20 1. The events alleged herein occurred at all times within the District of this Court, County of
21 Orange, and State of California.

2. Plaintiff Farshad Saghatchi, D.D.S., Inc. (“Plaintiff”) is a California Corporation duly
23
organized and existing to do business in the County of Orange, State of California.
24
25 3. Defendant Habibullah Rahmani (“Defendant”) is a natural person who resides within the

26 County of Orange, State of California.


27 4. This Court has subject-matter jurisdiction over all claims in this action.

1 5. This Court has personal jurisdiction over Defendant, pursuant to Cal. Code Civ. Procedure
2 § 410.10. Defendant, through his false internet postings, manifested an intent to target and
3
focus on Plaintiff’s business reputation. Therefore, Plaintiff’s business located in Orange
4
County, California is directly impacted and injured by Defendant’s wrongful actions.
5
6 6. Venue is proper in this court under Cal. Code Civ. Procedure § 359(a), as this action

7 concerns injuries to Plaintiff’s business reputation and the injuries occurred in Orange
8 County, California.

FACTUAL BACKGROUND

12 Plaintiff’s Internet Reputation is Key to its Success

13 7. Plaintiff is a highly-acclaimed dentistry business founded by dentist Dr. Farshad Saghatchi,


14 D.D.S. (“Dr. Saghatchi”), and has enjoyed a good reputation as a dental practice.

8. Because of the nature of Plaintiff’s business, the internet is a key means of attracting new
16
clients. Upon information and belief, Plaintiff’s clients research Plaintiff on the internet to
17
18 determine, among other things, if there is negative information published about plaintiff,

19 and whether they want to do business with Plaintiff.


20 9. Because of its clients’ reliance on the internet as a means of researching Plaintiff,
21
Plaintiff’s internet reputation and those of its principals are extremely important to their
22
business. Plaintiff has invested substantial amounts of time and money to build and
23
24 maintain its internet reputation.

25 10. As a result of Plaintiff’s efforts to develop its internet reputation and presence on social
26 media, Plaintiff has become successful in a highly competitive and fast moving dentistry
27
industry. Plaintiff regularly uses its name and those of its principals in commerce.

2 11. Defendant has published false and misleading information on the internet concerning

Plaintiff and its principal, Dr. Saghatchi, in order to damage Plaintiff’s reputation on the
4
internet.

6 12. Specifically, on or about November to December of 2008, Defendant used his first name to

7 publish a complaint on www.ripoffreport.com about Plaintiff (hereinafter “Ripoff Report”)


8 13. The complaint, entitled “Laguna Hills Dental Care – Dr. Farshad Saghatchi $$$Con Artist
9
Dentist$$$ ILLEGAL Work Ethic. No Concern for Patient Well-Being. Laguna Hills
10
California” was published at the following url:

14. Attached and incorporated herein as Exhibit “A” is a true and correct copy of the Ripoff
16
Report.

18 15. In the Ripoff Report, Defendant made a number of false statements and insinuations

19 regarding Plaintiff and its principal, Dr. Saghatchi. These false and defamatory statements
20 include that:
21
a. Plaintiff and its principal engaged in “ILLEGAL Work Ethic” (Ex. A at p. 1);
22
b. Plaintiff’s principal Dr. Saghatchi “displayed a behavior of dishonesty; (Id at p. 2)”
23 and
24 c. Plaintiff’s principal Farshad Saghatchi “was unethical and unprofessional” (Id at p. 3)
25 d. Plaintiff’s principal Farshad Saghatchi “is a Con-Artist”.
26 16. The Ripoff Report is unquestionably false and misleading. First, Plaintiff fulfilled all of his
27
obligations under the contract with Defendant and in no way acted unethical,

1 unprofessional, dishonest, or engaged in any sort of illegal conduct with respect to the
2 services that were rendered for Defendant.

17. The Ripoff Report has caused and continues to cause significant harm, as it acts as a
4
deterrent to retain current clients and to attract prospective clients.

6 18. Given that Plaintiff’s internet reputation is a significant part of its business, the false,

7 misleading, and defamatory complaint posted on www.ripoffreport.com is particularly


8 damaging.
9
19. Upon information and belief, potential clients have read the Ripoff Report described above,
10
and then decided not to do business with Plaintiff as a result of the false and misleading
11
12 posting.

13 20. As a result of Defendant’s illegall publication of false information on the internet,


14 prospective clients seeking to employ Plaintiff for dentistry services now encounter
15
Defendant’s false and misleading statements on www.ripoffreport.com, forever poisoning
16
clients’ impressions of Plaintiff and the services it offers. Plaintiff’s name, along with that
17
18 of its principal, are continually linked to the word “ripoff” and Defendant’s false

19 allegations.
20 21. The false and misleading statements Defendant made in the Ripoff Report about Plaintiff
21
and its principal will remain on www.ripoffreport.com- and thus, the internet – in
22
perpetuity, forever damaging Plainitff.
23
24 22. Unquestionably, these false, misleading, and defamatory statements have irreparably

25 harmed Plaintiff and will continue to cause considerable damage to Plaintiff’s business, due
26 to the willful and malicious conduct of Defendant.

