MANIFESTATION

COMES NOW, the defendants, through the undersigned counsel, unto

this Honorable Court most respectfully avers;

1. That undersigned counsel was furnished a copy on June 18, 2018

of the Motion for Judgment on the Pleading by Counsel for the
Plaintiff Atty. Menchito L. Viovicente;

2. That hearing for said Motion was set on July 11, 2018 at 1:30 in
the afternoon.

3. That said Motion is violative of Rule 15, Sec. 5 of the Rules of

Court since the date of hearing was set more than 10 days from
the filing of the Motion;

Sec. 5. Notice of Hearing. The notice of hearing shall be

addressed to all parties concerned, and shall specify the time and
date of the hearing which must not be later than ten(10) days after
the filing of the motion.

 4. That even assuming that the said motion would be heard on
July 11, 2018, undersigned counsel would also not be available
on said date as the latter will be attending the Mandatory
Continuing Legal Education(MCLE) 6th Compliance at Sabin
Resort Hotel, Ormoc City scheduled on July 10-13, 2018.

WHEREFORE, premises considered, it is most respectfully prayed

that this manifestation be noted and considered.

Other reliefs as are just and equitable under the circumstances are
likewise prayed for.
