Re: Complaint/Demand for License Suspension

Dear Texas Commission on Law Enforcement:

On September 6, 2018 at or about 9:59 p.m. officer Amber Guyger, badge number 10702, did
unlawfully and without cause enter the apartment of civilian Botham Jean and with her firearm did
shoot Botham Jean causing his death.

Officer Amber Guyger did exhibit blatant and gross misconduct by entering the apartment of a civilian
without proper authorization and causing the murder of the rightful inhabitant, more specifically
Botham Jean, by discharging her firearm and causing the untimely death of Botham Jean.

Subsequently, on September 9, 2018, Amber Guyger was arrested and charged with felony
manslaughter. Shortly thereafter, on September 24, 2018, after an Internal Affairs investigation, Chief
Renee Hall terminated Amber Guygers employment with the city of Dallas as a police officer after an
internal affairs investigation found the officer engaged in 'adverse conduct.' As a result, Amber
Guyger's actions constitute an “immediate peril to the public safety and welfare if she were to remain
licensed during the pendency of criminal proceedings.”

It is well settled, The Texas Commission on Law Enforcement Statues and Rules handbook
provides under Administrative code 223.18 Suspension Following Felony Arrest that:

The commission through the executive director, may suspend the license of a person arrested or
indicted for a felony offense which would constitute an immediate peril to the public health safety
or welfare if the person were to remain licensed during the pendency of criminal proceedings.
By virtue of their nature, the following felony arrests constitute immediate peril:

(1)Sexual offenses
(2)Assaultive offenses
(3)Offenses classified under Chapter 39 or section 31.03 of the Texas Penal Code.

Accordingly, Amber Guygers actions caused an immediate peril to Botham Shem Jean and continue to
cause an immediate peril to the public health and safety of the citizens of Dallas, Texas.

As such, the charge of Felony Manslaughter extends well beyond the scope of 'assaultive offenses' and
for this reason Dallas Communities Organizing for Change is seeking the suspension of Amber Guygers
Law Enforcement Officers Certification/License.

Conclusively, it is demanded a summary suspension order be issued to Amber Guyger with a notice to
initiate suspension proceedings within 30 days of the commissions order on behalf of the citizens of
Dallas, Texas.