4 23. Plaintiff incorporates by reference paragraphs 1-22 as though fully set forth herein.
5 24. Defendant has published unprivileged false statements on the internet regarding Plaintiff,
6
viewable to at least one third party.

25. Defendant’s published statements are false and actionable statements, and Defendant is at
8
9 fault for publishing the statements.

10 26. The published statements were made with the requisite intent by Defendant to irreparably
11 harm Plaintiff and its principal’s business, trade, occupation, and reputation.
12
27. Defendant’s published statements were made with knowledge of their falsity, which
13
constitutes actual malice.
14
15 28. The published statements about Plaintiff, including that its principal engaged in

16 “ILLEGAL” conduct, are defamatory on their face, were obviously hurtful to Plaintiff, and
17 constitute defamation per se.

29. Defendant’s unlawful conduct has caused and will continue to cause Plaintiff irreparable
19
injuries for which there is no adequate legal remedy. Accordingly, Plaintiff is entitled to
20
21 permanent injunctive relief.

22 30. As Defendant has placed Plaintiff’s reputation publicly at issue, Plaintiff is entitled to a
23 declaratory judgment that Defendant’s statements are false and defamatory.

4 31. Plaintiff incorporates by reference paragraphs 1-30 as though fully set forth herein.
5 32. Defendant has published false information on the Internet, viewable to at least one third
6
party, including potential clients for Plaintiff.

33. The statements published by Defendant – as described in paragraph 15 (including that
8
9 Plaintiff engaged in “ILLEGAL” conduct) – are false and/or misleading, and are actionable

10 statements.
11 34. The published statements disparage the nature and quality of Plaintiff’s services.
12
35. Defendant intended to cause harm to Plaintiff and its principal, or should have recognized
13
the harm likely to be caused by the publication of such false and misleading statements.
14
15 36. Defendant’s published statements have, in fact, irreparably harmed Plaintiff’s reputation

16 and business.
17 37. Defendant’s unlawful conduct has caused and will continue to cause Plaintiff irreparable
18
injuries for which there is no adequate legal remedy. Accordingly, Plaintiff is entitled to
19
permanent injunctive relief.

21 38. As Defendant has placed Plaintiff and its principal’s reputations publicly at issue, Plaintiff

22 is entitled to declaratory judgment that Defendant’s statements are false and defamatory.

1 40. The ongoing nature and damage resulting from the defamatory posting on
2 www.ripoffreport.com is of such a nature that Plaintiff is without an adequate legal remedy
3
at law.

41. As a result of Defendant’s acts as described above, Plaintiff suffered and will continue to
5
6 suffer irreparable harm. Unless enjoined by this Court, Defendant will continue to cause

7 irreparable harm to Plaintiff.


8 42. Plaintiff is entitled to a permanent injunction against Defendant; ordering Defendant to
9
remove and retract the Ripoff Report; and to enjoin Defendant from creating and
10
publishing further defamatory statements against Plaintiff.

13 FOURTH CAUSE OF ACTION

16 43. Plaintiff incorporates by reference paragraphs 1-42 as though fully set forth herein.
17 44. A controversy now exists between Plaintiffs Defendant as to whether the statements by

Plaintiff in the Ripoff Report are false and defamatory.

45. For these reasons, judicial intervention is necessary in the form of an Order declaring that
20
21 Defendant’s Ripoff Report post is false and defamatory.

22 PRAYER FOR RELIEF


23 WHEREFORE, Plaintiff prays for judgment against the Defendant as follows:
24
1. Judgment in favor of Plaintiff against Defendant in an amount to be determined at trial;
25
2. Permanent injunction that issues the following orders against Defendant Habibullah
26
27 Rahmani, his agents, officers, members, managers, employees, representatives, and co-

28 conspirators (“Restrained Parties”):

1 i. Prohibiting the Restrained Parties from any further acts of defamation or publication
2 of the same or similar false statements, reviews, advertisements, comments, or
3
information regarding Plaintiff on Ripoff Report or other public-facing websites;

ii. Mandating that the Restrained Parties take all actions to remove the defamatory,
5
6 disparaging, libelous, and false statements about Plaintiff that Defendant Habibullah

7 Rahmani posted on the internet, including, but not limited to those found in the
8 following URL: https://www.ripoffreport.com/reports/laguna-hills-dental-care-dr-
9
farshad-saghatchi/laguna-hills-california-92653/laguna-hills-dental-care-dr-farshad-

saghatchi-con-artist-dentist-illegal-work-eth-401729; and

12 iii. Mandating that, as it is foreseeable that the above-referenced URL to the Ripoff

13 Report and statement contained therein will be referenced or additional webpages in


14 the future, including but not limited to, index, directory, and search result pages, to
15
take all actions, including requesting removal from the internet search engines such
16
as Google, of all such webpages.

18 3. Declaratory judgment that Defendant Habibullah Rahmani’s statements in the following
