Chu v.

• • Agustin Chu retired from Victorias Milling Company, Inc. upon reaching the
age of 60, under its regular retirement program.
• • He was granted an extension of service by the Board of Directors under a
“Special Contract of Employment”, where he was employed as Head of the Warehousing,
Sugar, Shipping and Marine Department.
• • Respondent issued 2 memoranda providing a rotation of the personnel and
other organizational changes. Petitioner was transferred to the Sugar Sales Department.
• • Chu protested his transfer contending that he was constructively dismissed
from his employment.
• • Moreover, he contends that it violated the “Special Contract of
Employment” which is the law of the parties, and that it was unreasonable and
caused inconvenience.
