ABSTRACT

The environment furnishes all essentials for life and so there has been a close link between
the environment and human beings. Without a natural and congenial environment, human
existence is not possible on earth. In the quest of making life more comfortable the man has
always exploited the nature. Agriculture, industrialization and infrastructural developments
are the causes of exploitation of natural resources. Human activities create a variety of wastes
and bye-products which accumulate over a period of time and may become toxic to the
naturally growing plants, animal and the mankind. Indiscriminate use of fertilizers and
pesticides has added to the problem.

In recent years, higher judiciary has played important role in devising and monitoring the
implementation measures for pollution control, conservation of forests and wildlife
protection. The project aims to analyse how the environment protection measures in existence
have been evolved by the judiciary.

STATEMENT OF PURPOSE

1. How has the development of Environmental Law taken place in India?


2. What role has judiciary played in development of the same?

RESEARCH QUESTION

What role has the judiciary played in the development of environment protection laws in
India and how effective has the same been?

HYPOTHESIS

Judiciary has played a very important role in development of environmental protection laws
in India and without activism in the same the state of affairs would have been very different
from the present case scenario.
