WHEREAS, Republic Act 7160 otherwise known as the Local Government Code of
1991 empowers the Sangguniang Panlungsod as the legislative body of the city to enact
ordinances and appropriate funds for the general welfare of the city;

WHEREAS, Section 458, (a) (5) (ii) of the Local Government Code empowers the
Sangguniang Panlungsod to approve ordinances which shall ensure the efficient and effective
delivery of basic services and facilities as provided for under Section 17 thereof and to establish
markets, slaughterhouse, public terminals and authorize the operation thereof by the local
government unit;

WHEREAS, the establishment and development of local economic enterprises and public
utilities are provided under Section 3132 of the Local Government Code;

WHEREAS, Section 76 of the Local Government Code authorizes local government

units to design and implement its own organizational structure and staffing pattern taking into
consideration its requirements and financial capability, subject to the minimum standards and
guidelines prescribed by the Civil Service Commission;

WHEREAS, Section 68 of Ordinance No. 2009-316 read as follows:

"Section 68. Automatic increase of Rental Rates. - 1'he rate of rentals

under Section 67 of this ordinance shall be subject to automatic increase every
two (2) years at the rate equivalent to ten percent ·(JO%) thereof''

WHEREAS, the Iloilo City Terminal Market Association requests to subject the
automatic increase of 10% evefy three (3) years irtstead oftWO (2) )ieats.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City of

Iloilo, in session assembled, that:

Section 1. - Section 68 of Regulation Ordinance No. 2009-316 is hereby amended, to

read as follows:

"Section 68. Automatic Increase of Rental Rates. - The rate of rentals

under Section 67 of this ordinance shall he subject to automatic increase every
three (3) vears at the rate equivalent to ten percent (10%) thereof and shall take

P Section 2. - This ordinance shall tak~ effect ten (10) days after publication in a
newspaper of general circulation in the City of Iloilo.
