Subject: Request for promotion to the Rank Head Constable.

Vide PUC placed below, Constable Mubark Ali No.766/PWL has
requested that he was recruited as Constable in Haryana Police on 10.06.2007. Due to his
performance, he has earned 18 good entries in his Ch. Roll not even a single bad entry. He
passed the Lower School Course in batch No.60 in the year 2014. List C granted to him on
26.12.2014. When he was posted as Munshi in Anti Vehicle Theft, Sector-2, Palwal, a case FIR
No.202/2016 u/s343, 34 IPC Police Station City Palwal was registered against him on
01.04.2016 which is subjudice in the Court A departmental enquiry was also ordered against
him. He was awarded a punishment of stoppage of one annual increment with permanent effect
vide order dated 10.04.2017 in said Departmental enquiry. Now currency period has been over
and requested for promotion to the rank of Head Constable.
Brief facts of this case are that while the representationist alongwith
his co-defaulter namely SI/ORP Mohd. Illyas No.1057/FBD were posted in Anti Vehicle theft
Staff, Palwal as Munshi and In-charge respectively, a raid from the team deputed by Hon’ble
High Court of Punjab & Haryana, Chandigarh was conducted at Anti Vehicle Theft Staff, Palwal
on 01.04.2016. A person namely Narain Son of Shri Ram Rattan, resident of village Fatehpur
Billoch, district Faridabad was found illegitimate detention in Anti Vehicle Theft Staff, Palwal for
the period from 28.03.2016. A regular departmental enquiry was ordered against both the
delinquent officials by the then SP/Palwal vide his office order No.5047-54 dated 01.04.2016.
Meantime, one delinquent official SI ORP Mohd. Illyas No.1057/FBD was transferred from
district Palwal to Commissionerate, Faridabad and departmental enquiry file was also sent to
Faridabad for taking further necessary action. Whereas the representationist was awarded a
punishment of stoppage of one future annual increment with permanent effect by the punishing
authority i.e. SP/Palwal vide order No.1682-86/Steno dated 08.11.2016. Aggrieved with the
punishment order, he has filed an appeal. The then IGP/south Range Rewari has set aside the
punishment order and further directed to pass a fresh order by following due procedure in the
said departmental enquiry. On the aforesaid direction, SP/Palwal has got enquired the matter
and a punishment of stoppage of one future annual increment with permanent effect was
awarded by the punishing authority vide order No.420-24/Steno dated 10.04.2017. Appeal
against the said order has been rejected by this office order 4759/A-2 dated 26.04.2017. His
name for promotion to the rank of officiating Head Constable was considered alongwith his
batchmates of 60 batch. But due to under currency and a criminal case pending against him, he
was not promoted.
Now, he has submitted his representation addressed to Grievances
Redressal Cell for promotion to the official Head Constable.
If approved, file may be moved to Grievances Redressal Cell.
