INFORMATION

The undersigned Assistant Provincial Prosecutor of

Laguna hereby accuses JOHN LLOYD DELA CRUZ, a resident
of Barangay Bagumbayan, Santa Cruz. Laguna of the crime of
“MURDER," committed as follows:

That on September 28, 2017 at about 6:45 O'clock in the

morning at Monserrat Subdivision, Highway, Barangay Sto. Angel
Sur, Municipality of Santa Cruz, Province of Laguna and within the
Jurisdiction of this Honorable Court. the above-named accused.
While conveniently armed with a Caliber .45 Pistol. marked
Federal with Serial Number N06 2203c, with intent to kill, with
treachery and evident premeditation, did then and there willfully,
unlawfully and feloniously attack, assault and shot one MARK
HELTERBRAND Y AGUILAR, with the said deadly weapon.
Thereby inflicting upon the latter multiple gunshot wound on the
different parts of his body, which caused his instantaneous death,
to the damage and prejudice or the surviving heirs of the victim.

Santa Cruz, Laguna native of Brgy Gisgis Sariaya, Quezon;

2. BRIEF FACTS OF THE CASE:

Investigation disclosed that on or about 6:45 in the morning of September 28, 2017 at
Monserrat Subdv., Highway, Brgy Sto. Angel sur, Santa Cruz, Laguna, Aforementioned suspect
armed with Cal 45 pistol with serial number N06 2203c, marked federal, made in USA,
treacherously shot to death the victim while latter was riding on his bicycle. Afterwards, victim
slumped with pool of blood, suspect finish the former by way of repeatedly shooting the victim
before casually left the scene. Follow up team this MPS launched a search the suspect and
yielded from him the fatal weapon he used.

3. Case is being brought for inquest by SPO4 Aga Mulach, Investigator on Case.

4. Disposition of the Case:

The respondent/suspect was interviewed and informed of his rights. He stated that his
lawyer is Atty. Alden Richards, PAO, Sta. Cruz, Laguna. The suspect is given the necessary
documents for his defense. There being reason to file a complaint, let the proper criminal
information be filed immediately today, 29 September 2017, 1:30 P.M., Sta. Cruz, Laguna.

The UNDERSIGNED, RICHARD GOMA accuses JOHN LLOYD DELA CRUZ of Murder
committed as follows, to wit:

That on September 28, 2017 at about 6:45 o'clock in the morning at

Montserrat Subdivision, Highway, Barangay Sto. Angel Sur, Municipality of Santa
Cruz, Province of Laguna. The above-named accused. While conveniently armed

nakita ko ang isang lalaking tumatakbo papalayo sa lugar ng insidente na nakasuot ng asul na
“Checkered” na damit at naka suot ng sombrero. Tumakbo patungo ang lalaki patungo sa Bliss
subdivision na kalaunan ay nakilala kong si JOHN LOYD DELA CRUZ.

Hinabol ko ang Suspect papuntang Bliss Subdivision na matatagpuan sa Brgy Patimbao

subalit hindi ko siya nabutan dahilan upang ako ay mag tanong tanong sa naturang subdibisyon
hanggang mayroong nakapag turo sa akin sa bahay ni Ellen Adarno na mayroong di umanong
pumasok na lalaki na tumutugma sa pisikal na diskripsiyon ng hinihinalang salarin.

Dahil malaki ang posibilidad na armado ang hinihinalang salarin ay inutusan ko ang mga
nasa loob ng naturang bahay na lumabas at makalipas ang ilang sandali lamang ay lumabas si
Ellen Adorno at ang kanyang asawa. Matapos na makumpirma mula sa kanila na si JOHN
LOYD DELA CRUZ ang lalaking aking hinahanap ay naroon. pinasok ko ang naturang bahay.
nag tungo ako sa ikalawang palapag ng bahay at doon ko nakita ang hinihinalang salarin at
doon ko siya na aresto matapos ko siyang basahan ng kanyang mga karapatan bilang akusado
at ng anti-torture Act. Matapos nito ay aking dinala ang akusado sa aming himpilan upang doon
lubos na maimbestigahan kasama ang mga ebidensyang nakuha kasunod ang pagpa medical
sa kanya sa pampublikong hospital.

ang biktimang si Mark Helterbrand na personal kong kakilala. Kausap
nito ang akusadong si John Loyd Dela Cruz sa kanto ng Monsserat
Highway, binati ko sya sa pamamagitan ng pag tango at dumeretso na
ako sa aking pag bibisikleta.

Nasa limang metro pa lamang nang malampasan ko si Mark at ang

akusado ay bigla na lamang akong nakarinig ng putok ng baril. Pag
lingon ko pabalik ay nakita ko si Mark na bumagsak. Nag tago ako sa
likod ng poste ng kuryente at doon ko nasaksihan ang akusadong si
John Loyd Dela Cruz na binaril pa ng tatlong ulit si Mark gamit ang
calibre .45 na baril. Matapos nito ay umalis si John Loyd at tumawid
patungo sa Bliss Subdivision.

Na Noong ikaw-28 ng Setyembre 2017 humigit kumulang 7:30 ng umaga

habang kami ay nag hahanda ng aking asawa para sa pag sisimula ng araw ay
dumating si JOHN LOYD CRUZ sa aming tahanan. Siya ay dating katrabaho ng
aking anak na si Christian. Suot ni John loyd ang isang “Striped” na asul na damit at
maduming sombrero. Hinahanap nya ang aking anak na si Christian dahil sa
kadahilang mag tatanong daw siya kung meron itong alam na trabahong maaring
pasukan.

Sa puntong ito ay dumating na si P/Insp Abueva at Sinenyasan ako ni John

Loyd na huwag akong maingay at huwag ko siyang ituturo. Narinig ko si P/Insp.
Abueva na inaatasan kaming lumabas ng bahay. Dahil dito kami ng asawa ko ay
agad na lumabas subalit si John Loyd ay umakyat patungo sa ikalawang palapag ng
aming bahay. Pag kalabas ko ay kinumpirma ko sa kanya na nandoon nga ang
kanyang hinahanap. Matapos nito ay inakyat nya sa ikalawang palapag n gaming
bahay ang akusado at dun nya na ito naaresto.

Nakita ko ang Striped na damit na pinagpalitan ni John Loyd sa “Folding bed”

ng aking anak, Sumbrerong kanyang isinuot sa upuan at ang Kalibre .45 na baril sa
aparador ng aking anak. Lahat ng ito ay isinuko ko sa kapulisan upang magamit na
ebidensya.
