section


40 of the Migration Act 1958 (the Act) in regard to your Student (Temporary) (class TU)
Student (subclass 500) visa application

In the following information, when we say ‘you’ we mean all applicants listed below.

Offshore visa applicants in selected overseas locations need to provide personal identifiers in
the form of fingerprint scans and a digital facial photograph.

Under section 257A and for the purposes of section 40 of the Migration Act, I require each
applicant listed in the table(s) below to provide personal identifiers in the form of fingerprint
scans and/or a digital photograph of their face and shoulders by attending a Visa Application
Centre or Biometrics Collection Centre within 14 days after you are taken to have received
this letter.

The only fingerprint scans and facial photographs that will be accepted are those taken by
staff at a Visa Application Centre or Biometrics Collection Centre.

If you have been required by a delegate to provide your personal identifiers under section
257A of the Migration Act, and you do not comply with the requirement, nor has the
requirement been withdrawn, then your visa application must be refused under section 65 of
the Migration Act because the grant of a visa is prevented under section 40 of the Migration
Act.

Providing personal identifiers


In order to provide personal identifiers, all applicants listed above need to attend a Visa
Application Centre or Biometrics Collection Centre in person with this letter and a current
passport for each applicant. You should make an appointment prior to attending the Visa
Application Centre or Biometrics Collection Centre.

You should provide your personal identifiers before you travel to Australia. If any of the
applicants listed above are unable to provide their personal identifiers for any reason, contact
the office processing your application as soon as possible.

Biometrics provision for minors


The following arrangements regarding minors (applicants under 18 years of age) included in
the application. Depending on the age of the minor(s) at the date of biometrics collection, the
following biometrics provision guidelines apply:

● minors aged less than five years may be required to provide a photograph of their face
and shoulders only; and
● minors aged five years and over but less than 18 years may be required to provide their
fingerprints and a photograph of their face and shoulders.

Minor applicants are required to provide personal identifiers in the form of fingerprint scans
and/or a digital photograph of their face and shoulders (depending on the age of the minor
as described above) by attending a Visa Application Centre or Biometrics Collection Centre
within 14 days after you are taken to have received this letter.

Under Policy, the presence of a parent or guardian is required before personal identifiers are
collected from minors aged less than 16 years.

Biometrics provision for incapable persons


If someone included in this application is an 'incapable person' contact this office.

An ‘incapable person’ means a person who does not have legal capacity to understand the
significance of a requirement to provide a personal identifier; this includes the general nature
and effect of, and purpose of, a requirement to provide a personal identifier. For example,
someone with an intellectual disability. Evidence may need to be provided that they are
considered an 'incapable person'.

The following arrangements apply to ‘incapable persons’:

● a photograph of their face and shoulders only will be taken.

Under policy, the presence of a parent or guardian is required before personal identifiers of
incapable persons are collected.

Processing your application


While every effort is made to process visa applications as quickly as possible, until all
applicants listed above have provided personal identifiers this application may not be
finalised.

The provision of personal identifiers is only one of several stages in the visa assessment
process. As I have required you to provide personal identifiers, compliance with this
requirement will assist us to process your application as quickly as possible.

Additional Information
Applicants who have spent 28 days or longer in the countries listed below since 5 May 2014
should provide a current polio vaccination certificate. This is in response to the World Health
Organization’s declaration of a Public Health Emergency of International Concern, noting
recent outbreaks of polio in these 9 countries.

If you have not yet provided the department with a current certificate of vaccination
against polio with your visa application, you should bring the certificate to your biometrics
appointment. If you do not provide the vaccination certificate, the processing of your
application may be unnecessarily delayed.
