TEMPORARY SEPARATION AGREEMENT,
THIS TEMPORARY SEPARATION AGREEMENT is entered into this_day of
, 2018, by and between KATRINA N. BAKER (“Wife”) and TERRY LEE
BAKER (“Husband”).
EXPLANATORY STATEMENT
‘The parties were lawfully married in 1992, in Lexington, Kentucky
Differences have arisen between the parties and they are now living separate and apart
from one another, voluntarily and by mutual consent in separate abodes, without cohabitation,
with the purpose and intent of ending their marriage.
NOW, THEREFORE, in consideration of the promises and mutual covenants and
understandings of each of the parties, the parties hereby covenant and agree as follows, all as of
the effective date hereof.
1. On or about July 24, 2018 Wife filed a petition for an order for protection from
domestic violence styled Baker v. Baker, D-112-FM-18-000708. On or about July 26, 2018
Wife dismissed the Petition in consideration of the promises and covenants contained herein, and
shall not reinstitute a petition based upon those grounds while this agreement is in effect. On or
about July 26, 2018, Husband and Wife mutually and voluntarily agreed to terminate their
marriage and thereafter to live separate and apart without any cohabitation. The parties agreed
that neither party would harass the other or attempt to have sexual relations or demand the right
to reside with the other. The parties agreed that each was thereafter to be free from any control,authority, restraint or interference, direct or indirect, by the other party, and each would reside
separate and apart from the other at such place or places as he or she may elect,
2. Neither party shall speak further to the media about any matters related to the
Husband’s and Wife’s relationship.
3. Neither party will initiate contact with the other, in person, by phone, by text or other
electronic communication, by written communication, or through a third person other than the
parties’ attorneys. Neither party will conduct any surveillance of any kind of the other party
either personally, through a third party, or by electronic (GPS, telephone or smart device
tracking, vehicle trackers, or any other device) means. If Wife needs to be in touch with

4, Wife will get exclusive use and possession to the marital home and associated
properties located on 11925 Baker's Lane in Clear Spring, Maryland. Other than Husband going
back on prearranged basis with the police to remove personal property items (as further detailed
below), Husband (and any agent of Husband) will not visit the property or the adjoining rental
properties, or drive along Baker's Lane while this Agreement is in effect. Husband and Wife
agree that there may be occasions where Husband will to the marital home and associated
properties to pursue repairs, and those occasions will be governed by the terms below.
5. Husband will be permitted to return to the outbuildings located at 11925 Baker's
Lane and associated properties for the purposes of removing his personal property, in thepresence of a police officer. This will be prearranged with both parties. The items that Husband
‘will be allowed to take will be his trailer, with work equipment, contents of the shed(s)
including..., campaign signs and other work supplies located below the garage rental unit, his
clothing and personal effects (which wife has prepackaged and placed under and overhang at the
property), and the following items: deer antlers, if on property.
6. From September 1 through the end of February each year, Husband will have
exclusive access to the Frost, West Virginia property belonging to the parties. Neither Wife, nor
agents of Wife, will visit the property during this timeframe,
7. From March 1 through the end of August of each year, Wife will have exclusive
access to the Frost, West Virginia property belonging to the parties. Neither Husband, nor agents
of Husband will visit the property during this timeframe.
8. Throughout the year, Husband will be entitled to exclusive use and possession of the
roughly eighty (80) acres that the parties own in Pendleton County, West Virginia
9. In order to help Wife with her living expenses and to pay her bills, Husband and Wife
agree that Wife will continue to collect and keep the One Thousand Six Hundred Dollars
($1,600.00) per month rental income derived from the rental properties that adjoin Baker's Lane.
As continued consideration of this agreement, Husband also agrees to give Wife an additional
‘Seven Hundred Dollars ($700.00) per month, to be paid on or before the first day of each month.
Wife acknowledges that Husband has already deposited into a joint account that payment
associated with August, 2018, Wife will then be responsible for paying the electric bill for the
residence, as well as any additional utility bills for the residence. Husband will continue to
