 STATEMENT OF PROBABLE CAUSE
 
The Complainant states that the following facts establish probable cause:
 
On August 8, 2017, Detective Kroshus with the Woodbury Police Department, who is currently assigned to
the East Metro Human Trafficking Task Force, discovered an advertisement on the website backpage.com
that was associated to the business "Woodbury Wellness." Backpage.com was a common resource used
for posting commercial sex advertisements but has since been seized by the United States Government
and is no longer active. Detective Kroshus is aware through training and experience that it is common for
businesses and private persons to place advertisements in the commercial sex marketplace to notify sex
buyers of their locations. These advertisements are commonly posted in the escort, dating, or massage
section of each website. 

Detective Kroshus observed the Woodbury Wellness advertisement in the massage section of
backpage.com which depicted photographs of four young, Asian females and images of the front and
interior of the business. The City of Woodbury has ordinances that require licensing of massage parlors
operating within the City. Detective Kroshus determined that the current owner and manager is Shuxin Lan
(DOB: 9/24/1966), the defendant herein. The defendant applied for a business license for "Woodbury
Wellness Center of LAN, LLC" in May of 2017, and her license was approved. The defendant was not a
licensed massage therapist at that time but was granted approval to own/manage the business without
providing services. Woodbury Wellness Center is located in the City of Woodbury, Washington County.
Detective Kroshus determined that the email address associated with the backpage.com post was
whitebearmassage1979@gmail.com, and that the account was created in June of 2017, shortly after the
defendant applied for a license for Woodbury Wellness. It was also noted that the backpage.com account
additionally posted advertisements for "Orchid Spa" located in the City of White Bear Lake, Ramsey
County. 

In early January of 2018, Detective Kroshus noted that Woodbury Wellness was still posting
advertisements on backpage.com. Detective Kroshus learned that the account was now under a different
email address, and the account posted advertisements all over the United States. The IP geo location for
these posts were listed as China. Additionally, there were advertisements placed under this account that
listed an IP geo location of Los Angeles, California. Detective Kroshus also noted that this account posted
advertisements for massage parlor locations as well as traditional commercial sex ads that were located in
the "women-seeking-men" "dating" section of backpage.com. 

Officers observed reviews of Woodbury Wellness on a website which is a paid membership site known to
law enforcement that reviews and identifies illicit massage parlors. Reviews and comments on this site are
related to commercial sex and include describing the female service provider's physical characteristics
and sexual acts offered and/or received. The purpose of these types of websites is to inform persons who
are seeking sexual acts as part of their massage experience information on locations that provide sexual
acts and how much the sexual acts cost. Members will also provide reviews of the sexual experience.
Reviews of Woodbury Wellness on this website in 2017 and 2018 indicated commercial sex was occurring
during the ownership of the defendant. The review posted made claims that the sex buyer received a
"happy ending" which is further characterized as a "hand job" in the review. Another review made claims
that the sex buyer received a "hand job" and also that the provider was nude, and that the customer was
allowed to perform a sexual act on the provider. The additional "tip" or price paid by the sex buyers was
consistently listed as $40.00 for receiving a "hand job." 

Members of the East Metro Human Trafficking Task Force conducted surveillance at Woodbury Wellness

from June of 2018 through early September 2018. Detectives observed a steady customer flow of all male
customers. Detectives monitored this location at business opening and closing times, and noted that two
females appeared to be living inside the location. There were also times when only one female appeared
to be living in the location. The defendant was also observed occasionally transporting female employees
back to her residence in the City of White Bear Lake. On one occasion, Detectives observed the
defendant take one female employee from Woodbury Wellness and then drive to the Orchid Spa in White
Bear Lake, where she picked up another female employee and transported both employees to her
residence. The following morning, the defendant observed transporting both employees back to the
massage parlors they were picked up from. Pursuant to the issuance of a search warrant, Detective
Kroshus placed a covert GPS trafficking device on the defendant's vehicle. The GPS information illustrated
the defendant would often times travel between business locations. On one occasion, the vehicle belonging
to the defendant left her residence in the early morning hours and traveled Woodbury Wellness and then the
MSP airport. It is believed that the defendant was provided transportation to an employee that was living at
Woodbury Wellness to the airport. 

Detective Kroshus discovered that the defendant is also the listed owner for the Orchid Spa. Both
Woodbury Wellness and Orchid Spa have operating hours from 9:30 a.m. to 9:30 p.m. These business
hours are typical in other illicit massage businesses that have been investigated. Detectives conducting
surveillance have determined that none of the known and unidentified employees have transportation and
appear dependent on the defendant to bring them to and from each business. It is however, more frequently
observed that the females are living inside each business locations. 

