Dear Sir,
We have been instructed to enter into a Nominated Sub Contract Agreement with you for the
execution of the above works for the sum of Rs. 26, 455, 335.27 (MUR Twenty-Six Million Four
Hundred and Fifty-Five Thousand Three Hundred and Thirty-Five and Cents Twenty-Seven)
inclusive of value added tax.

In connection with the above, please note that the Main Conditions of Contract shall apply mutatis
mutandis to the Sub Contract Works. You are therefore responsible for ensuring that you are fully
aware of the Main Conditions of Contract including but not limited to amendments made to the
standard FIDIC conditions of contract First Edition 2011.
Any changes made to the standard Main Conditions of Contract i.e. “FIDIC First Edition 2011” shall
also apply to their respective clauses pertaining to nominated subcontract agreement and it is very
important for you to ensure that you are fully aware of changes that have been made.
A copy of the standard Conditions of Contract is available at our Office upon appointment for your
perusal.
Programme of works
The start date shall be 09th January 2017, Taking Over shall be 05th June 2017 and delay damages
applicable are defined in the Main Contract Appendix To Conditions of Contract.
A copy of the programme of work ref POW R6 version 1 (13 No. pages) has been attached for your
perusal. You are requested to go over the same and discuss any concern or whatsoever, e.g. in relation
to sequencing of works, procurement, etc. with the Senior Contracts Manager, Mr. James McAra prior
to signature of contract.

Site Organigram
You are requested to submit a site organigram elaborating on the supervision that will be on site on a
full time / part time basis and agree the same with our Senior Contracts Manager. Any changes thereof
shall be communicated instantly to Mr. James McAra.
Performance Bond
You are to provide a Performance Bond as per Main Contract pro forma as per tender documents
Annexure ‘H’, reflecting 10% of the Contract sum and valid till end of 06th June 2019 within 14
calendar days from issuance date of this letter of award.
Financial Aspects
General
All issues related to financial aspects shall be addressed to the Senior Quantity Surveyor, Mr.
Dinesh Khoody (Cell No. 5 497 95 26), e-mail address Dinesh Khoody
dinesh.khoody@squaredealmcs.com who is primarily responsible for any monies due.

Interim application for Payment
Your monthly interim application for payment for cumulative work done shall reach our site office
th
by the 20 of the month to enable us to incorporate the same in our main application for payment.
Notwithstanding anything mentioned in any document, all payments shall be on a ‘back to back’ basis,
i.e. the Main Contractor shall pay the Nominated Sub Contractor within 7 calendar days from receipt
of reciprocal payment from the Employer.
Variation works
You are requested to send detailed cost for all variation works along with relevant back-ups (mails,
correspondence, site instruction, etc…) progressively during the respective month.
Re-measurements
Kindly note that all the quantities listed above are indicative and are subject to re-measurement if
deemed necessary, prior to the final account settlement.
Retention
Retention of 10% up to a limit of 5% of the contract sum shall be withheld throughout the duration of
the works based on your progress claim. Half of the retention shall be released upon receipt of Taking
Over Certificate.
Cession of Rights
Please refer to tender documents for standard contract pro forma.

We trust the above is in order. We would be grateful if you could confirm agreement with the terms
and conditions of the Nominated Sub Contract Agreement by initialing the bottom of each page and
signing where provided for.
A full set of this document is for your retention, the other initialed and signed copy shall be returned to
us within the next seven calendar days as from the date mentioned above.
We look forward to a successful completion of the works in collaboration with you and take this
opportunity to thank you for your input on the project so far.
