The Governance of Basic Education Act of 2001 RA 9155)


STATE POLICY
…to protect and promote the right of the citizens to quality education and to make such
education accessible to all by providing all Filipino children a free and compulsory education
in the elementary level and free education in high school level.

GOAL
To provide Filipino children with the skills, knowledge, and values they need to become
caring, self-reliant, productive, and patriotic citizens.

Powers, Duties and Functions at the NATIONAL LEVEL


Secretary of the Department of Education
A. Overall authority and supervision
B. Shall have the authority, accountability and responsibility
1. formulating national educational policies and basic education plan
2. promulgating national educational learning standards
3. monitoring and assessing national learning outcomes
4. undertaking national educational research and studies
5. enhancing the total development of learners through local and national programs
and/or projects
6. enhancing the employment status, professional competencies, welfare and
working conditions of all personnel of the DepED.
REGIONAL LEVEL

At the DIVISION LEVEL


1. Planning and managing, the effective and efficient use of all personnel, physical and fiscal
resources of the division, including professional staff development.
2. Hiring, placing and evaluating all division supervisors, school district supervisors, employees
both teaching and non-teaching personnel, school heads except the assistant division
superintendent.
3. Monitoring the utilization of funds provided by the national government and local
government units to the schools and learning centers.
4. Ensuring compliance of quality standards for basic education programs and strengthen the role
of division supervisors as subject area specialists.
5. Supervising the operations of all public and private elementary, secondary and integrated
schools and learning centers.

At the DISTRICT LEVEL


District supervisor shall be responsible for
1. Providing professional and instructional advice and support to the school heads and
leaders/facilitators of schools and learning centers in the district or cluster
2. Curricula supervision

At the SCHOOL LEVEL


School Heads shall be both an instructional leader and administrative manager.
Consistent with the national educational policies, plans and standards, the SHs shall have authority,
accountability and responsibility for the following:
1. Setting the mission, vision, goals and objectives of the school,
2. Creating an environment within the school that is conducive to teaching and learning,
3. Implementing the school curriculum and being accountable for higher learning
outcomes,
4. Developing the school education program and school Improvement plan,
5. Offering educational programs, projects, and services which provide equitable
opportunities for all learners in the community,
6.Introducing new and innovative modes of instruction to achieve higher learning
outcomes,
7. Administering and managing all personnel, physical and fiscal resources of the school,
8. Recommending the staffing complement of the school based on its needs and
encouraging staff development,
9. Establishing school and community networks and encouraging the active participation
of teachers’ organizations, nonacademic of public personnel of public schools, and PTAs
11. Accepting donations, gifts, bequests and grants for the purpose of upgrading teachers’
learning facilitators’ competencies, improving and expanding school facilities and
providing instructional materials and equipment. Such donations or grants must be reported
to the district supervisor and division superintendent.

POLICY OF EMPOWERING SCHOOL HEADS


All SHs with instructional, administrative and management authority, accountability and
responsibility over all personnel, physical, and fiscal resources of the school for a more effective
and efficient delivery of quality basic education.

Administrator’s Obligation
1. Develop and maintain a healthy atmosphere conducive to the promotion and preservation
of academic freedom and effective teaching and learning, and to harmonious and progressive
school-personnel relationship
2. Assume and maintain personal behavior in his work and in dealing with students,
teachers, academic non-teaching personnel, administrative staff, and parents or guardians, and
parents or guardians.
3. Render adequate reports to teachers, academic non-teaching personnel and non-teaching
personnel and non-academic staff on their actual performance and counsel them on ways of
improving the same.
4. Observe due process, fairness, promptness, privacy, constructiveness and consistency in
disciplining his teachers and other personnel.
5. Maintain adequate records and submit required reports to DepED.

Administrator’s Duties
1. To exercise the due diligence expected of a good father of a family in the management of
the school so as to prevent any damage or injury to life or property inside or outside the
school campus.
2. To see to the financial viability of the school and to cause payment of its obligations when
they become due.
Principles of Shared Governance of Basic Education
1. Shared governance is a principle which recognizes that every unit in educational
bureaucracy has a particular role, task and responsibility inherent in the office and for
which it is principally accountable for outcomes.
2. Democratic consultations shall be observed in the decision-making process at
appropriate levels. Feedback mechanisms shall be established to ensure coordination and
open communication of the central office with the regional, division and school levels.
3. Accountability and transparency shall be operationalized in the performance of
functions and responsibilities at all levels.
4. Communication channels of all field offices shall be strengthened to facilitate flow of
information and expand linkages with other government agencies.