Several customers were interviewed during traffic stops after they exited Woodbury Wellness to learn
about their services. On August 7, 2017, a male identified as S.K. reported that he has been a regular
customer since fall of 2017, and he learned about Woodbury Wellness from when they were posted on
backpage.com. S.K. stated he has seen five or six different Chinese females inside the business working
during his five or more visits in the past year. S.K. stated that he has received massages from three
different females including the female he saw on August 7, 2017. S.K. stated that all three employees
provided him a "hand job" or manual manipulation of his penis. S.K. stated that during the "flip" there was
no conversation about sexual acts but after a focused massage around his groin he obtained an erection
and the female employee used oils/lubricants to manipulate his penis to the point of ejaculation. S.K.
"tipped" the female employees $40.00 each time he was given sexual acts. S.K. stated that he purchased
an hour of massage for $70.00 during his visits and was allowed to touch to the employee's legs and
buttocks. 

On September 4, 2018, a male identified as T.S. stated that he was not provided sexual services on this
day, but he has received and been offered sexual acts by two other employees at Woodbury Wellness on
other occasions. T.S. stated one female appeared to be the manager or boss based on her interactions
with the other employees and his conversation with her. T.S. stated that one to two months prior he received
manual manipulation of his penis by this female during a massage. T.S. was shown a picture of the
defendant and he identified her as the female who provided him a sexual service one to two months prior.
T.S. stated that he also received a sexual act from a different employee two months prior. T.S. provided a
description of the female and was shown photographs of suspected employees of Woodbury Wellness.
T.S. believed that suspected employee T.Q. was the female that provided him the sexual service two
months prior. T.Q. applied to the City of Woodbury for a massage license in May of 2018, but was denied. 

In September of 2018, detectives were provided information from an off-duty Washington County Sheriff's
Investigator that he observed an unknown Asian female walking out to the back of Woodbury Wellness with
a black trash bag. As the female put the trash bag into the common business complex dumpster some of
the contents fell out. The Investigator observed several condom wrappers fall out of the trash bag.

On September 11, 2018, simultaneous search warrants were executed at Woodbury Wellness, White
Orchid Spa, and the defendant's residence. Detectives used an alternative light source device that emits
ultra violet light to detect bodily fluids such as ejaculate and/or vaginal discharge. The device was used in
the massage rooms during the search at Woodbury Wellness and White Orchid Spa. The rooms at both
locations were set up with a massage table with a sheet and towel draped over it, or a mattress lying on the
ground with a sheet and towel draped over it. At both locations detectives observed the presence of bodily
fluids in every massage room, with heavy concentration where a customer's groin area would be. 

Detectives located one female at Woodbury Wellness who was identified as X.H. X.H. stated that she
started working at Woodbury Wellness eleven days ago. X.H. stated that she has known the defendant
since January of 2018, and the defendant told her she needed help at Woodbury Wellness. X.H. stated that
she is not a licensed massage therapist in the City of Woodbury, but stated that she did provide massages
and was paid $20 per massage. X.H. denied providing sexual acts but stated that she was asked to
perform them by her customers. X.H. stated that she has been living at Woodbury Wellness since August
29, 2018 and stated that she pays the defendant $10 per day for rent. X.H. was in possession of the large
amount of US currency. 

Two females, Q.D. and F.H., were located at the White Orchid Spa. Q.D. denied proving direct sexual
services however did admit some of the male customers would ejaculate during the massage. Q.D. stated
that she would squirt oil on the customer's hands and they would masturbate to the point of ejaculation.
Q.D. was a former employee of Therapy Massage located in the City of Mahtomedi. The owner of Therapy
massage has since been sentenced in Washington County for felony promotion of prostitution. F.H. denied
providing sexual services in exchange for money. X.H., Q.D. and F.H. were provided information for
resources. 

During the execution of the search warrants, the defendant was located approaching a Bank of America
location in the City of Woodbury, in possession of over 7000 dollars of US currency. The defendant was
placed under arrest and transported to the Washington County Jail. The defendant declined to speak with
investigators. 

Numerous cell phones and documents were recovered from each search location. The electronic devices
are currently pending forensic examination.

determined that probable cause exists to support, subject to bail or conditions of release where applicable, Defendant’s arrest
or other lawful steps be taken to obtain Defendant’s appearance in court, or Defendant’s detention, if already in custody,
pending further proceedings. Defendant is therefore charged with the above-stated offense(s).
